The latest version of the proposed charter revisions are attached. Several items were identified for further discussion over the mailing list. Your input is kindly requested on the mailing list regarding the following items: * The section of the charter on Transparency currently states: “Unless otherwise directed by the GNSO Council, the names of all applicants and all documents received during the selection process shall be considered public and published on the GNSO web-site or other ICANN web-site. To facilitate its deliberations, the SSC may decide to conduct some or all of its deliberations in private, but if so, it is expected to provide a rationale with its recommendations.” Some SSC members have suggested that the SSC should conduct deliberations privately by default, publishing emails sent to the mailing list, meeting notes, call recordings, and other materials relevant to a selection process only after the selection process has been completed. Do members support proposing this change to the charter? Another suggestion made by an SSC member was to continue the current practices regarding transparency but add disclaimer text to the SSC wiki indicating that all SSC recommendations are subject to GNSO Council approval. Are there additional proposals that SSC members would like to make? * On the last call, some SSC members raised questions about how the NomCom operates with respect to confidentiality of deliberations, noting that the NomCom is also a body that conducts selection processes for positions within ICANN. According the NomCom Operating Procedures (https://www.icann.org/resources/pages/nomcom2018-procedures-2017-12-15-en#A4) the NomCom keeps all deliberations confidential throughout the selection process and continues to keep this information confidential after the selection process is complete. This is a higher level of confidentiality than SSC members have proposed for the SSC. * Staff has investigated options for enabling the SSC to delay public posting of materials, including email and call records and other documentation, until after deliberations for an appointment are complete. While administratively more complicated than the current setup, this is possible from a technical perspective. * Under Review Team Appointment Principles, proposed text for bullet 8 included the following text: “The level of consensus reached by the SSC on the selected candidates will also be communicated [to the GNSO Council] as well as any minority views, should these exist.” Do SSC members think that it is appropriate to keep the text “as well as any minority views, should these exist” given that the SSC operates by full consensus? Should this text be clarified to state that the SSC should communicate minority views only if consensus is not possible to reach? * The same bullet 8 states: “The SSC shall notify candidates of its recommendations to the GNSO Council at the same time that it notifies the GNSO Council of its recommendations, making clear that the recommendations are subject to GNSO Council consideration.” Is the SSC comfortable with beginning to implement this new step after the GNSO Council approves the revised charter (as opposed to sooner)? Your input is kindly requested on the mailing list regarding the following items: * The section of the charter on Transparency currently states: “Unless otherwise directed by the GNSO Council, the names of all applicants and all documents received during the selection process shall be considered public and published on the GNSO web-site or other ICANN web-site. Action Item 2: Staff will research how NomCom operates in terms of privacy of deliberations and share on the mailing list. Action Item 3: In the section of the SSC charter “Membership Criteria” change “If an SSC member is a candidate for a position for which the SSC is expected to carry out the selection process, the member in question will recuse him/herself from the deliberations and decision-making process concerning that specific position” to “If an SSC member is a candidate for a position for which the SSC is expected to carry out the selection process, the member in question will recuse him/herself from the procedures for deliberations and decision-making process concerning that specific position.” Action Item 4: Staff will request additional input on the mailing list for the following items: * Under Review Team Appointment Principles, proposed text for bullet 8 reads “The SSC shall communicate to the GNSO Council the selected candidate(s), including proposed ranking where applicable. SSR2-RT candidate selection - Review of poll results. - Two members indicated that they would switch their votes to the candidate supported by the majority of members. As a result, the group appears to have consensus in support of the lead candidate, Rao Naveed Bin Rais. Members noted that the Scott McCormick is also a strong candidate for this position. - It is not yet clear if additional selection processes will take place to choose additional GNSO representatives to the SSR2-RT. - Members supported the proposal to indicate in the motion that if another slot becomes available for a GNSO representative on the SSR2-RT, the SSC would recommend Scott McCormick for this position. 