All, Given there have been no additional comments on the list and that the published deadline has passed (see below) the final recommendations of the Staff Accountability sub-group will be forwarded to the plenary for consideration at its next meeting. Please find attached a clean and red lined version attached to this email for your convenience. Additionally please note that we have also attached the proposed responses to all the comments made in the public comment exercise. Please review these and provide any feedback on the list by Friday 23 February 23:59 UTC. If no significant comments are made by the deadline this will be considered final and published. Thank You. All, We have failed to obtain the 5 required confirmations to be able to hold the above mentioned call and are therefore forced to cancel it. I've had a call with ICANN staff and with Avri as the former rapporteur, and I've carefully considered the on list traffic. I'm proposing a different approach that works service levels back in, closer to our original recommendations. You can find that in the re-revised Recommendation 3. This approach may result in ICANN org or board pushback, but I think it responds to their key concern about scope of the work on service levels while providing a way to make that work, and inviting the organisation to commit to service level targets and guidelines that are meaningful for the community. All, Given the difficulty in getting quorum for meetings of the sub-group coupled with the urgency to complete the review of these recommendations in light of the public comments, so they can be included in the WS2 final report, a new draft of the recommendations has been produced which incorporates what the rapporteur considers required changes to address the public comments which have been made. Attached to this email you will find both a clean and a red-lined PDF versions of this draft document for your consideration. Please provide any significant comments to the list by 23:59 UTC Sunday February 11. If there are no significant issues are brought up on the list which need to be addressed, this version of the report will be forwarded to the WS2 Plenary as the final recommendations of the Staff Accountability sub-Group. Should there be no significant comments by the deadline the work of the sub-group will be considered completed and all future meetings will be cancelled including the Wednesday 14 February 0500 UTC meeting. All, This is a reminder that there is a meeting of the Staff Acct sub-group scheduled for Wednesday 17 January 19:00UTC to review the comments from the public consultation. The only non-process agenda item is to review the comments from the public consultation. To facilitate your work with respect to this please find attached three documents: - The first of these is an aggregation of all comments received to date in one PDF document - CCWG-Accountability-WS2-StaffAcct-PublicConsultation-January2018-AllComments - The second is the staff summary of all the comments received to date in one Excel spreadsheet document (CCWG-Accountability-WS2-StaffAcct-PublicComments-january2018-Summary) - there are two tabs one is sorted by commenter the other by subject. Additionally these have been colour coded by staff: - dark green is unqualified support or agreement - light green is support with comment or qualification - orange/yellow is concern with rec. - red is opposed to the rec. - No colour means the comment does not touch on a recommendation - The third is a PDF of the spreadsheet should you have issues with that format or version of the document. The usual process that has been used successfully is to go through the comments sorted by subject to allow the sub-group to consider all the comments on a given recommendation or topic and then start working on responses to these. As a reminder we are working to an ICANN 61 deadline (9 March) where the integrated report of all the WS2 recommendations has to presented to the plenary for approval so it can be published for public comment. As noted by the co-chairs this date is fixed and any recommendations which are not in the integrated report will not be considered. Hi, During today's WS2 plenary meeting, the report passed its first reading with a few comments. Added two explicit instances of ",as appropriate" - page 5 Recommendation 2 It was commented that point ii, was not a recommendation but an explanation. It was recommended that the explanation be removed. Instead, the recommendation has been be subordinate to one of the recommendation and no longer stands alone as a recommendation. - page 6 Recommendation 3 change 1 Sentence reworked to replace informal with ad-hoc. Not sure this is as correct as informal. But not sure that it makes a difference. - page 6 Recommendation 3 change 2 We were asked to add example conditions of when discussions could be confidential instead of transparent. Since the Transparency subgroup developed answers for the SOAC accountability subgroup to the same issue, the SOAC text was copied to this report. A footnote was added to say that the various example listings should remain consistent once the entire WS2 book was built. - page 6 Recommendation 