Inclusion of Individual Internet Users within the City-TLD Multistakeholder Governance Environment

Fellow NARALO Members, ICANN granted the city of New York the right to issue domain names using the .nyc TLD in January 2014. As of May 1, 2016, 76,682 names had been issued to individuals and organizations. Connecting.nyc Inc. is an At-Large Structure associated with the ICANN and an active participant in its multistakeholder governance process. With our focus on the development of the .nyc TLD as a public interest resource, I recently reviewed the .nyc Registry Agreement page on ICANN's website <https://www.icann.org/resources/agreement/nyc-2014-01-23-en>, and noted that four changes to the original agreement had been recorded there. Three were under the heading "Authorization(s) for Release of Reserved Names," as follows: * All Digit/Digit, Letter/Digit, and Digit/Letter Two-Character ASCII Labels at the Second Level (01 December 2014) <https://www.icann.org/en/system/files/files/spec5-amend-two-char-01dec14-en…> * Letter/Letter Two-Character ASCII Labels (26 May 2015) <https://www.icann.org/sites/default/files/tlds/nyc/nyc-auth-ltr-ltr-26may15…> * Letter/Letter Two-Character ASCII Labels (14 March 2016) <https://www.icann.org/sites/default/files/tlds/nyc/nyc-auth-ltr-ltr-14mar16…> The fourth was listed under "Amendment No.1 (31 March 2016)": * PDF <https://www.icann.org/sites/default/files/tlds/nyc/nyc-amend-1-pdf-31mar16-…> This PDF amendment deals with the addition of 14 new data fields to the Registration Data Directory. The existence of these changes came as a complete surprise to me. As Chair of Connecting.nyc Inc., a NYS nonprofit created in 2007 to engage and educate New Yorkers about the use of the .nyc TLD, and as an active participant in ICANN's governance processes through our association as an At-Large Structure, I had presumed we would have been consulted about changes to the registry agreement. My desire for inclusion of individual Internet users in consultations about future registry changes provides the basis for this message. Note: An earlier email on this general subject led some to think I was challenging the 4 registry changes as being out of compliance with approved ICANN procedures. This is not the case. And based on my perusal of precedent references kindly provided by a fellow ALSer (see them below), I’d say that ICANN and the city followed the “letter of the law.” However... However, I do question the efficacy of a process that allows changes to a registry agreement without taking full advantage of the existing machinery of governance, i.e., the multistakeholder model and the extant At-Large Structures (ISOC-NY is also a NYC based ALS). With the Internet community having settled on a multistakeholder governance model, one would imagine that our ALS would be involved in changing the basic agreement that guides the operation of the .nyc TLD. But perhaps we were excluded from the review process for good reason, for example, that the city’s governance structure more effectively represents the needs of the various stakeholders than the Internet’s multistakeholder model. After all, New York City does have a democratic governance system, and a general election was held in November 2013. Perhaps it's thought the people thereby approved or acquiesced to the registry agreement, and thus, in the eyes of ICANN, a city-based ALS should not have a formal role. If this is the situation, I would appreciate someone pointing me to the relevant guidelines. For indeed... At this point, the city is acting as if there is no role for its residents in a traditional multistakeholder model. While there was a 20 month period during which the city acknowledged the role of the residents and users through a .NYC Community Advisory Board (May 2013 - December 2014), the city unilaterally decided that entity should cease to exist on January 1, 2015. And to my dismay, it followed this decision by eliminating all reference to the .NYC Community Advisory Board’s very existence from the city’s website. NOTE: To my knowledge city government has not been provided with any requirement or guideline about the operation of an inclusive, multistakeholder governance process for the .nyc TLD. So I’m not faulting the city administration for the current state of affairs. To do so would be to assume greater awareness and concomitant responsibility about this new resource than is seemingly warranted. What’s to be done? This email seeks the assistance or NARALO in learning if Connecting.nyc Inc. should be provided with an opportunity to consult and consent to future registry agreement changes. We see precedent for this with the .us TLD. The .us TLD is currently governed with the assistance of a .usTLD Stakeholder Council: http://www.neustar.us/ustld-stakeholder-council/structure-and-history/. The council has a charter <http://www.neustar.us/ustld-stakeholder-council/charter/>, operating procedures <http://www.neustar.us/ustld-stakeholder-council/ustld-stakeholder-council-o…>, a membership (which is appointed by the contractor!), and operational parameters (see usTLD Administrative Component graphic below). If it is the consensus that we are inappropriately outside the extant "consultation loop" I suggest that NARALO initiate a review to determine if the current process should be changed to more closely align with the tenets of the multistakeholder governance system that underpins the operation of ICANN and the Internet. The ALAC did comment on these and explicitly said we did not see any problems with that. This was a result of discussion and consultation within-At-Large. The net result was that we supported the release of such names. Note that the approval to release such names does not compel a registry to release them, it only allows them to make such a decision. * You can see the history of our full process on this by going to https://atlarge.icann.org/policy-summaryand doing a search on statement titles including the words TWO CHARACTER DOMAIN. * The contract amendment to include additional RDDS fields was made at the explicit request of the registry to allow .nyc to satisfy the nexus requirements of the registry (that is, to allow verification that the registrant does have a connection with New York City (http://www.ownit.nyc/policies/nyc_nexus_policy.php) The request by the registry can be viewed at https://www.icann.org/en/system/files/files/rsep-2016002-nyc-request-04jan1…. Such Registry Service Evaluation Process (RSEP) requests can be viewed athttps://www.icann.org/resources/pages/rsep-2014-02-19-en. The process requires a formal public comment only if there is the possibility (based on a "quick look" review) of a security or stability issue (which it did not in this case). * The RSEP is the result of one of the early GNSO Consensus Policy Development Processes - http://gnso.icann.org/en/issues/registry-services/final-rpt-registry-approv…. That process was of course subject to public comments and the resultant policy was widely supported.

