At-Large community involvement in policy development

Dear Community: In order to broaden the opportunities for At-Large throughout the world to get involved in the development of policy throughout ICANN, the existing liaisons which ALAC has appointed to the various standing bodies of ICANN is asking for volunteers! Mailing lists have been established to help the existing liaisons get some help - these are big jobs for one person to handle as they sometimes involve participating in several different committees or working groups. There is no recognised voting system in the international world which I am aware of which counts abstentions as votes. This is also true in the corporate world. As background, I can make these statements not only based upon 20 years of working with international organisations and participating in treaty making conferences, but also because I have recently read the authoritative work on rules of procedure of international conferences and standing committees of international organisations, and gone through the UNGA rules, the UN Model Rules, and the ECOSOC rules in order to come up with draft rules of procedure for At-Large meetings. It would be unwise to go against all established precendents and count abstentions as votes. If you were to do that, it would be very easy to argue that the vote counting method was not valid. This is also logical - if you think about it, counting abstentions as votes means that you are basically counting an abstention as a 'no' vote. If people meant to say 'No', they would have voted that way. Indeed, a number of voters in this election have specifically said that they were abstaining because they didn't have time to properly analyse the situation and didn't feel comfortable voting either way. This sensible approach should not be used to turn their vote into a 'no' vote. Ah, too true on the rude. Sorry about that its just rather hard when there are those trying to be constructive and then just keep getting pulled down and pulled down. Point well taken, though. Unfortunately, those that you are describing are in the minority. The rest of us (on both sides of the border) are trying to keep things moving and are trying to encourage more and more to participate in order to broaden the number of ALSs - even to the point of trying to be more inclusive (eg the org-of-orgs thing). ICANN Opens Comment Period on Telnic Proposal 11 May 2007 On 27 April 2007, ICANN posted for public information a proposal from Telnic Ltd., the sponsor of the .TEL top-level domain, to amend the .TEL Registry Agreement. Specifically, Telnic is seeking to alter the public display of Whois for TEL customers pursuant to Appendix S, Section VII of the .TEL Registry Agreement (http://www.icann.org/tlds/ agreements/tel/appendix-s-07apr06.htm#Part7). (Telnic intends to launch registry operations in late 2007/early 2008.) Telnic’s request states that they have been in communication with the UK Information Commissioner’s Office concerning Telnic’s current contractual obligations on Whois. However, there is no pending enforcement action against Telnic, therefore this is not a situation that would trigger the Draft ICANN Procedure for Handling Whois Conflicts with Privacy Law (http://gnso.icann.org/issues/whois- privacy/whois_national_laws_procedure.htm). In addition, this change is being proposed while discussion continues within the GNSO Policy Development Process on Whois. Telnic (and all gTLD registries) will be required to comply with new Whois consensus policy when approved by the Board. As provided for by existing consensus policy (http://www.icann.org/ registries/rsep/rsep.html), ICANN has undertaken a preliminary determination period to determine whether the proposed service might raise significant security or stability, or competition issues. ICANN's determination is that the proposed amendment does not raise such issues. The next step in evaluation is that (because implementation of the proposal would require a change to the .TEL Registry Agreement) ICANN will post the proposed amendment, solicit public comment and refer the proposal to the ICANN Board for consideration. ICANN San Juan: Invitation for North American ALS community

(French version to follow in due course) Dear North American ALS Representatives: ICANN is pleased to invite one representative from each accredited and applicant ALS to attend the San Juan ICANN Meeting in June. The San Juan ICANN Meeting will be held from 25th to 29th June – further details may be found at http://www.icann.org/meetings/sanjuan - and will feature tutorials, workshops, and stakeholder meetings on a variety of issues of interest to end-users (such as internationalized domain names and the introduction of new top level domain names), as well as public forums and a public meeting of ICANN's Board of Directors. There is expected to be a total of one to two sessions of the North American ALS community as part of the San Juan meeting. The first is scheduled for Sunday, 24th June, from approximately 09:00 to 17:00, with a break for lunch and coffee breaks in the morning and afternoon. If another meeting is required, it will be scheduled so that it allows all of you to attend the other ICANN events with as few conflicts as possible. Should your MoU with ICANN be completed on or at the San Juan meetings, and subject to agreement by the Office of the General Counsel on the willingness of ICANN to sign the text you agree on, a signing ceremony will be arranged in which those ALSes who wish to participate will be able to do so. Like those of all the other regions, this will be done as a part of the main public meeting on Thursday morning and will be witnessed by the Board of Directors, with signing by Paul Twomey, the Chief Executive of ICANN on behalf of ICANN. We will work with you in the interim to determine a draft agenda for your meetings. Of course, some of the agenda items are dependent upon your pre-conference work on your Operating Principles, Code of Conduct, and draft Memorandum of Understanding to form your Regional At-Large Organisation with ICANN, as this will determine how much of the discussions, if any, will be about these documents and how much will be focused on other matters, including elections for regional officers if those are not concluded in the remaining weeks from now until the June meeting. Conference documents, draft proposals, and agendas will be published online on the NARALO website and linked to the NARALO pages on ICANNWiki. MEETING VENUE: ICANN will make all the technical arrangements for the meeting. REMOTE PARTICIPATION: Remote participation via voice will be available for those who are unable to attend in person. Further details about this will be provided on the wiki pages devoted to the meeting. MAIN ICANN MEETING ACCESS: You may register for the main ICANN meeting from the Lisbon meeting page as above, or you may choose to register upon arrival. There is no fee for registration in either case. TRAVEL SUPPORT: ICANN is able to provide travel support and hotel accommodation for one representative of each At Large Structure, and candidates for ALS status, who have identified themselves as requiring travel assistance, as follows: Airfare, to and from San Jan, by economy class; Hotel accommodation at a hotel TBD – for the the period from the 23rd to 28th June inclusive; Airport transfers to and from the hotel; A new travel policy is in the final stages of being put into place. This will feature one of the following possible methods to handle costs of meals and other incidental costs (ground transportation if necessary to and from your home airport and the like): 1) A reimbursement-based system where you keep your receipts and submit a claim for them after the fact. 2) A lump sum payment made to you in advance of the meeting to cover these costs, in which case you do not need to submit expenses or ask for reclaiming of expenses, or; 3) A per-diem payment made in advance to you to cover these costs. The attached travel policy details all that you need to know about the travel and subsistence assistance provided by ICANN. Please read it carefully. Once a final determination on the above matters is made, you will be informed of it in detail. VISAS: Please see the attached policy for more information. At-Large Request for an Issues Report on Domain Tasting

Dear Community: I am pleased to forward you the email below. At-Large has now become the first advisory committee ever to request an Issues Report of the GNSO Council on an issue of policy. The report is to be delivered to the GNSO Council by 24th May 2007. The At-Large request was supported by other ICANN constituencies, thanks in large part to the hard work of ALAC GNSO Liaison Alan Greenberg. Having multiple constituencies supporting a request like this is very important to the next steps in the Policy Development Process.
