See whether any of the organizations linked to ICANN might be attending and could participate in the ICANN61 session. * CCWG should indicate where personal contacts exist as that could facilitate getting a response and allow for appropriate follow up. Action item #1: CCWG - any further input on the questions or letter to experts needs to be provided by the end of this week. Action item #2: CCWG to review organizations and identify where people have direct contacts which may facilitate getting a response. Action item #3: Staff to send out letter to external experts as soon as possible (target early next week). 1. Review of response of Board Liaisons * See response received from Board liaisons: https://www.icann.org/en/system/files/correspondence/botterman-burr-to-mann… * Letter should be seen as a constructive contribution to the CCWG's deliberations. * Important that proceeds are spent in line with ICANN's mission and values. * Some concerns regarding the preamble and the concept of 'open and interoperable internet' - may be worth reviewing again and ensuring that there is no confusion. * Important that examples do not raise any false expectations - make clear that these are not agreed projects. * May need to be clearer what examples would not be eligible. * Staff developed template that may assist the CCWG review the letter and determine what changes if any need to be made to current CCWG documents (preamble & examples). * Consider encouraging the Board liaisons to provide concrete suggestions for changes to either preamble and/or examples. * Further consider board input during next meeting. Possibly task a small drafting team to use the template as a basis for further review / discussion. Action item #4: CCWG to review Board letter and start considering possible responses / ways to address input received. 5. See below suggested updated text of the question to clarify the nature of the audit referred to in the question. “What fiduciary and auditing requirements, whether financial or non-financial, would need to be established for this program?” I am also suggesting to remove the secondary question below, within question #3, which is to vague to be addressed. “How will audits need to be managed?” 2- Recommended question on administrative costs The question currently reads as: “Would a fixed percentage, like for example 5%, for administrating and covering the costs of the distribution of the funds be reasonable for project applications? If yes, please provide input on what percentage should apply as well as what the percentage should be applied to (for example, % of total funds available for disbursement, or % per year or in total over the life of the project?)” The part of the question that asks “what percentage should apply” does not make sense. An external expert can not say what should apply to ICANN’s specific and unique program, but can only share common practices they know about, or the practice of the entity they work for. I also want to remind everyone that the administrative costs are not defined by a top/down assumption, 5% for example, but are the RESULT of the procedures that need to be put in place to meet the objectives defined. Again, as an example, if we decide that all grant decisions should be reviewed independently, it will cost 10 times more than if we decide that only a sample of 10% of all grant decisions should be reviewed. No one can “decide” that the costs are 2%, 5% or 15%. What can be decided is what procedures should be put in place, which will then result in a certain level of costs. An external expert can not know what administrative costs the ICANN’s disbursement program “should” result in. The external expert can only provide an external opinion on what other entities see administrative costs to be, for their program. I would therefore suggest rephrasing the question as follows: “What are the main costs to be incurred for grant distribution program? What are the various methods to measure these costs (fixed cost for the entire program, percentage of the total funds allocated for distribution,…)? If a percentage is commonly used in practice, what is the level of percentage most frequently observed?’’ Thank you. I just sent my adding sentence to the letter in the first paragraph. For what we will use funds are not clear. Apologies. However, I will just note that I worked for a major corporation for many years, and during that time, I engaged many experts for advice for ad hoc activities, NGOs, etc.. Ireviewed the letter and frankly, I would NEVER agree to participate in a call with such weirdly cautionary language. It reads like this: hmmm, you do not now who "we are". We are very special. And, oh by the way, don't bother to learn about us. No need! And, by the way, you should know today whether you might today, or ever in the future have a client interested in applying for the auction funds, although you do not know the mechanism we will choose, or the conditions, etc. And, oh by the way, we hope you will want to donate your time to give us information while we are not clear with you.. and we may sort of blackball you if you answer any question in a way that makes "us" uncomfortable. Surely, we can do better than this in how we explain the issue, the invitation, and the call for a declaration of interest. Just as someone the CCWG do not know today if in the future they might have a client or be part of an organization that might apply for funding, that may be the case for those that are interviewed. I also note that if you want a senior executive to read a letter - make it one page, with attachments. I'll join as long as I can.
