ICANN Legal Opinion on GDPR - Part 1

ICANN has received the first part of the independent legal analysis of the GDPR in relation to WHOIS that had been commissioned. Although we have decided that implementation of compliance with GDPR is not within the scope of this RT, it does make interesting reading. RDS-WHOIS2 RT: Statements and Conflicts of Interest

Dear Review Team Members, ICANN’s legal department has provided some clarification on questions raised on Statements and Conflicts of Interests. First, while both affirmations state that you have received the Conflicts of Interest policy, the SOI affirmation also confirms that the representations made in the SOI are complete and truthful. Secondly, legal department advised that forwarding a picture or PDF of a hand signed version is considered as an acceptable electronic signature. Therefore, we would like to suggest the below step-by-step recommended process when filling out and returning your SOI/COI: 1) use print-outs received in Brussels (or print out both forms attached, if lost) 2) complete/sign both documents 3) scan both sets of documents 4) Send to ICANN org via rds-whois2-staff(a)icann.org<mailto:rds-whois2-staff@icann.org>. 5) Signed documents will be saved here<https://community.icann.org/display/WHO/Legal+Documents> on the RDS-WHOIS2 wiki. Scope: Legitimate needs

In reviewing the draft Scope document, I looked once more at the Phrase "legitimate needs". The sentence in the Bylaws reads: "The Board shall cause a periodic review to assess the effectiveness of the then current gTLD registry directory service and whether its implementation meets the legitimate needs of law enforcement, promoting consumer trust and safeguarding registrant data." We have previously discussed whether this means the RDS implementation: = meets the legitimate needs of law enforcement; = promotes consumer trust; and = safeguards registrant data. OR The RDS implementation: = meets the legitimate needs of law enforcement; = meets the legitimate needs of promoting consumer trust; and = meets the legitimate needs of safeguarding registrant data. The latter interpretation is what is in the draft scope. I went back to the original Affirmation of Commitments to see what it said: "... ICANN will organize a review of WHOIS policy and its implementation to assess the extent to which WHOIS policy is effective and its implementation meets the legitimate needs of law enforcement and promotes consumer trust." So I believe that the first interpretation is in fact the original one and if we revert to it, we do not need to worry about identifying what the legitimate needs of promoting consumer trust are (as opposed to the non-legitimate needs of promoting consumer trust). Safeguarding user data was added during the transfer of the AoC into the Bylaws and I believe we can similarly not need to worry about legitimate safeguarding vs illegitimate safeguarding. Alan
