Joly, I'd like to pass on the sociological characterization -- short people would do just as well -- with the appropriate credits to Randy Neuman. It is possible there is a competition policy issue that has existed since the NIC contract was first put up for competitive bid, an issue not adequately addressed by any subsequent event, with the exception of the competitive redelegation of the .org franchise. It is also possible there is an agency issue that has existed since the IANA contract was hurridly put in place, an issue not adequately addressed by any subsequent event, though the publication of the FNOI earlier this summer by the DoC, rejecting certain claims made by the current chief executive officer of the corporation, may improve this situation as agency, when clear, can be delegated, and shared, under rules consistent with modern administative practices. Maintenance of the status quo benefits specific private parties. Eric

Colleagues, I've not read the EC paper and don't plan to until after the 1st of October. I expect it will keep. I agree with John about regulatory capture. However, I know that many who are engaged in policy advocacy, including Verisign among other contracted parties, reject "regulatory capture" as a possible description, as they do not accept that "regulation" is an accurate description. The former, for a variety of reasons, including a lack of familiarity with federal (United States) administrative law, as well as a preference for some other legal framework, and the latter, possessing an abundance of familiarity with US administrative law, for reasons specific to agency capture and regulated party benefit, insist that "regulation" is not practiced. I don't plan to read Professor Meuller's paper. We've known each other's positions since the Working Group C period (1998) and have had nothing in agreement then or subsequent. What I suggest is that everyone try and understand each other, that when there is disagreement over whether "regulation" applies, that that is not overlooked by reference to some other benefit, or harm, and the assumption offered by Verisign, and its non-competitor imitators, currently with TLD franchises, or seeking new TLD franchises, that new TLDs are a sufficient substitute for redelegation or other means of reducing the market share of the incumbent monopoly, while held by some, are not assumed to be held by all, or necessarily valid, however attractive. Bottom Up Action Procedure - Last Time?

Hi all, I have now incorporated Eduardo’s suggestion into the wording. I hope that we have got this nailed down now! 1. NARALO has a discussion on its mailing list and/or telephone conferences about a policy position it wishes the ALAC to advance. 2. Once consensus is achieved according to the NARALO Operating Procedures, the NARALO Chair sends a request to the Chair of the ALAC clearly stating our intentions and a specific request for action as per the group decision. 3. A person or people from NARALO will be designated as the ALAC liaison for the specific issue and it will be their responsibility to request that the matter be given a place on the ALAC agenda. This person or people will then present the matter to the ALAC during their regularly scheduled conference call. 4. The liaison will then report back to the group. If ALAC rejects the request, the region will be so informed and the reasons for rejection given. At that time, the region will decide to move or not to move forward with the issue at hand. If the decision is to move forward, the Chair will contact other regions directly to gain support. If there is enough interest from two or more regions then the Chair should refer the issue back to ALAC. It may also be decided that the NARALO will advance the issue by itself without ALAC support. Hi all, Eric Brunner-Williams has stepped down as one of North America's reps on the DSSA working group (https://community.icann.org/display/atlarge/DSSA+WG+-+At-Large+Members) We had two reps on this working group - the other is John Levine who is now our ONLY rep. Therefore, we are looking for SOIs from someone else from North America to participate in this working group along with John. Please see the e-mail thread below for qualifications for same. My apologies for not participating in this discussion as it was evolving the last couple of days. We now mercifully have our electric power back. This procedural outline looks good to me as well. I thank everyone who participated in getting it down in writing. In my opinion for this pre-registration issue we pretty much complied with 1, 2 and 3. We should have designated an issue liaison or advocate to represent the issue to the ALAC. Also I would like to thank Olivier for supporting the evolution of this process, we were able to accomplish the "liaising" with the ALAC chair because of his welcome presence on our NA-RALO monthly call. Consumer information on domain "pre-registrations" -- well done

I wanted to share with the NA RALO this chain (below) that illustrates some inspiring co-operation among RALO, ALAC and ICANN staff on communications about the pre-registration issue. There may have been a fair amount of to-ing and fro-ing with e-mails and what not, but positive things emerged: 1. Results. 2. Opening up or strengthening issue communication to Scott Pinzon. 3. Stepping back and setting down some actual procedures for "bottom up" policy communications. Thanks Evan, Darlene, Scott, Olivier et al for a semi-grueling procecural slog that hopefully will cut the work in half the next time around. We will work with the registrar in question to make sure that they address the confusion about ICANN registrar accreditation and pre-registrations in speculative new gTLDs. ICANN has not authorized anyone to offer such pre-registrations. While this is indeed a specific example, I am concerned that concentrating on one specific instance may simply lead to a game of "whack-a-mole", in which one effort may go away just to be followed by another. In addition to specific examples I think it's necessary to alert the public to the practice in general, as the effort will most certainly appear in marketplaces outside our direct view.
