MOU in San Juan (Action Items)

Dear ALAC Colleagues, As the San Juan meeting approaches, we should turn our attention to finalizing the MOU with ICANN. Current Draft: http://www.icannwiki.org/NA_RALO_MOU (newest revisions, for discussion, in bold typeface) By its terms, the MOU is between ICANN and the North American At Large Structures that choose to sign it (Section 1). I point this out so you know that it is possible to participate in the ICANN process as an ICANN At Large Structure, participate in the NARALO, but choose not to sign the MOU. Nevertheless, we should strive for a MOU that a substantial majority of currently accredited ALSs would be willing to sign and which we believe would be generally acceptable to future At Large Structures from North America. *If* we can find agreement on the language of the draft MOU, then we will have an official signing ceremony in San Juan and move forward with our contemplated election of ALAC representatives from North America. As we've discussed on the list previously, this is an aspirational goal, not a hard deadline, but I am certain that with work over the next week on the list we will be able to find consensus around common language for the MOU. Here is what I would ask everyone to do in preparation for San Juan: (a) if you don't already have it, seek authority from your organization to sign the MOU on its behalf, if we can agree to terms, in San Juan. Even if you are not going to San Juan, we can still arrange to have your organization sign the MOU by mail and facsimile (my understanding is that repersentatives from all organizations will be present with the exception of CAUCE, CAUCE Canada, Alberta Community Network Association (ACNA), and People Who). Unlike our ratification vote, in which each organization had two votes, we only need one signature from each ALS. (b) review the current draft and consider whether you would be willing to sign on the current terms. Is that language in the draft that would prevent you from signing? Is there language that must be in the draft in order for you to sign? If so, please let us know as soon as possible so we can carry this back to our own organizations and have a discussion around it. (c) let me know by email bfausett **at** internet.law.pro, or on list, whether you think the current draft is something your organization will agree to approve in San Juan. This is just a straw poll, but I'd like to get a read as soon as possible about how close we are to having an acceptable draft. Questions and discussion welcome. Bret

MOU - Lets get things started

Hi all, I've taken the liberty to go through the transcript of our last telephone conference as well as the ICANN review of the MOU and have done my best to provide a "red lined" overview of the MOU. Since, on the Wiki, I can neither figure out how to create the colour red nor the appropriate strike-out, I have used the following conventions: * Things cut are surrounded by brackets and are in bold. * Things added are just in bold I have pretty much used ICANN's suggestions verbatim, not because I necessarily agree with them but just so that we can all have a starting point for discussion. Some things that some may wish to discuss are: 1. Clause 4.4 - During the conference call, Danny suggested wording such as "ICANN shall provide administrative and operational support necessary for the NARALO to carry out its responsibilities"; whereas what ICANN suggested was "Providing the necessary resources to support NARALO activities and the NARALO Secretariat." This seems to state about the same thing but I'm not sure. Maybe Danny would like to comment further. 2. Clause 4.6 - I went with ICANN's wording but also added Spanish and the wording on "official languages". 3. Section 5 - ICANN suggested wording to give us a much broader role in the certification of ALSes. One thing I noticed, though, is it remains silent on decertification. 4. Clauses 6.4 and 6.5 have already been amended, I believe, in order to remove the unlimited liability problems. Clause 6.5 still needs work. So, this list is by no means comprehensive. Some of the thinking behind per-diem rates - and a survey on travel at the end of the meeting

Dear North American and LAC travellers: Since a number of people have asked questions about the per-diem system, how the amount was chosen, and the like, I thought I would put out a brief note. The amount chosen is actually based upon the US Government's OCONUS system amount for San Juan. We looked at two systems: the US system and the UN DSAR system. In the end, we settled on the US system - which is slightly lower - since there are frequently food and drink options at evening events - in San Juan, there are evening events every night which will have drinks, and are expected to have food - certainly the gala dinner will have a sumptuous meal as per usual, and the opening night reception traditionally has food as well. We removed the lodging portion of the US per diem amount since lodging is of course included. In the case of At-Large, both the LAC and NA regional meetings will have a catered lunch, and the ALAC will have two meetings with breakfast included. Obviously, this is the first time a number of these measures have been impemented. We want to know how it works for everyone. Robert Guerra came up with the superb idea of having the polling system conduct a poll on the various elements of the travel handling for San Juan, which all of you will be invited to take part in, so we can use the feedback to make things better for everyone. One final note: I explained the per-diems rather badly in my previous email I find. Here's the text from the travel policy which is much clearer: You will receive the per-diem for each full night you are away from home. Right now, Clause 6.5 of the MOU reads: 6.5 Placeholder for public benefit statement, e.g., "This agreement is made for the benefit of the Internet-using public in the North American Region." as per Minutes Apr. 27 <http://atlarge-lists.icann.org/pipermail/na-discuss_atlarge-lists.icann .org/2007-April/000629.html> . I can't for the life of me remember this discussion but, maybe the interested party/ies could draft up some wording for this? Per Diem for San Juan - IMPORTANT ANNOUNCEMENT

