RDS users may include (but are not limited to) Registrants, Proxy Service Providers and Customers, Internet Technical Staff, On-Line Service Providers, Individual and Business Internet Users, Internet Researchers, Intellectual Property Owners, Law Enforcement Agencies, Operations/Security Incident Investigators, and others requesting gTLD domain name registration data for legitimate purposes. Purpose of RFI ICANN is releasing this Request for Information at the request of the Expert Working Group on Next Generation gTLD Directory Services (EWG). The EWG is now developing recommendations to identify a replacement to the current WHOIS system that could better meet global Internet community needs for domain name registration data while offering greater privacy, accuracy, and accountability. With this Request for Information, the EWG seeks to solicit responses from organizations that currently issue system access credentials to authorized members of their own community, using defined acceptance criteria. The EWG hopes to build upon existing membership or credentialing processes to fulfill RDS user accreditation needs, should ICANN pursue RDS implementation in the future. The purpose of this RFI is purely informational – that is, to inform the development of policies and procedures that may follow the EWG's Final Report. As a result, potential Respondents responding to any future RFP for the EWG Project will not be bound by the estimates, prices, or other information provided in response to this RFI. Background on the EWG Project In December 2012, ICANN announced the creation of an Expert Working Group (EWG) on next-generation gTLD Registration Directory Services, as a first step in fulfilling the ICANN Board's directive to help redefine the purpose and provision of gTLD registration data. The EWG's findings are expected to serve as a foundation to help the GNSO create a new global policy for the provision of gTLD registration data. The Initial Report<http://www.icann.org/en/groups/other/gtld-directory-services/initial-report…> [PDF, 1.70 MB] enumerated the users, purposes, data elements, recommended principles and features, and proposed model to guide the development of a next generation Registration Directory Service (RDS) to replace WHOIS. Prior to the ICANN Meeting in Buenos Aires, the EWG published its Status Update Report<http://www.icann.org/en/groups/other/gtld-directory-services/status-update-…> [PDF, 2.26 MB] to highlight the EWG's thinking on these and many other key issues. It also provides a great deal more detail on the analysis that lay behind the Initial Report<http://www.icann.org/en/groups/other/gtld-directory-services/initial-report…> [PDF, 1.70 MB]. The EWG is currently in its research and information gathering phase. This RFI is one of several research efforts that the EWG is currently undertaking to ensure that its final recommendations are supported by facts and informed by current practices. The EWG expects to complete its recommendations in 2014, informed by Community feedback and in-depth analysis of selected areas, including the responses to this RFI. The EWG plans to reconvene in March 2014 to derive fact-based recommendations after carefully examining the results of its research, and expects to deliver its final report to the ICANN Board by June 2014. This RFI is intended to inform two distinct ICANN projects that require address validation and verification. The first project relates to a near-term need for postal address cross-field validation services arising out of requirements applicable to those registrars who have signed the new 2013 Registrar Accreditation Agreement (RAA Project). In addition, ICANN is seeking similar information for a separate longer term project in connection with Expert Working Group on Next Generation gTLD Directory Services ("EWG") recommendations to identify a replacement to the current WHOIS system. The EWG is now developing recommendations for a new system that could better meet global Internet community needs for domain name registration data while offering greater privacy, accuracy, and accountability (EWG Project). Background on the RAA Project Registrars who are accredited under the 2013 RAA are currently required to perform limited validation of registration contact data. The agreement envisions<http://www.icann.org/en/resources/registrars/raa/approved-with-specs-27jun1…> that registrars will also perform cross-field validation of address data (e.g., the house number exists on the street, which exists in the city and province, and the postal code is correct). This cross-field validation requirement becomes effective 6 months after ICANN and a working group of registrar volunteers have agreed that cross-field validation is technically and commercially feasible. ICANN has convened the registrar working group that is exploring address validation service options. The RFI published today intended to help inform that working group's work. As part of the New gTLD Program, ICANN has put in place the Public Interest Commitment Dispute Resolution Procedure<http://newgtlds.icann.org/en/applicants/agb/picdrp-19dec13-en.pdf> [PDF, 208 KB] ("PICDRP") to address reports of a Registry Operator's non-compliance with one or more of the public interest commitments included in Specification 11 of its Registry Agreement with ICANN. 