I felt a tad guilty last week that I got so wrapped up in the excellent Hong Kong <http://isoc-ny.org/p2/8535> and Curacao <http://isoc-ny.org/p2/8539> events that I never sent out notices on Eurodig <http://www.eurodig.org/eurodig-2016/>, which was packed with ISOC speakers <http://www.internetsociety.org/events/eurodig-2016>, and the Decentralised Web Summit <http://www.decentralizedweb.net/> which had folks like Vint and Tim. I expected that everyone knew already, and also I could later link to the nicely segmented archived webcasts. Delay Tolerant Networking one might call it. Perhaps I was over optimistic. Because as far as Eurodig goes, the only video currently available is the Council of Europe's Director General briefly bemoaning bad stuff on the web <https://www.youtube.com/watch?v=wUNXpvB1Irs>, and as for the other, just one huge decentralized 8 hour block <https://youtu.be/Yth7O6yeZRE>. Call For Founding Volunteers: Association of Internet Users

I invite the community to get involved in a new project: the Association of Internet Users <http://www.aiu-us.org/> The Vision - what does success looks like? Who? Membership in the AIU is open to individual Internet users. Organizations have voice through their members, but no direct vote. AIU members will have the capacity to identify with particular organizations through mutual assent. * 67% of the 315M people in the U.S. hold drivers licenses and 17% are AAA members * 34% of the U.S. population are senior citizens and 11% are AARP members * 29% of the U.S. population are gun owners and 1% are NRA members * 85% of the U.S. population use the Internet and 0% are AIU members If the AIU conservatively aims for a 5% membership among Internet users, it outstrips all of these organization barring the AAA, which it rivals. To be clear: I am very specifically focusing on the United States. That said, it is my hope and dream that this vision is replicated internationally as appropriate and meaningful to people elsewhere. How? * Members can use a feature rich website with multiple communication vectors. * They can attend and participate in regular local meetups for members and the curious. * The AIU will cultivate relationships with the private sector, academia, the technical community, and other non-profits. What? Services * Membership organizations typically offer discounts for members through agreements with service providers. For the AIU, likely options would be software, hardware, tech support, classes, shipping for ecommerce, and special member offers. Education * One prime focus is educating users on Internet policy. I've been involved in this effort for many years at many levels. The AIU offers to help everyday users who want to know more about the Internet by offering them information and discussion. * The AIU is structured around the four areas of access, association, expression, and sharing and each is dependent upon the previous areas. Online expression means little to those without access or who lack the ability to connect to those they want to connect to. These four categories neatly encompass the issues of the day such as network neutrality and file sharing, for instance. * Multiple tools will be offered such as discussion forums moderated by experts, AMAs, online courses, and meetups; in short, an array of offerings that meet the needs of users/members. * The AIU will connect interested members interested in global Internet governance to organizations such as the IGF, ICANN, and ISOC. Advocacy * Unlike the AAA, AARP, and the NRA, the AIU's policy advocacy will be solely directed by the membership. To that end: * A round of (born-mobile) voting on a salient issue preceded by focused discussion on an issue. * Voters who supported the majority position will work with staff and the Board to craft a polished position document. The draft will be the work of the membership with staff taking an editorial role. * The AIU membership also has the capability of issuing a minority advocating a strong but dissenting position in the same manner. * The drafting teams submit final positions to the Board and AIU administration which may * Veto a position by asserting and showing a position does not represent the will of users (this is a safeguard against hostile/malicious takeover) * Refer a position back to the drafting team for revision to address an important but overlooked issue. * Adopt the position. * To be clear: the board does not set the organizational policy agenda. * Policy positions will then be disseminated in a manner consistent with the restrictions of being a 501c3 organization under U.S. tax code. * Policy positions will also be disseminated by a sister organization to the AIU organized as a 501c4 which allows for greater political advocacy, but which sole charter-bound purpose will be to advance the policy directives of the AIU Why - what's my reason for choosing to do this? Quite simply, it needs to get done and no one else is doing it. In recent years we've had public reactions over SOPA/PIPA and network neutrality. In one case, the public was led by Google and the Internet industry as well as advocacy organization, and in the other by John Oliver and the media. I believe that the time is now for a truly bottom-up advocacy organization with organic leadership to tell government what Internet users want. It's just that simple. Now - or how do we get there? * Incorporation into a nonprofit 501c3 organization * Gathering of human resources * Volunteers who want to help and who have skills and knowledge * Gathering of financial resources * Grant applications * Development * Gathering material resources * Access to the nonprofit resources available from the private sector * Assessment of resources * Discussion among interested volunteers about available strategies to get from start-up to national organization * Form implementation strategy with knowledge of available resources * Execute the strategy Why you?