4a. The consensus was that it should remain service level guideline instead of service level agreements. _Consensus Call for 2nd plenary reading submission _ Until 30 September 2359 UTC __ If anyone has any objections or strong recommendations for ways to change the edits being made in response__to the 1st reading comments please contribute specific changes on the list. If we change the file in a substantive way during this last call based on comments, I will restart the last call for another 48 hours after the change is published. Minor fixes will just be made without restarting the clock. Note: at this point substantive changes to the report or its content are discouraged as they would require another 1st plenary reading and would probably mean that we would not finish in time. __ thanks avri

Hi, For those who may not have been on today's WS2 Plenary Meeting, the draft report passed its first reading. Thanks to all for coming to the consensus that made that possible. There were some minor changes requested. I am working on those today and will send out an updated copy of the report. Instead of getting the same group of stalwarts to discuss it on a meeting tomorrow and then doing a last-call on the list on it, and after consultation with Bernie and few of those stalwarts, I have decided to cancel the meeting. Hope to send out the updated report before the end of my day If we fail to get consensus on the list, I will schedule a meeting for next week or the week after. thanks avri

During the meeting we worked through the comments and changes which had been pending from Mtg 26. In all but one case, we reached consensus on the document. The one instance of open discussion concerns recommendation 4a ** 1. * ICANN Organization should work with the community to: * * 1. Develop and publish service level guidelines (similar to the Service Level Agreement for the IANA Numbering Services) that clearly define all services provided by ICANN to contracted parties and the service level target for each service. * The original recommendations had been for a service level agreements (SLA). As there had been strong reaction on SLAs because of their legal nature and the difficulty involved in negotiating such SLAs, the recommendation was changed to guidelines. In response, there was consensus, though not unanimity, for recommending guidelines instead of agreements. During the consensus call, there was one request that we wait until there had been time for a group member to check with the groups in the Contracted Parties House of the GNSO, on whose behalf the original recommendation had been made. It was argued that guidelines were an unreliable mechanism and that it would be better to develop SLAs. Because of the tight schedule and the intermittent nature of sub-team member attendance, it was recommended by others that we send the sub-team consensus document on to the full meeting leaving the issue of 4a open for discussion in the full meeting. As the number of participants in the meeting was small, the compromise accepted by the group was to check the consensus with the members of the group who had not been in attendance (most of you). For that reason I am doing this online consensus call. The deadline for sending documents for consideration to the next full meeting (27 Sept) is 20 September (Bernie, please correct me if I have this wrong). This consensus call is scheduled to end 19 September at 1200 UTC. Note, there is only one other full meeting between now and the Abu Dhabi meeting on 18 Oct. *Consensus Question: is there consensus in the sub-team for sending the Rev 1.5 of the document* *<https://docs.google.com/document/d/1vH5su7SDGE0i_rTstbYJ7tIaOFuRnV4dfqpwMTP…> (pdf attached)* *to the full meeting, with the request that they also determine whether we submit 4a with a recommendation for service level guidelines or Service Level Agreements.* Note: the alternative, if this consensus call fails, is that the agenda of the next Staff Accountability meeting on 28 September 13UTC to focus on this subject and that we submit in time for the last full meeting for Abu Dhabi. This would be very last minute and would give the sub-team limited time for resolving any pending issues that may emerge in the first reading before the Abu Dhabi meeting. If the consensus call succeeds, we will dedicate the September 28 meeting to responding to issues from the reading in the full meeting. Additionally, during the meeting several comments were made about the format of the document. I have done some cleanup and would appreciate that those of who do read the report let me know of any format &c. problems you might see, so that I can fix them. thank you avri

