Compliance Staff response to questions posed during ALAC Policy Discussion Part 1 Meeting

Dear All, As requested during the Compliance staff briefing that took place in the ALAC Policy Discussion Part I meeting held 7 December 2010, please find below the written answers to questions that were posed in the Adobe Connect room. ** Q: How many new compliance officers are planned to be added during the next calendar year? A: 3 but we have plans to adequately staff the department to support the new gLTD program. Q: The latest draft terms and conditions governing registrar accreditation applications still seem to allow for the accreditation of shell corporations. Why is ICANN continuing to allow this practice? A: It is our understanding that there is no policy that prohibits this practice. If the community wishes to adopt such a policy, staff will follow it. Q: Section 3.16 of the RAA requires registrars to provide on their web sites accurate contact details, including a valid email and mailing address. Is this being audited? A: It is ICANN's current practice that prior to renewal, ICANN informs registrars of this new requirement and checks registrars' websites for compliance as part of the renewal process. In addition, ICANN is planning to incorporate website checks into its 2011 registrar audit schedule. Q: Onlinenic was ordered to pay $33 million for cybersquatting. Why is this cybersquatter still an accredited registrar? A: ICANN was aware of the judgment, but the matter was subsequently settled between the parties. ICANN staff engaged in numerous correspondence and discussions with OnlineNIC's attorneys and staff when considering its renewal application. Based on the facts and materials available to ICANN at the time, we did not believe that there were grounds for denying its renewal application pursuant to Section 5.4 of the RAA: 5.4 Term of Agreement; Renewal; Right to Substitute Updated Agreement. This Agreement shall be effective on the Effective Date and shall have an initial term running until the Expiration Date, unless sooner terminated. Thereafter, if Registrar seeks to continue its accreditation, it may apply for renewed accreditation, and shall be entitled to renewal provided it meets the ICANN-adopted specification or policy on accreditation criteria then in effect, is in compliance with its obligations under this Agreement, as it may be amended, and agrees to be bound by terms and conditions of the then-current Registrar accreditation agreement (which may differ from those of this Agreement) that ICANN adopts in accordance with Subsection 2.3 and Subsection 4.3. ICANN continues to closely monitor OnlineNIC's registration practices as well as its compliance with all RAA requirements. The fact that OnlineNIC is now under the 2009 RAA means more enforcement tools would be available to ICANN if OnlineNIC is found to be non-compliant with its RAA obligations. DOODLE / Community call on Internationalized Domain Names (IDNs)

Dear All, As requested by Olivier Crepin-Leblond, Chair of the ALAC, an At-Large Community call on Internationalized Domain Names (IDNs) is being organized for the week of 20 December. Tina Dam, ICANN's Senior Director, IDNs, and Bart Boswinkel, ICANN’s Senior Policy Advisor, ccNSO, will talk about the currently open public comments related to IDNs: 1) Interim Paper Inclusion of IDN ccTLD’s in the ccNSO<http://icann.org/en/public-comment/#idn-cctld-ccnso>, 2) Draft Final Report on Policy Aspects Regarding Introduction of Single Character IDN TLDs<http://icann.org/en/public-comment/#jig-draft-final-report>; and 3) Review of IDN ccTLD Fast Track Process<http://icann.org/en/public-comment/#fast-track-review-2010>. Participants will also be able to engage in a discussion of these three issues with the guest speakers. This call will be scheduled for 60 minutes at an Asia-Pacific friendly time. Interpretation into French and Spanish will be available upon receiving 3 or more requests. Final CSTD Text for Information

Dear All, Please find below a copy of the final text adopted on Friday by the Commission on Science and Technology for Development (CSTD), and provided by Baher Esmat, Manager, Regional Relations for the Middle East. It is the view of the ALAC ExCom that becoming directly involved with the CSTD process constitutes mission creep. Indeed, some RALO bylaws specifically prohibit such involvement beyond the confines of ICANN. The statement below is therefore provided to our ALSes for informational purposes only, as an aid to understand the overall environment that ICANN is evolving in. As the text does not explain procedures used to choose CSTD invitees, we encourage the ALSes directly involved with that process to continue their work and look forward to continue receiving high-level updates on their valuable work. ** Final Text: The Chair of the CSTD establishes a Working Group of 15 member states plus the five member states which hosted the IGF meetings plus the two member states which hosted WSIS. This Working Group will seek, compile, and review inputs from all member states and all other stakeholders on improvement of the Internet Governance Forum in an open and inclusive manner throughout the process The Chair invites the following stakeholders to interactively participate in the Working Group, bearing in mind the the established rules of procedure of the ECOSOC, who will remain fully engaged throughout the process: 5 Business community 5 Civil society 5 Technical and academic community 5 Intergovernmental organizations Pursuant to the ECOSOC decisions 2010 226, 2010 22, and 2010 228, maximum possible assistance, the diversity of ideas, and the equal representation of stakeholders from developing and developed countries in the Working Group should be ensured in consultation with the stakeholders. The report of this Working Group will be adopted by consensus. This statement was originally prepared on November 20 by Evan Leibovitch, Chair of the At-Large gTLD Working Group, at the request of ALAC. Version 2 was prepared on November 23 based on input from a community meeting. Minor changes made afterwards, based on input of community members.