2. During the compliance review and investigation process for a report submitted to ICANN under the PICDRP, ICANN may call upon the Standing Panel to review one or more reports in order to evaluate whether the Registry Operator was or was not in compliance with Specification 11 of the Registry Agreement. Composition of Standing Panel 1. The Standing Panel shall consist of a minimum of three members, with more members to be added as deemed necessary. Not all members of the Standing Panel are necessary to the consideration of each report referred by ICANN. 2. The Standing Panel members should have diversity in geographic and cultural representation. Diversity of experience will be considered in completing the composition of the Panel. Proposed Qualifications of Standing Panel Members 1. In consideration of the scope and areas of expertise required, that Standing Panel members, in the aggregate, should have expertise and significant knowledge in the following (or similar) aspects/areas. * Online content * Public policy * Trademark protection * International dispute resolution * Cultural studies * Judicial and/or legal experience * DNS technical experience * Regulatory background * Sociological research experience * Contract interpretation experience * Licensing experience * Cybersecurity 2. Panel members should have demonstrated recognition of expertise and knowledge through high-level positions, peer group recognition, and/or history of publications/presentations on relevant topics. Conflict of Interests All Panel members must be independent from ICANN (i.e., not an ICANN employee; not a member of any ICANN Sponsoring Organization or Advisory Committee; not affiliated with any registrar or registry holding a contract with ICANN). Further, all Panel members must adhere to ICANN's conflicts of interest policy and annually complete a Conflicts of Interest Disclosure Form. Time Commitment 1. To keep the costs and burdens of evaluation as low as possible, absent exceptional circumstances, the Standing Panel is expected to conduct its proceedings by email, by telephone and otherwise via the Internet. 2. It is anticipated that the Standing Panel may start to have matters referred to it by ICANN within one month of the Panel formation. The members of the Standing Panel will be required to review reference and training materials prior to receiving matters such that the Panel members understand the Public Interest Commitments Dispute Resolution Process. For each matter referred, the Standing Panel will be expected to evaluate compliance by the Registry Operator and report its evaluation results to ICANN. The Standing Panel is expected to deliver its evaluation results to ICANN within 15 days of reference by ICANN. 3. At present it is unclear how many matters will be referred to any given Standing Panel member; over time this may become more predictable based on the nature and number of the reports submitted. Fees for Service on Standing Panel Fees to be determined based on, among other things, proposals received. Terms of Standing Panel Member For the purpose of continuity and consistency, the terms of Standing Panel members will be staggered. For a start, the terms of two of the Standing Panel member shall be two (2) years and the term of the third member shall be one (1) year. Subsequent terms of new members and renewal of terms shall be two (2) years and members, with agreement from ICANN, are allowed to renew for a maximum of two (2) terms. Timing It is anticipated that the Standing Panel membership will be announced by end of March 2014. Background In December 2012, ICANN announced the creation of an Expert Working Group (EWG) on next-generation gTLD Registration Directory Services, as a first step in fulfilling the ICANN Board's directive to help redefine the purpose and provision of gTLD registration data. The EWG's findings are expected to serve as a foundation to help the GNSO create a new global policy for the provision of gTLD registration data. A significant milestone was reached on 24 June 2013<http://www.icann.org/en/news/announcements/announcement-3-24jun13-en.htm> with the publication <http://www.icann.org/en/news/announcements/announcement-3-24jun13-en.htm> of the Expert Working Group on gTLD Directory Services<http://www.icann.org/en/groups/other/gtld-directory-services> (EWG)'s Initial Report and FAQs, opening a consultation period with the ICANN community. The Initial Report<http://www.icann.org/en/groups/other/gtld-directory-services/initial-report…> [PDF, 1.70 MB] enumerated the users, purposes, data elements, recommended principles and features, and proposed model to guide the development of a next generation Registration Directory Service (RDS) to replace WHOIS. Prior to the ICANN Meeting in Buenos Aires, the EWG published its Status Update Report<http://www.icann.org/en/groups/other/gtld-directory-services/status-update-…> [PDF, 