Hi, As was requested at our last meeting Patrick made the edits recommended in his contribution, which we discussed during the meeting, in response to the Board WS2 Caucus' objections to the recommendations from the group.. Hello everyone, Based on the conversations during and since ICANN59, I have the following reflections I wanted to share for the group’s consideration. I have kept these in a separate document for now, to avoid creating confusion in the working document until the group has evaluated the ideas and suggestions presented here. For clarification, I provide these thoughts in my own individual capacity as a team member of the staff accountability subgroup. These have not gone through any internal process within ICANN prior to my providing them here. I will be on the call this week and will be happy to discuss any of these suggestions. Please note this isn’t a board action: instead these are inputs agreed by some participants to continue engagement in the work of the subgroup. As shared during the ICANN59 face-to-face CCWG-Accountability meeting, a general observation is that some of the issues have limited supporting examples. Because of this, it is very difficult to assess what specifically are the issues the subgroup is trying to solve, and whether the issues are systemic. Without that understanding it is difficult to share in the subgroup’s conclusions that all of the issues outlined in the report are of a systemic nature or represent a demonstrated pattern of behavior, versus isolated or more sporadic occurrences. Similarly, it is difficult to determine whether the recommendations are designed to solve those issues. As also shared during the face-to-face meeting, here are some observations in relation to the issues section: * Issue 1, clarity on the issue of a “safe zone”, is needed including in the context of 1(a) whether the newly-established Complaints Office <https://www.icann.org/complaints-office> serves this role. In relation to 1(b), staff reporting of concerns is an internal HR-related matter. However, there is an important issue here for the community in relation to community (including SO/AC) accountability. Input is welcome on how ICANN can coordinate with the community to make sure that misbehavior towards staff is identified and treated appropriately within the community. * Issue 3, “[T]he overall culture of the ICANN Organization is less focused on supporting the community’s work … than it should be,” clarification of specific examples would be helpful to determine whether these are isolated cases or systemic. * Issue 4, which states there is “no institutionalized route for community feedback to be included in staff performance and accountability systems,” feedback related to the Organization’s accountability should go to the organization, and the Complaints Office is the most appropriate mechanism through which these concerns can be expressed. This issue is an example of an issue posed without explanation of what is trying to be solved for. * Issue 5, which states “[s]taff may not be consistently meeting ICANN’s accountability commitments in a way they summarize and substantively respond to recommendations…,” it is unclear what this means and clarification and specific examples are needed. Clarification is needed whether the subgroup is implying, for example, that staff are misrepresenting facts or manipulating responses. * Issue 6, which states “[t]here are concerns about the compensation scheme…”: Departmental or individual goals are not tied to any specific policy outcome or the timing of reaching any conclusion of process. Further, departmental or individual goals are aligned with ICANN’s mission, goals or objectives. Concerns that a decision taken by the Organization staff member may be based on a conflicting incentive should be brought to their manager or the Complaints Office. * Issue 8, it is unclear whether this is staff accountability or whether it is requesting a different process for the organization when there are these types of requests. Clarification would be helpful here as to the context of the issue. If the subgroup has ideas of how more specificity can be developed and further conversations needed with parts of the ICANN organization or the Board, please let us know. Hi, I have updated based on today's discussion during the incomplete second reading. * Split Recommendation 7 into a & b to cover both Contracted parties' specific issues and the more general community issues. I understand that 7a may be too strong for some, but the sentiments expressed by some contracted parties were rather strong. this may be an issue that is appropriate for raising with the full group as part of their first reading. I suggest people review and comment &c. I worked for a bit on my assignment of writing the explanation. For some reason I decided that mapping each of the recommendations to the issue it addresses should be my first chore. Built a table and I am struggled with the mapping of the recommendations we have and the issues we identified. It needs sanity checking. Hi, After scheduling discussions it seems that Krista, the CO, can make a meeting on 22 May 1900 UTC. I am hoping that Herb can also make it. I would like to plan this meeting with the single topic of: CO & Ombuds Roles & Responsibilities as they relate to Staff Accountability. I have not yet cancelled the previously scheduled meeting for later in the week (24 May 13 utc) yet, but will unless there is a feeling that we could make progress on the document. In some part this depends on how industrious I, and perhaps others, are in the next few days in adding content to the evolving report. Hope people can make this meeting.