I'm happy to report that due to popular request, we will be able to change from paying per-diems after the meeting to paying them out, in cash, onsite in San Juan! Here's how it will work: 1) We have compiled a list using the itineraries provided to us by American Express, and for those few of you who were approved to buy your tickets individually. 2) The per-diem rules in the travel policy will be used to calculate the number of days' per-diem you will receive. Except for those who already are approved for meeting requirements before the Sunday, or who are in specific situations with long-haul travel involving stopovers, per-diems will be paid out on a MAXIMUM number of 7 days - calculated based upon the period of 23 - 29 June INCLUSIVE. Of course if you depart later than the 23rd, or return home earlier than the 30th, these dates and days of PD will be different. 3) At the beginning of the meetings on Sunday, 24th June, we will be handing out envelopes to each of you and asking you to sign receipts. This will take place at the LAC meeting room for LAC, and the NA meeting room for NA. (ALAC members who are in San Juan on Sunday morning can pickup your PDs at the same time; if you aren't there yet, we'll do it at the first breakfast meeting on Monday) Q&A: Question: I've sent in my per diem form already - what will happen to those? Answer: We will check these but you will actually receive your funds as outlined above Question: Do I need to send in a per diem form if I haven't already? MOU - ICANN Obligations: Redelegation

I remain troubled by the total lack of transparency in the ccTLD redelegation process. Has anyone ever seen a detailed redelegation request posted for consideration prior to action being taken by the Board? The .us situation is particularly bad. On the last go-around ICANN bypassed the normal IANA processes to declare an "emergency redelegation" -- see http://www.icann.org/announcements/announcement-19nov01.htm I certainly don't want the relevant Internet community being kept in the dark should the delegation of the .us namespace become an issue. I would ask that the NARALO MOU stipulate that ICANN has the obligation to inform the NARALO upon the receipt of any relevant ccTLD redelegation request (.us or .ca) so that community input may be provided (as per RFC 1591: "it is also appropriate for interested parties to have some voice in selecting the designated manager.") ____________________________________________________________________________________ Be a better Globetrotter. The agenda of these meetings is basically set by each community, though the courtesy of providing these in advance to the board is appreciated. The Board and ICANN Staff are looking for input on these meetings, and Diane Schroeder has asked that the following note be passed along to you for your consideration. --- To the ICANN Constituencies, Supporting Organizations and Advisory Groups, Over the past year, the ICANN Meetings Committee has been soliciting information on how to make the public board meetings more efficient and to increase participation. This is a ongoing project and in response to the feedback that has been received, changes are being made to each meeting. For instance, as a part of this event, we have rearranged the schedule to start with public meetings on Monday and significant changes have been made to the methods of remote participation. As part of this ongoing process, we would like each group to evaluate the interaction between the constituency, supporting organization or advisory group that takes place during the meeting. These opportunities to meet should be as productive for each party as possible. Constituency Day is the one day on which most of the groups meet. The questions I would like to ask each constituency to consider are: 1. The purpose of the interaction between the board and the constituency? 2. The best venue for this to occur. Is the constituency meeting the best venue? Would a breakfast, lunch or dinner be better? 3. How much time would be needed for the most optimal interaction? 4. Does the entire board need to meet with the constituency? For instance, could a few members of the board attend different constituency meetings, perhaps allowing them to stay for a longer period of time? 5. Could the board be provided with an agenda before the meeting, identifying topics or concerns that the constituency would like to discuss, allowing the board to be better prepared for the meeting? Any other feedback on the board/constituency interactions? I would like to report back to the Meetings Committee on the feedback that I receive from the various groups at our first telephone conference after San Juan. This would enable us to take the feedback into account for the planning of the Los Angeles meeting? Eduardo, There are currently 16 accredited North American ALss (with more on the way). Dividing $500 amongst this group amounts to no more than $30 per year per organization... (and most organizations have more than a handful of members). My new blog

All, I have finally managed to set up a blog in English about ICANN and Internet Governance issues. I plan to use it to post my updates as a Board liaison (in addition to those given directly to the Committee) and for what regards the other processes I am involved in, to spread news and encourage discussion.