2.26 MB] to highlight the EWG's thinking on these and many other key issues. It also provides a great deal more detail on the analysis that lay behind the Initial Report<http://www.icann.org/en/groups/other/gtld-directory-services/initial-report…> [PDF, 1.70 MB]. The EWG is currently in its research and information gathering phase. This Questionnaire is one of several research efforts that the EWG is currently undertaking to ensure that its final recommendations are supported by facts and informed by current practices. What's Next? The EWG expects to complete its recommendations in 2014, informed by Community feedback and in-depth analysis of selected areas, including the responses to this Questionnaire. The EWG plans to reconvene in March 2014 to derive fact-based recommendations after carefully examining the results of its research, and expects to deliver its final report to the ICANN Board by June 2014. This group will informally review SSAC reports to determine whether they contain recommendations that might deserve broader consideration in the GNSO. Problem Statement Recommendations made by the SSAC sometimes are relevant to GNSO policy making, yet the mechanism for the GNSO to find out or act on them is not well developed. The current process is for the SSAC to give advice to the Board, with the presumption that the Board will pass relevant issues along to the GNSO for consideration. This doesn't appear to be happening in all cases, with sometimes-unsatisfactory results. Here are two examples: * The SSAC produced an extensive report (SAC007<http://www.icann.org/announcements/hijacking-report-12jul05.pdf> [PDF, 400 KB]) in 2005 that addressed the issue of domain-name hijacking. In 2011, six years later, members of the GNSO IRTP-B working group stumbled across the following observation in that report and realized that it was a good idea: * "Collect emergency contact information from registrants, registrars and resellers for parties who are suited to assist in responding to an urgent restoration of domain name incident. Define escalation processes (emergency procedures) that all parties agree can be instituted in events where emergency contacts are not available." It took six years for that very common-sense idea to find its way into Consensus Policy and probably another year or two to implement. * The SSAC wrote a report (SAC045<http://www.icann.org/en/groups/ssac/documents/sac-045-en.pdf> [PDF, 507 KB]) in 2010 titled "Invalid Top Level Domain Queries at the Root Level of the DNS" which provided an early warning about the "name collisions" problem. Again, an opportunity to proactively research this issue was missed and ICANN finds itself scrambling to deal with an issue that is much complicated by the fact that a number of the highest-volume invalid strings are now applied-for strings and soon to be delegated into the root. A related problem is that the stakeholder-group structure of the GNSO does not have an SSR-focused forum for this kind of cross-GNSO conversation. How does not solving this problem get in the way of achieving ICANN's objectives? The implication is that the GNSO may sometimes fail to consider SSAC recommendations in a timely way, or at all. Specifically, not solving the problem raises the possibility of: * Negative impacts on SSR of the DNS – as a result of not considering or implementing SSAC recommendations, or building trust relationships in an SSR community of interest * Increased implementation costs – as a result of delay in considering SSAC proposals that may bear on GNSO consensus policy * Lower quality of implementation – as a result of not taking fullest advantage of the rigor of the multi-stakeholder analysis and PDP processes Value to be gained In addition to addressing the problems listed above, the GNSO will benefit from having this group by: * Broadening the pool of participants -- by identifying and engaging community members who have interest and skills in SSR of the DNS * Building trust relationships – by providing community members an opportunity to work together in a low-key setting Approach The primary work product of this group will be periodic informal suggestions of SSR-related topics to be considered by the GNSO. The form of that consideration may vary. Possibilities include: * An Issue Report * An alert to a currently-running working group or implementation review team * Notifications to constituencies and stakeholder groups The group: * Will do its work via an email list – no teleconferences are planned * Is open to all members of the ICANN community – all AC's and SO's, staff, Board, etc. * Will require that all participants submit or update their GNSO Statement of Interest<https://community.icann.org/pages/viewpage.action?pageId=14713457> before they are subscribed to the list * Will maintain open public email archives – and thus will not discuss private or confidential information * Will be convened by Mikey O'Connor until somebody gets tired of him and offers to take over * To join the mailing list please RSVP gnso.secretariat(a)gnso.icann.org<mailto:gnso.secretariat@gnso.icann.org>
