Review of plan for Hyderabad Sebastien Bachollet: (Presentation of slides) Herb Waye: Concerned this report only represents the views of a small number of people and not the community. Sebastien Bachollet: Our work will be presented to the plenary of the CCWG-WS2 so this is not an issue. After it is accepted it will go for public comment to be accepted by the community. Herb Waye: Willing to pay for part of the evaluation, have funds and will have to do one (there may be a conflict of interest with such funding). Klaus: I am just thinking about if anybody outside the WG will actually understand the slides? Somehow I think not. We might need a more "understandable" version. Content is OK but who will understand and do we get the message across? Avri Doria: i think there will be chance to explain t to assembled crowd. In terms of staff accountability, we have included a reference to the necessity of coordinating with this group. Chris LaHatte: the slide about consent of the Ombuds is an issue Avri Doria: but the people listening will all be CCWG participants. Herb Waye Ombuds: Did this idea of consent come about as a copy of the reconsideration new process in the bylaws I wonder? Klaus: I think the cross group issue is critical now, we will need to have a mechanism in place to have the input from the other WG's Bernard Turcotte: @Klaus - the co-chairs advised on the leadership call last week that they would focus on this to ensure synchronicity between sub-groups Klaus: Great, good to know. Thanks Karen Mulberry: I am working out the details for the Review that you have asked for Cheryl Langdon-Orr: we should note that at least from the slide mentioning crossover matters the mention of Elections might be inflammatory for some CCWG Members. Sebastien Bachollet: This was one of my suggestions for our work. Herb Waye Ombuds: That idea is good Seébastien and it could be in the office but I would need to ask for funding for staff... The IOO could become a sort of ethics office Sebastien Bachollet: the evaluation will probably impact our timetable. Klaus: Ethics can never be a subject of an office but an community. Happy to discuss this at a face to face basis. Herb Waye Ombuds: Agree Klaus, two separate hats but some organizations do it as part time functions. Sbastien Bachollet: Shall we resume our calls immediately after Hyderabad. Next meeting on November 14 or 21? will check with staff AOB? (none). Adjourned.

Hello Xavier, <putting ccwg in CC as I have no idea which other list discusses this> I am looking at the figures recently published and I find it quite interesting but i am always reminded that ICANN sure have the money so why not. However I have a few questions and would appreciate your response: 1. The figure vary by Board member, apart from difference that could occur as a result of flight booking, are there any other factor/elements that affect figures? 2. Is there any limit to what a Board member can spend? 3. Does the column for amount paid "on behalf" include travel expense for ICANN meetings (and other Board specific meetings)? 4. What determines if a Board get compensated or not. i.e is board member participation like attendance to meetings, delivery on internal committee tasks et all considered as part of the requirement for payment? and is there publicly available record of such? 5. Am I right that the compensation is tax free as the Board ain't employees? 6. Some of the members seem not to be given the compensation, is there a reason for this? Welcome Greg Shatan: Acknowledge KA statement. Advise everyone that we will consider all the tough questions within our scope and that we will reach consensus on these. Statement from Kavouss Arasteh for the record: While the works of all subgroup are important and valuable and their efforts are fully recognized and highly appreciate, I as a Member of CCWG associate a very high degree of importance to a mutually accepted output of Jurisdiction sub group. I hope our expectations would be realized and the group produce an output which properly and legally address the case under consideration. It would be totally inacceptable, disappointing and frustrating to either end up with status quo or a Watered town product. The overwhelming majority community, in particular those which are still skeptical to the concept of multistakeholder approach, are carefully monitoring the output of this group to join others getting assurance that this fundamental, crucial and important issue is concluded with satisfactory results. We count on all of you and, in particular, count on the able chairman to explore all his expertise, skills, competence, knowledge and fairness in this regard 2. Review of Progress to Date Greg Shatan: will post this to a Google doc and give the group 24 hours to review. Any comments on A? (none). PDS email comment for B - Generally speaking, the progress report seems reasonable to me. I would only suggest the removal of the expression "and the Subgroup can’t find a less drastic solution" in point 2.b, as the idea of what "drastic" means seems quite abstract to me and can be subject to misinterpretations. Any comments on this? In meeting 7 of this sub-group it was phrased as this and accepted at that time. Avri Doria: So many other