Dear CWG-UCTN members, During its 20 September meeting, the GNSO Council adopted the Final Report of the CWG-UCTN. Kind regards, Emily GNSO Adoption of the Final Report of the Cross-Community Working Group Framework for the Use of Country and Territory names as TLDs Submitted by: Heather Forrest Seconded by: James Bladel Whereas 1. The GNSO and ccNSO chartered the Cross-community Working Group Framework for the Use of Country and Territory names as TLDs (CWG UCTN) in March, 2014 (https://ccnso.icann.org/workinggroups/unct-framework-charter-27mar14-en.pdf) The formation of a cross-community working group to evaluate the feasibility of developing an overarching framework on the use of country and territory names as TLDs was the principal recommendation of a preceding ccNSO Study Group (Final Report of 8 September 2013: https://ccnso.icann.org/workinggroups/unct-final-08sep12-en.pdf) 2. The CWG UCTN published an Interim Paper dated 9 February 2017 (https://ccnso.icann.org/workinggroups/ccwg-ctn-interim-paper-09feb17-en.pdf) setting out the history and context of ICANN policy-making on country and territory names, and proposing four recommendations, with Recommendation 3 articulated in three alternatives. A public comment period on the Interim Paper was held from 24 February 2017 to 21 April 2017, with comments summarised in a report dated 3 May 2017 (https://www.icann.org/en/system/files/files/report-comments-cwg-uctn-interi…) 3. In addition to comments submitted by individual GNSO stakeholders, the GNSO Registry Stakeholder Group, Business Constituency and Intellectual Property Constituency submitted comments supporting Recommendations 1, 2 and 4, as follows: 1. Close this CWG in accordance with and as foreseen in the charter. 2. Recommend that the ICANN community consolidate all policy efforts relating to geographic names (as that term has traditionally very broadly been defined in the ICANN environment to this point) to enable in-depth analyses and discussions on all aspects related to all geographic-related names. This is the only way, in our view, to determine whether a harmonized framework is truly achievable. 4. Recommend that future policy development work must facilitate an all-inclusive dialogue to ensure that all members of the community have the opportunity to participate. Again, we believe that this is the only way to determine whether a harmonized framework is truly achievable. 1. Notably, no objections were raised in any submission during the public comment period to the above Recommendations 1, 2 and 4. 2. A range of support was expressed for each of the alternative wordings of Recommendation 3, with all GNSO commenters expressing support for Alternative A, as follows: Alternative A Future work should take place with the authority of a policy development process under ICANN's Bylaws, with a clearly drafted Charter or scope of work that sets out how conclusions and recommendations will inform that policy development process. This addresses a key deficiency of this CWG, as it has not been made clear how the group's work can or will be incorporated in policy-making pursuant to ICANN's Bylaws. 3. On 24 June 2015, the GNSO adopted the Resolution on the Request for a Preliminary Issue Report on New gTLDs Subsequent Rounds. (https://gnso.icann.org/en/council/resolutions#201506) The Preliminary Issue Report, which identified the “requirements around geographic names” as meriting discussion, was adopted by the GNSO Council on 17 December 2015 (https://gnso.icann.org/en/council/resolutions#201512) The Preliminary Issue Report notably recommended that: “A potential PDP-WG on New gTLD Subsequent Procedures could consider collaborating with other parts of the ICANN community, such as the GAC or ccNSO in particular, in determining if strings described above should be allowed and if so, what requirements would be needed to govern that process. The PDP-WG should also consider the work of the Cross-Community Working Group on Use of Country/Territory Names as TLDs before reaching any conclusions.” (Preliminary Issue Report at page 59, https://gnso.icann.org/en/issues/new-gtlds/subsequent-procedures-prelim-iss…) 4. The GNSO Policy Development Process on New gTLD Subsequent Procedures (“Subsequent Procedures PDP”) was chartered on 21 January 2016 to, inter alia: “Review whether geographic names requirements are appropriate.” (https://gnso.icann.org/en/issues/new-gtlds/subsequent-procedures-charter-21…) This issue formed part of Work Track 2, covering legal issues. 5. Following two cross-community sessions led by the leadership of the Subsequent Procedures PDP WG at ICANN59 in Johannesburg on the topic of the use of geographic names, the formation of a new Work Track 5 was proposed to better facilitate broad community participation in the discussion of policy on geographic name use. Resolved, 1. The GNSO Council adopts Recommendations 1, 2 and 4 of the Final Report of the Cross-Community Working Group Framework for the Use of Country and Territory names as TLDs. 2. The GNSO Council adopts the underlying objective of Recommendation 3, and in particular supports Recommendation 3 Alternative A, recognizing that the use of geographic names as gTLDs is clearly within the GNSO's mandate as per ICANN's Bylaws, and also recognizing that this is a matter of interest for the ICANN community as a whole. 3. The GNSO Council instructs the leadership of the Subsequent Procedures PDP to consider the Final Report of the Cross-Community Working Group Framework for the Use of Country and Territory names as TLDs, and to ensure continued collaboration with other parts of the ICANN community in addressing issues relating to the use of geographic names. 4. The GNSO Council recognizes the significant contribution of the CWG UCTN to the ongoing development of policy on the use of geographic names in the DNS, and thanks the members of the CWG UCTN for their Final Report, which clearly documents the history and context of policy-making in relation to geographic names. 5. The GNSO Council instructs the GNSO Secretariat to communicate these resolutions to the ccNSO Council, as co-chartering organization of the CWG UCTN, as soon as possible. ccNSO Council decision re final paper CWG UCTN

