Original link: https://www.icann.org/news/blog/ntia-report-update NTIA Report Update By: Akram Atallah In a report issued earlier this month, the U.S. National Telecommunications and Information Administration (NTIA) found that the “proposal developed by the global Internet multistakeholder community meets the criteria NTIA outlined in March 2014 when it stated its intent to transition the U.S. Government’s stewardship role for the Internet domain name system (DNS) technical functions, known as the Internet Assigned Numbers Authority (IANA) functions.” One of many elements of NTIA’s review process was to evaluate the proposal against the Committee of Sponsoring Organizations (COSO) of the Treadway Commission Internal Control Framework Assessment. The use of the COSO framework was in alignment with the U.S. Government Accountability Office recommendation of how NTIA could enhance its review. NTIA’s COSO Assessment was favorable, with no items flagged as red. Of the 70 areas assessed only eleven received a yellow rating relating to four areas: · PTI governance (5 items) · PTI Audit Committee (1 item) · ICANN’s new investigatory process (2 items) · PTI Operations (3 items) Although NTIA does not require that any of the recommendations flagged as yellow be resolved as a pre-condition for the completion of the transition, we are confident that there is a clear path forward to address every item. We reviewed each of the items against NTIA’s recommended action, and implementation notes have been developed where further work is needed. NTIA’s recommendations andICANN’s plans to address them can be found here. Of the eleven items that were rated yellow: · Two have already been addressed and do not require any further action · Six are already accounted for in the transition work plan and we anticipate completion by the time of transition · Three are expected to be completed post transition either as part of scheduled implementation work, or as part of normal operational planning We appreciate NTIA’s thorough review of the community-developed proposal. We will work with the community and NTIA to ensure that the plans to address these items will meet the expectations of NTIAand the ICANN community.

ATRT Implementation Reports

In response to the CCWG discussion yesterday on AoC implementation we wanted to note that there are several places for the community to see updates on the implementation of AoC Review recommendations. Quarterly updates on the implementation of all AoC Review Recommendations are posted publicly on the ICANN web site (ATRT2 <https://community.icann.org/display/atrt/ATRT2+Implementation+Program> , SSR <https://community.icann.org/display/SSR/SSR1+Review+Implementation+Home> , WHOIS <https://community.icann.org/display/WHO/WHOIS+Review+Implementation+Home> ). Additionally, ICANN publishes a quarterly Executive Dashboard <https://www.icann.org/progress> , which is accessible from the ICANN.org <http://icann.org/> home page Quick Links. High-level statistics on implementation of all AoC Review Recommendations can be found in goal 5.2: Promote ethics, transparency and accountability across ICANN community. In particular ATRT2 implementation reports show that it is progressing, with quarterly updates <https://community.icann.org/display/atrt/ATRT2+Implementation+Program> posted publicly. * Majority of the tasks are expected to be completed by September 2016, two years after board approved 12 recommendations, which translated into 50+ subcomponents. * Quarterly update as of 30 June will be published in August. * Next detailed update on the progress of ATRT2 implementation will be presented by end of September 2016, in line with NTIA¹s request (see letter <https://www.icann.org/en/system/files/correspondence/chehade-to-strickling- 28jan16-en.pdf> from Fadi Chehade to Larry Strickling) ³In the interim, ICANN staff will publish a thorough report on implementation of the ATRT2 recommendations by the third quarter of 2016.² * ICANN has a process in place to monitor progress of implementation work and hold teams accountable for completing board-directed improvements. This process follows project management best practices, periodic oversight by the Board and regular reports to the community. * The Board also adopted a community-supported process improvement (https://www.icann.org/resources/board-material/resolutions-2015-07-28-en#2. c <https://www.icann.org/resources/board-material/resolutions-2015-07-28-en%23 2.c> ) as a result of ATRT2 process improvements to have designated review team members take part in the implementation planning processes. This will be implemented for all Reviews starting with the CCT review and is expected to add clarity around the intent of the recommendations, desired outcomes and realistic timeframes for implementation work. The Board standards topic

Hi all This email teases out what seems to be three separate options for what the WS2 item on Board standards means, to see if others are clearer or share my view that a number of topics are on the table. When we (ages ago, early in WS1) were discussing the removal of Board members community power, there was agreement - from memory in Dublin - that it would be helpful to generate some community norms for Board members. Let's refer to this as Option 1 for now. This was seen as having two benefits that I can remember being discussed - that Board members would have some insight into what the community was looking for beyond the procedural "rules" of Board membership, and removal processes by the community would be guided by such norms (since, presumably, they would be embedded in the community's views of what it needed from the Board - not for procedural reasons). A few weeks ago a discussion suggested that this topic might be going in a different direction - perhaps Option 2 - creating standards against which a Board removal decision might be objectively judged (i.e. creating criteria for removal). That was rebutted at the time - the CCWG never agreed to that. Today a different interpretation - Option 3!? - has emerged on the call just now - from Annex 4 para 54 of the final Proposal, the fourth bullet point: "Guidelines for standards of conduct that will be presumed to be in good faith (for example, conducting reasonable due diligence as to the truthfulness of a statement) will be developed in Work Stream 2." I confess I had not read or noticed the implications of this text in previous readings of the draft. It appears the topic noted here is to create standards for COMMUNITY members not for Board members, relating to indemnity. It may be useful to clarify this through discussion on list before Helsinki. >From my point of view Option 1 remains important and useful for the community to express some views that will help inform current and future Board members or candidates for the same about some things the community wants to see, beyond what can/should be written in bylaws or rules language. Option 3 seems to be required too but is not the same thing. I'd be strongly opposed to Option 2 coming back on the agenda. Look forward to your thoughts! On behalf of the Cross Community Working Group on Enhancing ICANN Accountability (CCWG-Accountability), we welcome the U.S. Government report that our recommendations meet their requirements. We are actively engaged in the prep work needed for a timely implementation of these new accountability mechanisms into ICANN’s ecosystem. Looking ahead, our ongoing work to advance ICANN’s accountability is not complete. The CCWG-Accountability identified nine additional areas where community, staff and Board accountability can be improved. These target areas, recognized as Work Stream 2, are outlined in Recommendation #12 of the Work Stream 1 Report. To launch Work Stream 2, the CCWG-Accountability will be holding a full-day face-to-face meeting in Helsinki on the Sunday before ICANN56 (26 June 2016). All Work Stream 2 topics will be covered during the session. The full agenda can be found here. The topics that will be discussed are: · Additional transparency considerations · Diversity across ICANN · Clarifying the lines of accountability for ICANN staff · A work plan to enhance accountability of Supporting Organizations and Advisory Committees · A Framework of Interpretation on respecting human rights within ICANN’s limited mission and scope · Expanding the list of jurisdictions identified in ICANN’s contracts, for purposes of resolving contractual disputes [1] · Role and function of the Ombudsman · Guidelines for good faith conduct in ICANN Board member removal discussions · Engagement process between a complainant and ICANN prior to an Independent Review Process We encourage all members, participants and interested observers that are not attending ICANN56 to follow along with our discussions via our Adobe Room.