words can be used vs drastic why not change it. Milton Mueller: how about just replacing "less drastic" with "another"? Christopher Wilkinson: Agree with 2A, never understood what a gap analysis would be and support changing the word Drastic. Kavous Arasteh: Alternate solution - part starting with "IF the subgroup deems it is necessary to revisit this it will be done accordingly" Greg Shatan: KA please check if notes ok. Would like for this group to do more work on this document prior to presenting in Hyderabad. Greg Shatan: No, more about making ICANN immune like NGOs etc. Paul McGrady: If this would happen it would undo all the accountability work we have just completed in WS1. Greg Shatan: There is much work to do even before we even consider this point. Paul McGrady: All horrible tends to grow in this environment - I think this is a horrible idea and hope it will not grow. Jorge Cancio: Immunity was inserted last week in the Multiple layers document. then there was another addition as an Addition vs a Suggestion that immunity would block accountability measures and should only be a suggestion. Agree with GS that it is early days and we should focus on the influence document. We cannot dismiss immunity without proper discussion and as such we should not jump to conclusions. In the Multiples layers document we should simply note that we will get to this if necessary. Greg Shatan: offending text now changed to suggestion mode. Greg Shatan: We should not raise immunity within the 30 minutes in Hyderabad. Any comments on the Influence document? much text has been added and you have until Sunday to insert comments. (Presentation of influence document) Section C is the heart of the document but t is unfortunately empty at this time. Jorge Cancio (GAC Switzerland): Let's focus on real life issues for the community - this "influence" doc is a good basis for gathering also inputs from the community Kavous Arasteh: If you refer to California law please include or hyperlink the document so we understand the references. Greg Shatan: good suggestion will look at doing this. We will circulate the latest copy of this document after this call. Parminder's issues are around the power of the state. JC is more about choice of law. Jorge Cancio (GAC Switzerland): @Greg: could we at some time circulate this to registries, registrars and others directly affected in order to gather their impressions? We need to listen to real-life needs... otherwise we may get into an academic exercise with all due respect to academics of course :P Kavous Arasteh: not distribute widely at this point. I am so sorry I did not see this email sooner to respond. I believe Kavouss does not use Outlook calendar, he uses Google calendar. When a meeting populates on his Google calendar it populates all the invitees also. He simply used that list of names instead of using the CCGW accountability address (accountability-cross-community(a)icann.org)<mailto:accountability-cross-community@icann.org)> Hope this answers the question. The future of the internet could be at stake at a conference beginning this week in Tunisia, where diplomats from more than 100 countries will debate United Nations jurisdiction over the web. What emerges from the World Telecommunication Standardization Assembly will affect geopolitics and global economic growth, and possibly internet freedom for billions of users. U.N. members will address cybercrime, privacy and the potential regulation of internet companies, applications and content. Most important, diplomats will discuss the emerging Internet of Things, which will soon connect tens of billions of devices and people to the global network. A new navigational and addressing technology, Digital Object Architecture (DOA), could enable the real-time surveillance and tracking of each device and individual connected to the web. Some governments are advocating that DOA be the singular and mandatory addressing system for the Internet of Things. They also want this system to be centrally controlled by the U.N.’s International Telecommunication Union, which has contractual rights to the underlying intellectual property. At the meeting in Tunisia, China is working to join the leadership of the global study group on DOA and the Internet of Things, which <http://www.itu.int/en/ITU-T/wtsa16/Documents/WTSA16Infographic.pdf> the U.N. projects will generate $6 trillion in global economic value by 2025. Digital Object Architecture tracking tools could be integrated into industries ranging from aviation to pharmaceuticals.