Notice of Motion: update to ALAC advice on gTLDs

Hello, This message is to announce my intention to move this motion at the *JANUARY* ALAC meeting. This is being done in order to enable discussion to take place -- within ALAC, its gTLD working group, and the RALOs -- to determine the response to this issue which has been IMO simmering throughout the At-Large community. We are told by many (and officially by ICANN) that the program is set and we should stop complaining, But to refuse to express the point of view of the public interest within ICANN -- even if it is contrary to the predominant wisdom -- if to fail at the very basics of At-Large's bylaw-mandated role. As one of the ALAC representatives for North America it is important for me to know the NARALO sentiment. As the proposer of this motion I guess my own point of view is laid bare; but if the region is mostly against it I will act accordingly. - Evan ------------------------------------------------------------------------------------------------------ WHEREAS end-users and governments have only been invited to participate in the new gTLD program long after its foundation principles were determined; WHEREAS most of the problems identified by the ALAC in its Mexico City Summit declaration related to the new-gTLD program have not been satisfactorily addressed and indeed some have worsened; WHEREAS numerous complaints from governments, intergovernmental organizations and other bodies have indicated that law enforcement and public-protection measures in the current design of the gTLD program are insufficient; WHEREAS the ICANN Board, without explanation, has refused the cross-community endorsement of the Joint Applicant Support Working Group recommendations to reduce costs of new gTLD in developing economies independent of any fixed fund; WHEREAS the absence of a staggered release schedule or a fixed timetable for future rounds severely inhibits ICANN's ability to correct mistakes in the proposed application round; and WHEREAS ICANN has still not convincingly demonstrated the end-user need or benefit of a simultaneous launch of hundreds of new TLDs; RESOLVED THAT the At-Large Advisory Committee (ALAC) convey to the ICANN Board and community the dissatisfaction of At-Large with the new gTLD program in its current form, and explicitly advises that its implementation would be harmful to the public interest. We request that implementation of the program be suspended until necessary public-interest modifications are implemented.

@Avri, +1. Unfortunately, Eduardo is quite right that the IANA relationship is central to the idea of U.S. 'ownership of the Internet'. This view has quite a following in political Washington; the political Luddites from the sticks leading the charge. American exceptionalism is but one of the issues that drive the alternative root movement. ANd if allowed to proceed without challenge, makes for an altogether illiberal world; fundamentalist fragmentation and the spread of a coven of Luddite communities around the world. IMHO, this future does violence to the global public interest. I am unanimous in dissent. BTW, most of us at the edge of empire well understand that from the point of view of more thoughtful Americans, the At-Large in ICANN is manifestation of continued engagement with the rest of the world. Just wanted to make sure everyone saw, and read, this letter on the new gTLD program sent by the FTC to ICANN on the 16th. It's a stinging letter and contains a number of elements that several of us have been saying for years. It also infers that ICANN is corrupted by contracted parties. You missed my point, though I suppose I made it somewhat opaque with irony. ICANN will listen to the FTC because it has to. Respond, I suppose, is correct also. ICANN doesn't really have to listen to the non-contracted parties in the multistakeholder environment, so it often doesn't. And it often doesn't bother to respond, either. At least as far as my ALAC experience goes. If it did, it could have saved us all a lot of time and effort in the new gTLD process. Because we said the things that are being said now by the FTC, by members of the US Congress, etc., four years ago. Repeatedly. Dear all, there has recently been discussion on the NARALO list, regarding hearings taking place in the US, including a hearing by the Senate Committee on Science, Energy & Transportation (held Dec 8) and a hearing by the House of Representatives Energy & Commerce Committee (held on Dec 14th -- i.e. today). Evan has kindly explained what these are and how they can accept comments, with clear links to the hearings. His message is included below. Please find enclosed, a draft of the first letter from Beau Brendler, NARALO Chair and co-signed by me, Chair of the ALAC, to be sent to the Senate Committee by closing of business day today. It will be sent via two paths, to the Chair of the Committee, John D. (Jay) Rockefeller. Since this draft letter is not a policy paper or ALAC Statement but rather a letter to tell the Senate "you wish to see end user input in ICANN, hey look, here we are", it does not require a formal vote, but it will be archived in our ALAC correspondence. We shall also submit a similar letter to Chair of the the House of Representatives Energy & Commerce Committee, Congressman Fred Upton, should this be required. I understand that Kurt Pritz will be one of the witnesses providing testimony in the hearing, so we'll have to see what gets addressed at the hearing and if a completion of information is required, no doubt that Beau and I would be happy to oblige. We, the undersigned, have played various parts in building a network called the Internet. We wrote and debugged the software; we defined the standards and protocols that talk over that network. Many of us invented parts of it. We're just a little proud of the social and economic benefits that our project, the Internet, has brought with it. Last year, many of us wrote to you and your colleagues to warn about the proposed "COICA" copyright and censorship legislation. Today, we are writing again to reiterate our concerns about the SOPA and PIPA derivatives of last year's bill, that are under consideration in the House and Senate. In many respects, these proposals are worse than the one we were alarmed to read last year. If enacted, either of these bills will create an environment of tremendous fear and uncertainty for technological innovation, and seriously harm the credibility of the United States in its role as a steward of key Internet infrastructure. Regardless of recent amendments to SOPA, both bills will risk fragmenting the Internet's global domain name system (DNS) and have other capricious technical consequences. In exchange for this, such legislation would engender censorship that will simultaneously be circumvented by deliberate infringers while hampering innocent parties' right and ability to communicate and express themselves online. All censorship schemes impact speech beyond the category they were intended to restrict, but these bills are particularly egregious in that regard because they cause entire domains to vanish from the Web, not just infringing pages or files. Worse, an incredible range of useful, law-abiding sites can be blacklisted under these proposals. In fact, it seems that this has already begun to happen under the nascent DHS/ICE seizures program. Censorship of Internet infrastructure will inevitably cause network errors and security problems. This is true in China, Iran and other countries that censor the network today; it will be just as true of American censorship. It is also true regardless of whether censorship is implemented via the DNS, proxies, firewalls, or any other method. Types of network errors and insecurity that we wrestle with today will become more widespread, and will affect sites other than those blacklisted by the American government. The current bills -- SOPA explicitly and PIPA implicitly -- also threaten engineers who build Internet systems or offer services that are not readily and automatically compliant with censorship actions by the U.S. government. When we designed the Internet the first time, our priorities were reliability, robustness and minimizing central points of failure or control. We are alarmed that Congress is so close to mandating censorship-compliance as a design requirement for new Internet innovations. This can only damage the security of the network, and give authoritarian governments more power over what their citizens can read and publish. The US government has regularly claimed that it supports a free and open Internet, both domestically and abroad. We cannot have a free and open Internet unless its naming and routing systems sit above the political concerns and objectives of any one government or industry. To date, the leading role the US has played in this infrastructure has been fairly uncontroversial because America is seen as a trustworthy arbiter and a neutral bastion of free expression. If the US begins to use its central position in the network for censorship that advances its political and economic agenda, the consequences will be far-reaching and destructive. Senators, Congressmen, we believe the Internet is too important and too valuable to be endangered in this way, and implore you to put these bills aside.
