Review of plan for Hyderabad Sebastien Bachollet: (Presentation of slides) Herb Waye: Concerned this report only represents the views of a small number of people and not the community. Sebastien Bachollet: Our work will be presented to the plenary of the CCWG-WS2 so this is not an issue. After it is accepted it will go for public comment to be accepted by the community. Herb Waye: Willing to pay for part of the evaluation, have funds and will have to do one (there may be a conflict of interest with such funding). Klaus: I am just thinking about if anybody outside the WG will actually understand the slides? Somehow I think not. We might need a more "understandable" version. Content is OK but who will understand and do we get the message across? Avri Doria: i think there will be chance to explain t to assembled crowd. In terms of staff accountability, we have included a reference to the necessity of coordinating with this group. Chris LaHatte: the slide about consent of the Ombuds is an issue Avri Doria: but the people listening will all be CCWG participants. Herb Waye Ombuds: Did this idea of consent come about as a copy of the reconsideration new process in the bylaws I wonder? Klaus: I think the cross group issue is critical now, we will need to have a mechanism in place to have the input from the other WG's Bernard Turcotte: @Klaus - the co-chairs advised on the leadership call last week that they would focus on this to ensure synchronicity between sub-groups Klaus: Great, good to know. Thanks Karen Mulberry: I am working out the details for the Review that you have asked for Cheryl Langdon-Orr: we should note that at least from the slide mentioning crossover matters the mention of Elections might be inflammatory for some CCWG Members. Sebastien Bachollet: This was one of my suggestions for our work. Herb Waye Ombuds: That idea is good Seébastien and it could be in the office but I would need to ask for funding for staff... The IOO could become a sort of ethics office Sebastien Bachollet: the evaluation will probably impact our timetable. Klaus: Ethics can never be a subject of an office but an community. Happy to discuss this at a face to face basis. Herb Waye Ombuds: Agree Klaus, two separate hats but some organizations do it as part time functions. Sbastien Bachollet: Shall we resume our calls immediately after Hyderabad. Next meeting on November 14 or 21? will check with staff AOB? (none). Adjourned.

Dear all, Further to my Email below, I would like to share with you the following proposal that would constitute in my view an acceptable outcome of the public consultation on the Framework of Interpretation, and build on the wording proposals made by Switzerland in its public comment input (see attached) and the exchanges had thereafter in the Subgroup. Specifically, I would like to propose that the following paragraph on page 6 (under “internationally recognized human rights”) be reworded as follows (changes in red): “By committing to one or more of these international instruments, nation states are expected to embed human rights in their national legislation. The UN Guiding Principles on Businesses and Human Rights are relevant for business organizations. Insofar ICANN the Organization is concerned, it should consider, as a business, the UN Guiding Principles on Businesses and Human Rights as a useful guide when applying the Human Rights Core Value.“ The UN Guiding Principles on Businesses and Human Rights (UNGP) are the universally accepted voluntary standard for business organizations. Therefore, we feel that it should be mentioned under the instruments regarding “internationally recognized human rights”. In order to avoid any extension of the UNGP to the non-business elements of ICANN (SO/ACs) there is specific mention that the UNGP would be relevant only for ICANN the Organization. In addition, the mention is constrained to having to “consider” the UNGP “as a useful guide” – which, in our view, eliminates any perceived danger of creating any obligation whatsoever through this mention. I hope that this compromise proposal may be positively considered by all of you. Please note that it is made only by me with the aim of arriving at a common ground and that it has not been possible to coordinate due to time constraints with the other participants joining the dissent. The main point of the dissent is, in my view, that we feel that the public comment period showed the existence of two schools of thought: some that favored maintaining the text sent to public comment “as is” (ALAC to a certain extent, and a number of different GNSO constituencies) and those (UK, BRZ, and CH) proposing some steps forward, especially in the recognition of the UN Guiding Principles (Ruggie Principles). However, again in our view, the discussions in the Subgroup did not yield a properly balanced result, which would have reflected at least some if not all of the positions and proposals made by the