Hi Anne, On its meeting of July 21 2016, the GNSO Council voted on a motion to adopt the charter of the GNSO Review Working Group. My understanding is that a Council discussion was held in Helsinki in preparation for the creation of this working group, and the adoption of its charter. This discussion included that the working group, which would work on implementing a number of recommendations made by Westlake (the independent examiner) following their review of the GNSO, would also assume the role that the SCI performs. This discussion resulted in this motion being adopted on July 21, where the decision was made by the GNSO Council to disband the SCI following the completion of its last two remaining tasks (procedures on submission of motions and Chair/V. Chair elections): please see resolved clause 2 of the 2nd motion here: https://community.icann.org/display/gnsocouncilmeetings/Motions+21+July+2016. On July 27 2016, I sent an email to the SCI list informing the committee that this motion had passed (https://forum.icann.org/lists/gnso-improvem-impl-sc/msg01801.html) I had also assumed that the Councillors of each of the stakeholder groups and constituencies of the GNSO discussed this with their respective groups prior to voting. I also forwarded a call for volunteers for the GNSO Review Working Group to the SCI list in hope that as many of the SCI members as possible would join the working group (https://forum.icann.org/lists/gnso-improvem-impl-sc/msg01802.html) The format for this working group is slightly different to that which we are used to in the GNSO, in that it has voting members who are appointed by the GNSO SGs/Cs, as well as non-voting participants and observers similar to how they function in cross-community working groups. The NCSG hasn’t appointed its members to this WG yet, but we are actively working on it. Several of our members, however, have signed up as participants in the WG, including myself. There was an online sign-up sheet for those interested in becoming involved with this working group, and the announcement calling for volunteers for this WG indicated that the sign-up sheet would be online and open until August 19. If this has gone by unnoticed by enough members of this committee, and there is interest from SCI members who have not signed up to do so, then perhaps a request could be made to reopen the sign-up process for a while. I suggest that folks who would like to do so go back to your representatives on Council to get this done. This seems to be the most logical approach to me. You do bring up an interesting point though, Anne. The GNSO Review WG is not chartered to perform periodic reviews of the GNSO, which is the case for the SCI as you pointed out. That may be a bit of an oversight on the Council’s part, including myself in my capacity of Council liaison to the SCI. Still…, I don’t recall the SCI actually conducting a review of the GNSO during my time on this committee, but I was appointed to the SCI in 2013, and the committee was around for a couple of years before I joined it. Still…, I think it is pertinent to point this issue out to the GNSO Council during it meeting the day after tomorrow, and I will do that. Thanks for pointing it out to me, Anne. Update re: Chair & Vice Chair Election Procedures

Dear Amr and SCI members, Further to the message below, the Public Comment period ended on 14 August. There were two comments – one from the Registries Stakeholder Group and the other from the Business Constituency. Both were in support of the proposed revisions. See the comments at: https://forum.icann.org/lists/comments-gnso-op-procedures-05jul16/. As both comments were positive, they do not necessitate any changes to the proposed revisions. Thus, staff will proceed as noted below and prepare the motion for approval of the revisions for the liaison to submit to the Council list not later than 22 August (the motion and document deadline for the GNSO Council’s meeting on 01 September). Staff also will post the public comment report on the public forum page and incorporate the revisions into the GNSO Operating Procedures so that they may be posted following the GNSO Council’s approval on 01 September, or as soon as possible thereafter. The SCI will decide whether and/or how to address comments (if any). I will note that we seldom receive substantive comments on changes to the GNSO Operating Procedures. 2. Staff will prepare a motion for the approval of the revisions to the GNSO Operating Procedures for you, as Liaison, to send to the GNSO Council for consideration not later than the document and motion deadline for the 01 September GNSO Council meeting – that is, by 22 August. 3. The GNSO Council will consider the motion at its meeting on 01 September and is expected to adopt the revisions. 4. The motion will direct staff to produce the revised GNSO Operating Procedures. Staff will prepare these in advance so that they can be posted immediately following the GNSO Council meeting, but not later than 02 September, when they will take effect. Final GNSO Review WG Charter

