And, oh by the way, don't bother to learn about us. No need! And, by the way, you should know today whether you might today, or ever in the future have a client interested in applying for the auction funds, although you do not know the mechanism we will choose, or the conditions, etc. And, oh by the way, we hope you will want to donate your time to give us information while we are not clear with you.. and we may sort of blackball you if you answer any question in a way that makes "us" uncomfortable. Surely, we can do better than this in how we explain the issue, the invitation, and the call for a declaration of interest. Just as someone the CCWG do not know today if in the future they might have a client or be part of an organization that might apply for funding, that may be the case for those that are interviewed. I also note that if you want a senior executive to read a letter - make it one page, with attachments. I'll join as long as I can. Consider having a first paragraph explaining ICANN, then auction proceeds, followed with what we are asking for. * Consider including footnote that would further explain some of the concepts. Reduce letter to 1 page / 1,5 page. * Consider rephrasing COI as the current way it is phrased may deter people from responding. * Provide an indication of how much time is needed to respond to the letter. * Consider whether specific amount needs to be mentioned or whether there should be a more general reference. * Consider moving some of the info into annexes to keep the letter short. * Consider introducing COI concept early on. * Need to think what would it take to be receptive. * Consider cover email introduction to find the right person. Those that made recommendations should reach out to the experts that they identified. * Who should sign the letter? Letter comes from working group, not Board or ICANN Org. * An explanation of the leadership of the group and its composition should be included in the letter to give some credibility to our purpose. Action item #1: WG to provide input by Friday 2 February at the latest. Action items #2: Rewrite introduction, restate objective, COI more upfront, review tone of the letter, shorten letter (consider moving additional info into footnotes or annexes) 4. Review of proposed questions for external experts (an updated version will be circulated prior to the meeting) * Updated version was circulated - everyone encouraged to review this latest version which aims to address comments that were submitted. * Reference to audit - what type of audit needs to be clarified. Note that a limited audit is done in an ICANN context. Possibly include it as a footnote. Xavier to suggest language to address this issue. * Description of mechanism #2 - consider broadening description and include other types of organizations. Consider focusing the description - partner to run grant making process is what is being considered. Charitable organization may be too broad. Focus on grant-making. CCWG to review and provide feedback. Sam to suggest language to address this point. * Need to understand motivation of people providing responses to these questions. Are we asking for specific input or general guidance? Review how question can be reframed so that motivation is clear. FW: CCWG-AP Conflicts note and inputs on the questions

Dear All, Please find below and attached input and feedback received from Samantha Eisner and Xavier Calvez on the questions to external experts (see attached) as well as the issue of conflict of interest (see below). In light of this input, the chairs of the CCWG have decided to go ahead with next week’s meeting as scheduled to allow for further review and discussion of the input received before finalizing the list of questions. Staff will be circulating shortly the proposed letter to be sent to external experts for your review. As a reminder, next week’s meeting is scheduled for Thursday 25 January at 14.00 UTC. Best regards, Marika ========================================= From Samantha Eisner: There are a few different scenarios where conflict issues could arise: 1. When the expert represents an entity that would like to assist ICANN/serve as a grant making organization. 2. When the expert is interested in receiving some of the auction proceeds. 3. When the expert may serve as an advisor to other potential applicants interested in receiving some of the auction proceeds. 4. When the expert is interested in serving as a consultant to ICANN in designing/implementing the selected structures. 5. When the expert is also a member of ICANN’s community and may, when providing advice, purposefully or inadvertently, represent also the position of a community organization. These each present different issues for consideration. However, it is also important that the CCWG has information available to it, so there is need to balance conflict concerns with accessibility of information to further the CCWG’s deliberations. First, it will be very important for each of the presenters to understand that the invitation to present is for general invitational purposes only. We are not seeking their proprietary information, only best practices and guidance from experience. We are also not interviewing potential grant making organizations or structures, so this is not a service proposal, nor are they determining the future rules for the process. Because of the general nature of the questions (and we have suggested some further refinement to those), there is no need for the experts to go into great detail about ICANN-specific issues. This is not yet about what ICANN should do; this exercise is about learning what others do. As a result, the focus of responses should reflect the more general practices. All presenters should be informed that these are publicly available through archive. Second, we should expect that as part of the invitation, we inform all potential presenters that they will need to consider and provide us a declaration of interest based on the classes of conflict issues identified above. Depending on the responses, we might wish to have a secondary process where we identify how deep or problematic the issue might be, and identify what protections we would put in place to make sure that those interests are on the record. We should keep a running table of the DOIs. Third, we should have an introduction for each session where we remind the expert and the participants of the scope of the conversation, as well as surface the potential conflicts on the record. Prior to the session, the Chair(s) should note that they will redirect or stop the conversation if the presentation veers into advocacy for particular entities/recipients/grant purposes. For ease of conversation, we’d also recommend that that presenters be provided with some explanation of the various models so that the questions are clearer. Roll Call * Roll call will be taken from Adobe Connect 2. Welcome & SOI/DOI Updates * Everyone is reminded to review their SOI/DOIs on a regular basis and make sure that these are up to date. 3. Overview of the details and proposed approach for dealing with external experts, followed by Q & A * Small group of volunteers agreed to work on identifying external experts, approach and proposed questions. The details and proposed approach for dealing with experts were shared on the mailing list prior to this meeting. * Original questions were derived from F2F meeting at ICANN60 and then further refined and added to by the small group of volunteers. * CCWG now requested to review this document and especially focus on identifying points of contacts for those organizations that no contact has been identified yet (TBC) as well as the questions identified (e.g. are questions missing, should further details be provided). Important that a point of contact is identified as that will facilitate getting responses. * Small group of volunteers included: Marilyn Cade, Sylvia Cadena, Mei Lin Fung, Vanda Scartezini, Daniel Dardailler, Olga Cavalli, in addition to the CCWG Chairs (Erika, Ching) * Need to make sure that there is a good balance between focus (national, regional, global) as well as experience (small, medium or large grants/projects). * COI statement needs to make clear whether providing responses or no responses would impede any possible future applications or partnerships. Need clarity on this before list of experts / approach is finalised. Could consider asking for COI statements, but not use it to exclude anyone as the same question is asked to many different experts. Whatever approach is taken, it needs to be crystal clear in the letter. * Note that questions are very general - how much specific knowledge of ICANN is required to respond to these questions. May not be a need to target people that are closely involved in ICANN or likely to apply. * Leadership team / small group of volunteers to review input received by next Wednesday and finalize approach. Action item #1: CCWG to review the details and proposed approach by Wednesday 17 January COB (wherever you are) at the latest. Action item #2: Staff to check with ICANN legal what is required with regard to COI statement in letter. 4. Review updated work plan * See updated work plan circulated to CCWG which factors in the proposed timeline with regards to outreach to expert. Action item #3: CCWG to review updated work plan and share any feedback with the mailing list. 5. ICANN61 Planning * Two meetings are being planned - one F2F WG meeting and one public consultation. Proposed meeting slots are Sunday 11 March from 17.00 - 18.30 and Thursday 15 March from 8.30 - 10.15. Note that these slots are still tentative. 6. Confirm next steps and next meeting * Next meeting will be scheduled for 25 January 2018 at 14.00 UTC, but may be postponed if identified experts are not available.
