Proposals in NARALO Related to the Registrant

Dear Community members: There has been considerable activity in recent weeks on various community lists (as well as in online news forums) relating to domain registration, accreditation of registrars, proposed initiatives intended to create better safety nets for registrants and related issues. At the same time, the ICANN community as a whole is engaged in a consultative process related to the key agreement (the Registrar Accreditiation Agreement (³RAA²) that governs many aspects of domain registration and the rights and responsibilities of registrants and registrars, as well as ICANN since it is one of the two contracting parties to the agreement. As you all know, many of these these issues are complex. At the same time, several proposals and issues raised, especially in the NARALO of late, seem to me to have elements which are interrelated (especially as regards the fundamental objective they seek to produce). What I would like to propose is that a couple of briefings be arranged to help further the understanding of these and related issues in the community. I would propose two sessions, of an hour to 90 minutes each, as per usual with simultaneous interpretation: 1. The Registrant/Registrar Relationship * What safeguards are available to registrants? * How are they implemented? * What compliance activities could, or already do, help ensure their implementation? * What proposals are being discussed to increase the protection available to registrants? 2. The RAA and the Internet User * Does the RAA impact the non-registrant user of the internet? * If so, how does it impact them, and are there different impacts for different types of users? * What if any changes being discussed would (or could) affect the non-registrant end-user, and how? It seems to me that these two sessions would likely help everyone have a much increased understanding of the issues and lead to a very productive debate. Hi all, As you all know, the ALAC position currently held by Beau is now up for election. As of such, we are now officially opening the Call for Nominations period. This period will start today and end on September 21, 2009. Please send in any nominations (or volunteers!) for this position during this time (the sooner the better). On September 222, 2009 we will have a one week period for the actual election (held on-line through Big Pulse or any other such voting mechanism that staff recommends). BC proposes Issues Report re Registration Abuse Policies

The recent Afilias funnel request highlights the issue, as has a related discussion in the Fast Flux WG. The BC proposes a Council resolution to request Staff to lay out the facts and potential options around this issue, for further community discussion. Thanks, Mike Rodenbaugh Councilor, Business Constituency Whereas: 1. ICANN's mission is to ensure the security and stability of the DNS, and to develop policy reasonably related to that mission. 2. Various forms of DNS abuse, in isolation and/or in the aggregate, cause a less secure and stable DNS. 3. Some of ICANN's gTLD registry agreements and appended registry-registrar agreements contain a provision such as Section 3.6.5 of the .info Registry Agreement, Appendix 8 (http://www.icann.org/en/tlds/agreements/info/appendix-08-08dec06.htm) 3.6.5. [Registrars] acknowledge and agree that Afilias reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, that it deems necessary, in its discretion; (1) to protect the integrity and stability of the registry; (2) to comply with any applicable laws, government rules or requirements, requests of law enforcement, or any dispute resolution process; (3) to avoid any liability, civil or criminal, on the part of Afilias, as well as its affiliates, subsidiaries, officers, directors, and employees; (4) per the terms of the registration agreement or (5) to correct mistakes made by Afilias or any Registrar in connection with a domain name registration. Afilias also reserves the right to place upon registry lock, hold or similar status a domain name during resolution of a dispute. 4. Afilias, the dotInfo Registry Operator, per its recent RSEP request, has sought to clarify and implement its specific abusive registration policy with respect to this provision. This request has been approved by ICANN, <http://www.icann.org/en/registries/rsep/afilias-to-icann-06aug08.pdf> http://www.icann.org/en/registries/rsep/afilias-to-icann-06aug08.pdf. 5. Some of ICANN's gTLD registry agreements, notably the Verisign contracts for .com and .net, have no such provision. Other gTLD registry agreements do contain such provision, but the registry operators have not developed or have inconsistently developed abusive registration policies. The GNSO Council resolves to request an Issues Report from ICANN Staff with respect to the following: 1. To identify and describe the various provisions in existing and previous gTLD registry and registry-registrar agreements which relate to contracting parties' ability to take action in response to abuse. 2. To identify and describe various provisions in a representative sampling of gTLD registration agreements which relate to contracting parties' and/or registrants rights and obligations with respect to abuse. 3. To identify and describe any previous discussion in ICANN fora which substantively pertains to provisions of this nature in any of these agreements. 4. To identify and describe potential options for further Council consideration, relating to consistency and propriety of provisions of this nature in all of these agreements. Dear Kevin, At the May Special Meeting of the ICANN Board of Directors, it was noted by John Jeffrey that the ICANN CFO intends to post Form 990 on the ICANN website after annotations are made to explain it to the community. As it has been 3 months since this comment was made and Form 990 (annotated or otherwise) does not yet appear to be posted, might we ask when we can expect to see the Form on the ICANN website? Hi Nick, As I cannot find an email address for the ICANN CFO, could I ask you to get us an update on the following: "Raimundo Beca also confirmed that the United States' Internal Revenue Service Form 990 was filed on time. John Jeffrey noted that the ICANN CFO intends to post it on the ICANN website, after annotations are made to explain it to the community." http://www.icann.org/en/minutes/prelim-report-29may08.htm In short, when can we expect to see Form 990 posted? Although I will no doubt get into trouble for trying to paraphrase you, my take on your answer was that you missed some meetings because they were often a waste of time. And I agreed. I am a bit troubled that you have not been more active in trying to fix that problem instead of walking away from it, but that is just my personal feeling. I normally treat volunteers very respectfully and with sensitivity. In this case, you are putting your name up for an important position within the ALAC world, and I do not think it appropriate to side-step issues because they are awkward to bring up. This whole resignation thing

Dear NA: This morning in the board liaison candidacy discussion, Alan Greenberg asked me a question that went something like, "considering the NA region is calling for your resignation because you don't have time for your ALAC duties as they currently stand, why should we vote for you for board liaison?" Putting aside the board liaison candidacy thing for a moment, I need to get clear on something. If I misinterpreted the question (I don't think I did), feel free to ignore this note. If Alan's question comes from some sort of bias for Wendy's candidacy versus mine, well hey, that's OK, I'm a big boy and I don't really see that as a problem. The ALAC will vote for whom it votes. But if the NA-RALO is indeed asking for my resignation, I would have appreciated the opportunity to address it in another forum beforehand, or would have appreciated hearing it directly from the elected chair of the NA-RALO rather than from a nomcom appointee. Or, for that matter, I would have appreciated hearing about it from the chair of the ALAC. If it's indeed the case, you'll have my resignation in 24 hours -- (914) 378-2018 until 5:30 EST. It would be great to know before the weekend starts, so I can devote time I would have spent on ICANN matters to other things.