‎Such a system could also help governments mandate charges for any online financial transaction, such as through bank ATMs, credit-card payments, electronic money transfers or mobile banking. Such transaction taxes could upend the pace of investment and innovation in the internet space and distort global commerce. The brewing conflict comes at a difficult moment. On Oct. 1, the Obama administration relinquished its legal oversight of the Internet Corporation for Assigned Names and Numbers (Icann), which manages the Domain Name System. The fight over Icann’s future ended a decadeslong bipartisan consensus on how to protect an open internet. U.S. policy makers should put the Icann fight behind them and work together to think strategically about the emerging geopolitics of the internet and restore both unity and resolve to a fragmented American tech policy. At risk is the internet’s technical architecture and regulatory structure, which scores of nations seek to bring under foreign government and multilateral control. These latest developments are part of a broader shift in the relationship between government and the internet. Countries like Russia, Iran and Saudi Arabia are all pursuing a grand strategy to use international organizations, particularly the U.N., to control the digital future. The Tunisia conference is the latest in a series of efforts to expand the International Telecommunication Union’s mandate beyond its historical function of telecommunications coordination. Today’s global fight over internet freedom started more than a decade ago. In 2003, China, Russia and other countries initiated a persistent and patient campaign to bring Icann under the control of the United Nations. In 2012 the U.S. led a coalition of 55 countries that refused to sign a global treaty negotiated in Dubai that would have expanded the U.N.’s reach and power to shape how key aspects of the internet operate. While the U.S. and some of its internet allies rejected the Dubai power grab, 89 other countries voted for more U.N. influence, including an enlarged role in “international Internet governance and for ensuring the stability, security and continuity of the existing Internet and its future development.” That particular <http://www.itu.int/en/wcit-12/documents/final-acts-wcit-12.pdf> resolution was rammed through at 1:30 a.m. on the penultimate night of the conference—forcing the U.S. delegation, of which we were both members—to contest the conference’s legitimacy and boycott its result. In 2015 a coalition comprised of China and 134 other countries submitted a manifesto to another U.N. meeting insisting that national governments—rather than NGOs, civil society, consumers or business innovators—should dictate the digital future. The bloc declared that “overall authority for Internet-related public policy issues is the sovereign right of States.” In April Russia’s <file://www.wsj.com/news/author/6409> Vladimir Putin and the leaders of China and India issued a joint communiqué proclaiming “the need to internationalize Internet governance” and enhance the role of the U.N. Momentum, energy and numbers are on their side. As is bureaucratic power: A Chinese government diplomat is today the secretary-general of the U.N.’s International Telecommunication Union. The first iteration of the privatized internet was conceived and controlled by the nongovernmental global technical community, civil society and the private economy, which unleashed the greatest wave of innovation in world history. The internet of the future, in contrast, may be shaped by foreign governments and the U.N. if countries like Russia, Iran, Saudi Arabia and China achieve their strategic objective. America must quickly move beyond the divisive argument about Icann and regain its internet-policy footing. Many more consequential battles over internet freedom loom—conflicts that will shape the digital future. It is time for the U.S. to unify again behind a bipartisan vision and common strategy to safeguard internet freedom for tomorrow. Mr. McDowell, a former Republican commissioner of the Federal Communications Commission, is a senior fellow at the Hudson Institute. Mr. Goldstein, a Democrat, is an adjunct senior fellow at the Council on Foreign Relations.

Avri Doria: there are 4 points which did not get inserted in the document because they were not accepted. These are: avri doria: Are individual staff members accountable to the ICANN community, or are they only accountable to their bosses in the ICANN staff hierarchy? In other words are there multiple points of staff accountability to the community or is only the CEO accountable. Are their different accountability structures for policy staff who are an integral part of the community processes than there is for operational staff, e.g. GDd? Is the CEO accountable to the Board, to the ICANN community or to both? Are staff, members of the ICANN community? Are they stakeholders in any sense? If they are stakeholders, how does their position in a hierarchical top down structure affect the nature of their stakeholder relationship to the rest of the community. Avri Doria: Still unclear on how to take the next step and where to get the answers to these. Pam Little: would Sam Eisner be helpful in this. Jordan Carter: I will do a final edit and submit to CCWG staff asking where these questions should be addressed officially. Next steps - work plan Drafter/s for Doc 1 (roles of staff, board, etc. document, includes definitions of staff/board/etc., and description of interactions among staff/board/etc.) Drafter/s for Doc 2 (staff code of conduct and other internal matters document) Jordan Carter: Have to advise our rapporteurs that once we get the information from ICANN there will have to be some writing by more than just the rapporteurs. But Steve Crocker has said there are overlaps with the AOC reviews - what is the status of this? Avri Doria: have not heard there is any intent to merge any of our work.
