Dear all, Please be informed that the poll to assess the sense of all members of the Working Group, in relation to certain types of design marks (i.e. stylized and composite marks) and to treatment of geographical indications, is now open. Please be sure to fill in your response by 23.59 UTC on Monday 10 July: https://www.surveymonkey.com/r/WV26DQK. IMPORTANT NOTE: * The Working Group co-chairs, assisted by staff, have developed a Reference Guide containing relevant definitions (i.e. of “stylized marks” and “composite marks”) as well as of relevant examples. This Reference Guide is attached for your convenience, and it should be consulted as Working Group members go through the survey, which consists of 11 substantive questions and we believe ought not to take too much time to fill in. Dear Working Group Members, Below are the action items from the WG’s face-to-face meeting on 29 June in Johannesburg. The action items, notes, AC room recording, transcripts and documents used in the meeting are posted on the meeting wiki page here: https://community.icann.org/x/qwffAw. You will find the majority of comments made during the meeting have been captured in the notes, and those that need to be incorporated into the next iteration of a working document of refined Charter questions, will be done by staff. This will be subject to review by the WG members. However, in some cases, Mary and I may be following up individually with participants from the meeting in Johannesburg (particularly those who are not members of the working group) to be sure that all comments have been accurately captured. Action Items for Staff: * Add bullet in preamble of Sunrise questions: Have abuses of the Sunrise period been documented by registries and registrars? * Staff to add suggestions on refinements to questions to the latest version of the Sunrise Registrations and Trademark Claims questions – to be reviewed by the Working Group members * Staff to compile all questions asked in Adobe Connect chat, and forward to the Working Group mailing list 2. Action Items for WG Members: * Question 2 of Sunrise questions: Working Group members to review and suggest rewording of the threshold question * Question 9 of Sunrise questions to be reworded to provide more clarity on its purpose (Suggested rewording: Should the scope of Sunrise Registrations be limited to the categories of goods and services for which the trademark is actually registered and put in the Clearinghouse?) * Standard pricing at general availability should be defined by the WG, possibly as a baseline to compare Premium Pricing to * On Trademark Claims Question 4: i. Dear all: We wanted to quickly point out a potential issue with the survey with respect to disclaimers. The survey does not appear to distinguish between stylized and composite marks where all textual elements are disclaimed, versus the same marks where only a part of the textual elements are disclaimed. We have consistently asserted in this working group that only marks where all textual elements are disclaimed should be excluded from the Clearinghouse. Exclusion of all stylized and composite marks that include any disclaimer would undoubtedly and improperly exclude trademark registrations corresponding to numerous well-known brands. See e.g. WHOLE FOODS MARKET and Design (U.S. Reg. No. 1,557,320) for retail grocery store services, in-store restaurant services, and in-store bakery services in health foods and natural foods (no claim is made to the exclusive right to use ‘FOODS MARKET’ apart from the mark as shown). Dear all, Please find attached the reports from the Sunrise and Trademark Claims Sub Teams. As noted in the agenda below, these will be presented by the Sub Team chairs for a brief initial discussion by the Working Group on the 21 June call, and will form the basis for further deliberations by the Working Group during the 3-hour open Working Group meeting at ICANN59. For each report/table, the updated questions and/or proposed alternative formulations of the original Charter questions have been put in bold font – this will be Column 3 for the Sunrise report (titled “Proposed Notes or Alternative Wording”) and Column 2 (titled “Updated Question”) for the Trademark Claims table.