named Governments. This relates in particular, that the FOI text should make stronger reference to the UN Guiding Principles as the most relevant voluntary international standard. In our view, the Subgroup did not undertake an inclusive enough effort to determine if a compromise text could be formulated that would accommodate this position of the three governments. Therefore, I would like to suggest that the CCWG Plenary could decide that some additional efforts to reaching a broader consensus on this important issue should be made – a broader consensus that could be more inclusive of all views expressed during the public comment period. Hence, I would suggest that the CCWG decides that the Report together with the dissent are sent back to the Subgroup with the request that a broader consensus solution is quickly sought within the coming e.g. 2 weeks after the Plenary call. I hope this way to proceed may seem reasonable to you and obtain your support during the abovementioned call. I would be happy to answer any questions you may have and look forward to your feedback. For my part I’ll try hard to attend the Wednesday call, but I’m (physically) attending at the same time the UN CSTD Working Group on Enhanced Cooperation. Hence, I would be very thankful if this issue could be discussed on the Thursday call instead if possible. Hi, Attached is version 1.6 of the Staff Accountability report. It is being submitted for a first reading in the full WS2 meeting. This will be the group's second attempt to do so. We have, since the first failed reading, discussed the issues that came out from that reading and have made extensive changes to the recommendations and their wording. The report has received consensus from the subgroup in all aspects but one. Due to the limited number of people participating in out last meetings we felt that we could not resolve that issue without a wider conversation. Currently recommendation 4a reads: ICANN Organization should work with the community to: a.Develop and publish service level guidelines (similar to the Service Level Agreement for the IANA Numbering Services) that clearly define all services provided by ICANN to contracted parties and the service level target for each service. The recommendation in our previous attempt at a first reading in the full group had been for a service level agreements (SLA). As there had been strong reaction on SLAs because of their legal nature and the difficulty involved in negotiating such SLAs, the recommendation was changed to guidelines. In response, there was consensus in the subgroup, though not unanimity, for recommending guidelines instead of agreements. During the subgroup consensus call, there was a request that we wait until there had been time for more comment from the Contracted Parties House of the GNSO, on whose behalf the original recommendation had been made. It was argued that guidelines were an unreliable mechanism and that it would be better to develop SLAs. Because of the tight schedule and the intermittent nature of sub-team member attendance, it was recommended by others that we send the subgroup consensus document as is on to the full meeting leaving the issue of 4a open for discussion in the full meeting. All, In preparing the agenda for the 27 September 1300 UTC plenary it has become obvious that we will not be able to complete the usual administration and all of the 4 first readings (SOAC Acct, HR, Ombuds, Staff Acct) and the second reading of the Diversity recommendations in a two hour meeting. *Given the importance of completing these readings at this time the Co-Chairs have decided to schedule an additional 2 hour plenary session to complete this work for Thursday 28 September 1900 UTC.* In addition to this the Co-Chairs have scheduled 2 additional plenaries prior to the 18 October 1900UTC plenary to allow all sub-groups the maximum opportunities to complete their work, should any amendments be required of sub-groups between readings, and have it approved by the plenary so it can go to public consultation (if required). These additional plenaries are scheduled for: - 4 October 0500 UTC - 11 October 1300 UTC If there is no need for either of these additional plenaries these will be cancelled on the preceding Monday via an email to the list. The package for the 27/28 September plenary, including the agenda and documents, will be forwarded to the list within the next 24 hours as per usual. 19th September 2017, Dear Co-Chairs, The WS2 Sub-Group on ICANN Ombuds Office (IOO) is very pleased to present to the plenary of the CCWG on ICANN Accountability WS2 our Report titled ‘CCWG-Accountability-WS2-Ombudsman-DrafRecommendationsV2.2’ for first reading, discussion, review, comments and consideration. It was finalized, on Monday 18th of September 2017 at the 30th meeting of the IOO Sub-Group. As IOO Sub Group Rapporteur I will be pleased to answer any questions and discuss any comments from our CCWG.