Dear all, As you will recall the final paper was subbmitted to the ccNSO and GNSO Councils for deliberation and decision-making prior to ICANN 59. At its meeting on 20 July, last Thursday, the ccNSO Council discussed the recommendations in the final paper and adopted the reoslutions (included below). The resolutions will become effective 7 days after publicationon the ccNSO website, Kind regards, Bart 7) Final Paper of the Cross-community WG Use of Country and Territory Names as TLDs 7.1 Discussion and or adoption final paper (https://ccnso.icann.org/workinggroups/ccwg-ctn-final-paper-15jun17-en.pdf ) Introduction At the ccNSO members meeting in Johannesburg the recommendations of the CCWG Use of Country and Territory names to continue work on use of Country and Territory Names as TLDs were discussed and supported. However, the format to continue work is still under community discussion. Awaiting the outcome of that discussion the ccNSO Councils deferred the discussion and adoption of the final paper to the next meeting (July 2017). By adopting the recommendations in the final paper the ccNSO Council effectively closes the Cross-community Working group and supports the need for additional work in this area. However, following ICANN 59 the next steps on how future work on the use of names countries and territories as TLDs will be structured and how the ccTLD community could participate most effectively is not clear (yet). Moving forward with respect to the Final paper and the discussion there are 4 options: Reject recommendations (working group effectively continues) and request WG to provide clear direction and assist in resolving issues. Defer the decision, up and until there is more clarity on how to proceed with follow-up work. The cross-community working group is not closed. Adopt final report and request the ccNSO appointed members to provide advice on next steps. Adopt the report, and await further action from other communities. The Council also request the ccNSO appointed members to the CWG to keep the Council abreast of the developments and advise the Council on next steps. The ccNSO Council thanks and congratulates the CWG and in particular its ccNSO appointed members and co-chair Annebeth Lange. 7.2 Discussion recommendation Study Group CTN Letter to the Board to request continued exclusion of country and territory names in subsequent new gTLDs rounds. For discussion and / or decision. Introduction In September 2014 the Study Group recommended Council: In light of the need for further work on the treatment of country and territory names, the complexity of the issue at hand and the aforementioned inconsistencies between various ICANN policies, it is also recommended that the ccNSO Council request that the ICANN Board extend the current rule in the new gTLD Applicant Guidebook regarding the exclusion of all country and territory names in all languages, for consecutive rounds of new gTLD applications. Council adopted this recommendation in 2014. Given the establishment of the CCWG UCTN, Council did not pursue this recommendation, awaiting the outcome of the deliberations and recommendations of the CCWG. Resolution At the ccNSO members meeting in Johannesburg the recommendations of the CCWG Use of Country and Territory names to continue work on use of Country and Territory Names as TLDs were discussed and supported. This also included the recommendation of the Study Group. However, as the format to continue work is still under community discussion, and interest of the ccTLD community in future efforts needs to be ensured the ccNSO Councils defers the decision whether to send the letter to its August meeting, and request the secretariat to organize the drafting of such a letter, which includes at a minimum consultation of the ccNSO appointed members on the CCCWG and interested Councillors.

Dear all, Per discussion on this morning on the call please find included the changes suggested by Susan Payne with respect to section of section 5.1.5 of the draft final paper (see her email 5 June 2017 to the list). On this morning’s call this was accepted by those attending, and it was agreed that if there are no comments on the suggested change by the end of this week (second reading), Friday 9 June 17.00 UTC, staff will prepare the final version of the Final Paper, including the suggested language. Welcome and roll call This call is meant to re-group the final comments. No further additions/subtractions to be made by co-chair Heather 2. Second reading draft final paper comment received from Jaap Akkerhuis: section on page 9 - regarding description of ISO-bodies involved in iso-3166. Bart Boswinkel will run through changes made on the interim report: 1. public comments were not conclusive regarding the recommendations 2. page 33. What has been done with the public comments is being described here. Reflect the (non)-support of the recommendations 1,2,4 and the divergence on recommendation 3 3. new annex was added Susan Payne sent some further comments. 2 minor ones: 1) editorial. reference to the public comments and the alternatives A, B, C: suggestion to move them to a different paragraph 2) section 1.5, page 20. replace the word "outcome": it is rather a succession of different perspectives; no conclusions have been reached. Background provided by Bart: old language, with respect to the 2-letter codes. Heather: similar concerns to Susan's comments. There are certainly concerns within the GNSO community that conclusions were reached on 2-letter codes, in the understanding that we would be progressing on 3-letter codes and further. The question is: do we specify that preliminary conclusions on 2 letter codes were preliminary conclusions reached at that point, i.e., prior to discussing 3-codes? Action item for the group’s co-chairs is to draft a cover letter, for the submission to the chartering organisations, preferably next week. Following the last call of the WG, staff circualted the draft final paper version 01, and send two reminders. Until yesterday we have received one comment (from Jaap), which is included. The comment relates to wording around how ISO organizes its work with respect to ISO 3166 (and is included in this version). Per charter (https://ccnso.icann.org/workinggroups/unct-framework-charter-27mar14-en.pdf) this is the second reading with respect to the proposed changes to the Interim paper. The feed-back received on recommendation C - how to structure future efforts- remains unresolved. Diverse views were submitted, ranging from a GNSO PDP to a ccNSO PDP and everything in between. 2. The comments that deal with the conclusions pertaining to the use of 2-letters, 3-letters codes and full name of countries and territories as TLD are also diverse. With respect to these comments staff suggests that these views and opinions included in a summarized version in the report, as an annex.