3. Proposed revisions to SSC Charter - SSC reviewed current language on the charter section “Transparency” and went over the outstanding question of whether the SSC wants to recommend, as standard SSC practice, delaying publication of email archives, call recordings, and other records of deliberations until the selection process is complete. - One member stated that she originally supported keeping materials confidential until a decision is made, but now thinks this may be too complicated and possibly not necessary. - Another member suggested that SSC materials should include disclaimers that SSC recommendations are preliminary and the results are not final until the Council confirms the selection. The poll will ask members to state their preference between the two candidates. Welcome/Agenda review/SOI updates - no SOI updates. 2. Review of poll results – SSR2-RT candidates/skills matrix - The selection of a candidate by the SSC has become more pressing as a GNSO priority. The SO/AC leaders feel that this selection process must be completed before the SSR2-RT can resume. The GNSO would not like this selection to hold up re-starting the Review Team, therefore a recommendation should be made as soon as possible. - One member noted that in addition to poll results, diversity should be a consideration for this process, including geographic region and SG/C. - Affiliation of SSR2-RT members nominated by the GNSO: Denise Michel (BC), Norm Ritchie (unaffiliated), James Gannon, the member who stepped down, is NCUC-affiliated - Affiliation of candidates for the vacancy: Rao Naveed Bin Rais (NCUC) and Scott McCormick (BC) - Question: Is it possible for the SSC to recommend training for members? - Response: The Council can recommend that the Review Team members have access to training in areas relevant to the work, but it may not be appropriate for this group to make recommendations for specific training for specific candidates. - SSAC was concerned with technical and security skills on the team and that more individuals with this skill set may be needed. - Suggestion: Perhaps it would be helpful to ask Norm and Denise what types of skills/types of person would be most valuable to the SSR as they have direct experience with what is needed. It may also be helpful to rach out to James Gannon as he was there from the start. - Alternately, the SSC could focus outreach to current leadership (Denise and Eric). SSC members on the call generally supported directing the inquiry to the co-chairs. 3. Proposed revisions to SSC Charter (time permitting) - There was not enough time to cover this topic on the call. - Regarding deadlines, the SSC could have this item for discussion at the upcoming meeting, if feasible, but for formal consideration, it would need to be submitted with a motion by the deadline for the following meeting. 4. Draft message will be circulated to SSC members for sign-off and then sent to SSR2-RT co-chairs. Action Item 2: Staff will prepare a poll for SSC members to complete once feedback is received from the SSR2-RT co-chairs. The poll will ask members to state their preference between the two candidates. Action Item 3: Staff will draft a placeholder motion for the SSC recommendation, which will be submitted prior to the 12 February document deadline for the 22 February GNSO Council meeting. Notes: 1. Welcome/Agenda review/SOI updates - no SOI updates. 2. Review of poll results – SSR2-RT candidates/skills matrix - The selection of a candidate by the SSC has become more pressing as a GNSO priority. The SO/AC leaders feel that this selection process must be completed before the SSR2-RT can resume. The GNSO would not like this selection to hold up re-starting the Review Team, therefore a recommendation should be made as soon as possible. - One member noted that in addition to poll results, diversity should be a consideration for this process, including geographic region and SG/C. - Affiliation of SSR2-RT members nominated by the GNSO: Denise Michel (BC), Norm Ritchie (unaffiliated), James Gannon, the member who stepped down, is NCUC-affiliated - Affiliation of candidates for the vacancy: Rao Naveed Bin Rais (NCUC) and Scott McCormick (BC) - Question: Is it possible for the SSC to recommend training for members? - Response: The Council can recommend that the Review Team members have access to training in areas relevant to the work, but it may not be appropriate for this group to make recommendations for specific training for specific candidates. - SSAC was concerned with technical and security skills on the team and that more individuals with this skill set may be needed. - Suggestion: Perhaps it would be helpful to ask Norm and Denise what types of skills/types of person would be most valuable to the SSR as they have direct experience with what is needed. It may also be helpful to rach out to James Gannon as he was there from the start. - Alternately, the SSC could focus outreach to current leadership (Denise and Eric). SSC members on the call generally supported directing the inquiry to the co-chairs. 3. Proposed revisions to SSC Charter (time permitting) - There was not enough time to cover this topic on the call. - Regarding deadlines, the SSC could have this item for discussion at the upcoming meeting, if feasible, but for formal consideration, it would need to be submitted with a motion by the deadline for the following meeting. 4.