Dear Rudi, Anne, and SCI members, At its meeting on 21 July the GNSO Council passed a motion (https://community.icann.org/x/BAObAw) that creates and charters a new GNSO Review Working Group. In this motion the GNSO Council also directs the Standing Committee on Improvements Implementation (SCI) to complete the two tasks assigned to it by the GNSO Council (see further below). The motion notes that upon completion of these tasks, any new requests will revert to the GNSO Review Working Group for consideration. In addition, per the motion, following the completion of these two tasks the SCI will be disbanded as its work will have been superseded by the GNSO Review Working Group. As noted recently by staff, a Public Forum has been opened on the two current SCI tasks regarding proposed revisions to the GNSO Operating Procedures. It will close on 14 August, following which staff will produce a report on comments received, if any. The SCI then will finalize the proposed revisions and submit them for approval by the GNSO Council along with a motion on 22 August for Council consideration at its meeting on 01 September. Upon Council approval the revised GNSO Operating Procedures will be published and the SCI’s work will be completed. Staff have sent out a Call for Volunteers for the GNSO Review Working Group earlier today. I will forward this Call for Volunteers in a separate email. SCI members are encouraged to consider volunteering to participate in this Working Group. Per the Charter, the GNSO Working Group is responsible for developing an implementation plan for submission to the Board by end-December 2016, containing a realistic timeline for the implementation, definition of desired outcomes and a way to measure current state as well as progress toward the desired outcome for the GNSO Review recommendations adopted by the ICANN Board. The Charter also notes that the GNSO Review Working Group will be responsible for considering any new requests by the GNSO Council concerning issues related to the GNSO Council processes and procedures and to Working Group guidelines. To recommend a general time table for election of the GNSO Council Chair to be approved by the GNSO Council and added to the GNSO Operating Procedures. In December 2015 the SCI created Subteam B to discuss and draft possible new procedures. The Subteam members were: Anne Aikman-Scalese, Angie Graves, Wolf-Ulrich Knoben, and Sara Bockey. The Subteam submitted its recommendations to the SCI to consider at its meeting during ICANN 55 in Marrakech, Morocco on 05 March 2016. On 02 June the SCI discussed the draft revisions and asked staff to submit them to the SCI for a Consensus Call. If there are no objections or changes received in two weeks by Thursday 16 June, the language will be presumed to be accepted by Full Consensus. Dear SCI members, No objections were received to the change below and included in the attached Word and PDF documents as of the deadline of COB Monday, 20 June. Thus, the proposed revisions are deemed accepted by Full Consensus. As requested, staff will proceed to initiate a Public Comment Forum following Helsinki. Staff also has conveyed to Amr the SCI’s request for him, as the GNSO Council Liaison, to provide a written update on the SCI’s activities to the GNSO Council. This is in lieu of a face-to-face update in Helsinki and does not affect the timing or ability of the SCI to initiate a public forum on the proposed revisions to the GNSO Operating Procedures. Staff will forward to the SCI any comments received in the Public Comment Forum as they come in and will prepare a summary of comments, if any. Staff also will prepare for the SCI’s review a draft motion adopting the proposed revisions for the GNSO Council to consider at its meeting on 01 September. Note: With respect to the Chair and Vice Chair election procedures, as discussed last week the SCI and staff have determined that if these revisions are adopted at the 01 September meeting they will be in place in time for the necessary steps to occur leading up to and including the election at the Annual General Meeting at ICANN 57, 3-9 November 2016. I believe this sentence may better serve the purpose we intended if it were something more like this: “Should one of the Houses fail to designate an interim Vice-Chair, the designated interim Vice-Chair from the other House will serve as an interim Vice-Chair alone until a new Chair is conclusively elected.” I hope this makes sense to folks.
