GAC recognises that such a process could help provide data on key questions relating to root scaling, staff administrative workload, and the different types of strings in the first round. However, there is still significant ambiguity about the purpose of such an EoI: mere data gathering or mandatory pre-registration. GAC notes that in the latter case the EoI could have a significant impact on the new gTLD program and that it should not prejudice the treatment of some outstanding policy issues. In this context, the GAC would like to express concerns regarding the consultation process, including that: - the first call for comments in November - December 2009 had very limited visibility and duration; - the objections raised in those limited consultations were not sufficiently examined in the summary of comments prepared by staff; - no request has been made for GAC's opinion, despite the clear public policy implications of the proposal (cf. Article III Sec 6 1 c. of the Bylaws); and - if the Board takes a decision in February 2010 on the EoI, there will have been no opportunity for face-to-face community interaction on this important new proposal before the final decision (contrary to Article III, Sec. 6 2 of the Bylaws). To co-ordinate the global Domain Name System in the public interest, and make its decisions in an accountable and transparent manner as requested by the Affirmation of Commitments, ICANN must provide an opportunity for broad cross-community interaction on this important process before final decisions are made. The GAC believes that the risks raised by the current draft EoI proposal must be more thoroughly evaluated. In particular, the proposed EoI model may: - give an unfair advantage to some ICANN participants who could pre-empt the most valuable strings before the rest of the world is fully aware of the gTLD program; - allow a speculative market for "EoI application slots"; and - penalize developing country applicants, and small non-profit TLD projects that none-the-less operate in the public interest. GAC recalls its March 2007 Principles on new gTLDs and intends to provide further comments on the EoI proposal before or at the Nairobi meeting, taking into account reactions by the community and comments posted. In view of the above, the GAC therefore advises the Board to: - avoid taking a decision on the EoI at its February meeting and defer it until the next ICANN Public meeting. A premature decision could trigger requests for reconsideration and further derail the discussion; - request that staff facilitate a full cross-community deliberation on the EoI at the next ICANN Public meeting, prior to any final decisions; and - ensure that the second summary of comments clearly documents the respective interests of respondents. MOTION TO APPROVE PROCEDURES FOR THE 2010 ELECTION OF BOARD SEAT 13 2. A redlined revised version of 'GNSO Operating Procedures' containing procedures for election of an ICANN Board Director to fill seat #13. I am hereby making the motion referenced in item 1 above. I apologise for the last minute nature of this motion and for the fact that it misses the 8-day deadline for motions stated in the GNSO Operating Procedures. Because of the lateness, we will have to approve an exception to the 8-day requirement before we may act on the motion. Unfortunately, the task of filling seat #13 was missed until just a few days ago and I take responsibility for that. Thanks to Glen for catching it. As you can see in the motion itself, the ICANN Bylaws require very quick action on this election and hence give us very little time to act. We just consulted with the General Council's Office today and learned that a 21-day comment period is needed for approval of the Procedures. Margie kindly wrote the motion in a way that allows us to move forward quickly and meet the Bylaws requirements if the Council approves the motion. Please forward this motion to your Stakeholder Groups and Constituencies right away. I understand that there will be inadequate time to obtain feedback, but I believe that the proposed procedure is non-controversial and consistent with the intent of the Bylaws changes approved last year allowing for the Contracted Party House to elect the Director for seat #13. Tony Holmes ISPCP Chairman ISP & Connectivity Providers Constituency Constituency Comments on New gTLD Program - Draft expression of Interest/Pre-Registrations Model The ISPCP welcomes the opportunity to comment on the Draft expression of Interest/Pre registration model. The new gTLD program will have a strong impact on both ISPs and Network Operators, and the ISPCP considers the stability and security of the DNS is of prime importance to ISPs and the community that it serves. The ISPCP is reviewing the Expression of Interest (EoI) concept with great interest, and asks the board to consider the following issues in its discussion of the EoI. EoI may be a pragmatic approach and, as we go forward, and a more reliable tool to measure the true level of demand for new gTLDS of different categories. While many concerns remain regarding the EoI process and circumvention of the DAG, the ISPCP is mindful of the beneficial impact of the EoI. The data collected will help clarify and address two of the overarching issues: - Economic demand and impacts - Root scaling issues. It will also provide to ISPs and Network operators useful information that could assist in preparing for this fundamental change. For the EoI data to be fully representative, and to minimize gaming, the EoI should be mandatory for the first round of applications, and for the same reason, a deposit should be required. The ISPCP supports the principle that the deposit should be refundable if the new gTLD program is not launched within a specific period of time that would be known to all EoI candidates. But what is not clear is the timeline in which this is expected to happen and what the conditions will look like for launch of the EoI applicants. We understand that there may be amendments to the Applicant Guidebook and major changes to the RFP following the analysis of the results of the EoI. It is indeed important to assess the interest of the community for this process and amend the process accordingly to better serve it. However, if such amendments are required and have a significant substantive impact on a particular application because of its nature or characteristics (e.g. string or category of application/applicant), the EoI could create false expectations. We ask that ICANN elaborate on the contractual issues that will arise if the Applicant Guidebook conflicts with the EoI process. The EoI objectives are to clarify the impacts of the RFP related to the overarching issues. In this respect, we do not see the value of making public the participant and string information without the explicit consent of the requestor. Knowing the character string and the requestor's identity will not help evaluating the impacts for the above issues. Worse, in the absence of mechanisms in place like appeals, contention/dispute resolution, etc, such disclosure will result in confusion or legal actions without any mechanism in place for the potential applicant and/or its contender(s) to address them. This can only create confusion and uncertainty. A potential applicant should therefore be granted confidentiality for the string requested and/or on its identity if it so requests and public information should be restricted to what is necessary for the community to address in an efficient way the overarching issues. The EoI should aim to help to solve or to have a better view on overarching issues, not to create more confusion in the process, nor to further delay the process for gTLDs expansion. The EoI is a useful tool to gauge impact of the new TLD process, however there needs to be greater clarity and consideration of the concerns raised by the community prior to its launch.

Attached you find our draft amendment which is targeted to provide more flexibility to the Review Teams in order to let them organize their support teams themselves rather than to constitute support teams in advance.
