Dear SCI members, after a phase of silent months it's now the right moment to put some items to the table which need input and recommendations from this committee. 1. Rules of procedure (http://gnso.icann.org/council/gnso-operating-procedures-16dec11-en.pdf) The GNSO council had a successful first run trial re a consent agenda which should be put in a formal process. One rugh suggestion for this is as follows: 1. The Chair or meeting leader calls for any opposition to said item being in the consent agenda. If any opposition is voiced, then that item is dropped from the consent agenda (and can be re-introduced at any time in the main agenda). 2. If no opposition is voiced to the item being on the consent agenda, the Chair or meeting leader calls for any opposition to the item itself. If any opposition is voiced, then no action is taken (and the item can be re-introduced at any time in the main agenda). 3. If no opposition, the consent agenda item is deemed approved by theGNSO Council. Obviously we need to discuss this in more detail, e.g. the goal of a consent agenda, which items could be included to a consent agenda and which should definitely be excluded e.a. It seems to make sense to include the text - once recommended - into chapter 3.0 of the rules "GNSO Council Meetings". 2. As discussed in Dakar, it might be worth sending out a reminder to the GNSO Council and SG/C leaders regarding the mandate of the SCI and the opportunity that exists to request review of GNSO Improvement related items. To this end, thanks to Marika the attached draft letter has been prepared for your consideration. Please feel free to comment. 3. Furthermore, in order to obtain feedback from WGs/DT on their experience with the GNSO Working Group Guidelines - as it is intended in the SCI charter - , it might be useful to develop a short survey which could facilitate data gathering and input. In order to kick off the discussion here are some bullet points: * The objective of the survey would be to determine whether there are any issues that were encountered by WG/Dts with the GNSO Working Group Guidelines, and/or identify areas for improvement * If deemed effective, such a survey could become a standard part of the self-evaluation process of WGs and provide the SCI with regular input on the status of the GNSO Working Group Guidelines Ideas for items to be included in the survey are welcome! Dear All, Following yesterday's SCI meeting, please find below the different work items and related notes. As discussed, members of the SCI are encouraged to indicate which topics they would be interested in working on so that on the next call it can be decided how to move forward on these different items. Attached you'll find the different documents that were used as part of the discussion. With best regards, Marika WORK ITEMS SCI a. WG Survey * Survey on the experiences with WG Guidelines needs to be added to list of work items * (Note – Staff would be happy to prepare a first draft of such a survey that might serve as a basis for further work / discussion) b. Consent Agenda * Include procedure sent by J. Scott (see http://forum.icann.org/lists/gnso-improvem-impl-sc/msg00146.html) into the comparison table to facilitate comparison by SCI (Action item: Marika) c. Deferral of Motions * Deferral of motions: currently unwritten rule which allows deferral upon request from SG/C, which is always allowed. Normally only one time deferral only, although there have been exceptions in the past. Council has requested SCI whether a formal procedure is needed / preferred. PDP rules allow individual member of Council to request deferral on PDP related vote (once). Individual vs. SG/C? What is the role of 'socializing' motions prior to formally introducing them - does that reduce the need for deferrals? d. Voting Threshold rules for Delaying a PDP * Threshold rules needed for delaying a PDP - overview of current rules and recent situation on delaying 'thick' Whois PDP. e. Proxy Voting Procedure * At the last GNSO Council meeting a proxy was requested but not in the correct way. Do rules need to be adapted to accomodate situations where no formal proxy can be given? Overview of current proxy voting rules (section 4.6 of Operating Procedures) provided. Current rules don't provide for last minute situations, assumes a certain time delay between knowing that Council member cannot attend Council meeting and giving proxy. Do youneed to create rules for every possible exception? Several members of the SCI noted that they do not think modifications need to be made to the current rules. d. Update of GNSO Council Voting Results Table * As a result of the adoption of the new PDP and related update of the voting thresholds in the ICANN Bylaws, the voting results table has been updated. SCI requested to review the table, which has been updated to be consistent with the changes as a result of the new PDP, so it can be included in the GNSO Operating Procedures.

Updated Consent Agenda Comparison Table

Dear All, As discussed during our last meeting, I've integrated the consent procedure as suggested by J. Scott (see http://forum.icann.org/lists/gnso-improvem-impl-sc/msg00146.html) into the comparison table which also included the board procedure and the interim procedure used by the GNSO Council (see attached). Please note that I've made a couple of small modifications such as changing President to Chair / Council Leadership and adding 'links to' as an additional option to including the full text of reports in the minutes to reflect existing practice. One thing I did notice is that the main difference between the board procedure, proposed procedure and the interim Council procedure appears to be that the latter specifically does not allow items on the consent agenda which are to be decided with a motion. This issue was also put forward to the SCI for consideration by the Council leadership: 'In particular, [the SCI] may wish to look at items that may require exclusion from the consent agenda (a motion vote is an obvious example), to serve as guideline for theCouncil Chair and Leadership Team when a GNSO Council meeting agenda is being drafted'. The SCI may wish to consider this issue in further detail at its next meeting. With best regards, Marika

All: today`s call is planned for 1 hour. It may be advisable to start with structuring our work due to the various items having been loaded on our shoulders. - agenda item 3 (Consent agenda): I didn't hear anything from J. Scott, I hope he's doing well. If he cannot attend the call the group should decide how to proceed. - item 4 (motion deferral): I suggest that we start with a small presentation of the information staff provided - item 5 (Threshold rules needed for delaying a PDP): I wonder if we shouldn't start providing information about the various phases of a PDP and then discuss the implications of a potential delay during those phases. Maybe we have to differentiate depending on the status of a PDP. - in addition we should talk about the necessary alignment of the voting thresholds laid down in the GNSO Operating Procedures with those in the bylaws and the PDP - item 6: an introduction to the present status shall be given by staff Looking forward to speak to you later Wolf-Ulrich
