This year, the community selection panel posthumously recognized a long-time member of the ICANN community: Stéphane Van Gelder. The award was presented today at ICANN62 in Panama City to Stéphane Van Gelder’s wife Julie Talfournier Van Gelder. Community member Keith Drazek presented the award on behalf of the community selection panel. He enumerated Stéphane Van Gelder’s many contributions and attested to how he was admired for “his passion, his fairness, his ability to find the best in people, and his true gift for uniting people.” Cherine Chalaby, Chair, ICANN Board, and Göran Marby, President and CEO, ICANN, also remembered Stéphane Van Gelder. Chalaby stated that Van Gelder’s “impact on the ICANN community, and many of us individually, cannot be overstated.” Marby urged community members present to continue in Stéphane Van Gelder’s spirit and “see the people behind the discussions.” Marby turned the podium over to Julie Talfournier Van Gelder, who spoke movingly about her husband, a man who she said “helped reveal the strength and skills in so many people.” The Multistakeholder Ethos Award honors members of the ICANN community who have made outstanding contributions to ICANN’s multistakeholder model of Internet governance. Stéphane Van Gelder was selected from a list of 16 nominees as the person who best demonstrated the spirit of collaboration, strongly promoting consensus. The community selection panel composed of nine members from different Supporting Organizations and Advisory Committees recognized Van Gelder for his immense dedication and commitment to ICANN’s multistakeholder model, which served as an example to others in the community. The multistakeholder model is built on achieving consensus, and Van Gelder’s contributions epitomize this ideal, making him the perfect recipient for the 2018 Multistakeholder Ethos Award. A unique point that stood out from the beginning of the community selection panel’s process was that Stéphane Van Gelder received nominations or endorsements from at least 10 different community groups, and also from several individuals and community leaders. It was an unprecedented level of support and something that the selection committee immediately recognized as important. The breadth and depth of cross-community support spoke directly to his impact representing each of the award’s criteria – breaking down silos, working across multiple groups, engaging in a collegial manner, and a record of substantive and meaningful contribution over many years. Stéphane Van Gelder’s contributions were distinct, and the level of support from the ICANN community was undeniable. From 2008 to 2012, he served on the Generic Names Supporting Organization (GNSO) Council as an elected representative of what was then called the Registrars Constituency (now the Registrar Stakeholder Group). On the GNSO Council, he served as vice chair in 2010 and was elected and served two consecutive terms as chair in 2011 and 2012. During his tenure as GNSO chair, Van Gelder oversaw and shepherded multiple key projects, including: · Completion of an extensive update of the GNSO's operating procedures. · Establishment of the Domain Name System Security (DNS) Security and Stability Analysis Working Group, working jointly with the At-Large Advisory Committee (ALAC), Country Code Names Supporting Organization (ccNSO), and Number Resource Organization (NRO). · Completion of the Fast Flux, Post-Expiration Domain Name Recovery and Inter-Registrar Transfer Policy (IRTP) Part B Policy Development Processes (PDPs), and the joint ccNSO-GNSOInternationalized Domain Name Working Group. · Launch of the IRTP Part C, Thick WHOIS, and Locking of Domain Names subject to Uniform Dispute Resolution Policy Proceedings PDPs. · Completion of the Applicant Guidebook for the 2012 New Generic Top-Level Domain (gTLD) Program and the launch of the program. Van Gelder was also a long-time contributor to the ICANN Nominating Committee, beginning in 2013, serving as its chair in 2015 and associate chair in 2017. He was a well-respected and much appreciated member of not only the GNSO, but of the broader ICANN community. His genuine passion, energy, and commitment to ICANN’s mission and his achievements in various roles across the community were second to none. All of these qualities and accomplishments strongly support the selection of Stéphane Van Gelder as the recipient of ICANN’s 2018 Multistakeholder Ethos Award. On 13 June 2018, ICANN appealed the Regional Court's initial decision to reject ICANN's application for an injunction, in which ICANN sought a court order requiring EPAG to reinstate collection of administrative and technical contact data for new domain name registrations. Upon receipt of an appeal, the Regional Court has the option to re-evaluate its decision that is being appealed, or affirm its decision and immediately forward the matter to the Higher Regional Court for consideration of the appeal. In this instance, the Regional Court has decided to revisit its initial decision and has asked EPAG to comment on ICANN's appellate papers within two weeks. ICANN is pursuing this matter as part of its public interest role in coordinating a decentralized global WHOIS for the generic top-level domain system. To that end, ICANN continues to seek clarity of how to maintain a global WHOIS system and still remain consistent with legal requirements under the European Union's General Data Protection Regulation (GDPR). Background: On 25 May 2018, ICANN filed the injunction proceedings against EPAG. ICANN asked the Court for assistance in interpreting the GDPR in an effort to protect the data collected in WHOIS. ICANN sought a court ruling to ensure the continued collection of all WHOIS data. The intent was to assure that all such data remains available to parties that demonstrate a legitimate purpose to access it, and to seek clarification that under the GDPR, ICANN may continue to require such collection. ICANN filed the proceedings because EPAG had informed ICANN that as of 25 May 2018, it would no longer collect administrative and technical contact information when it sells new domain name registrations. EPAG believes collection of that particular data would violate the GDPR. ICANN's contract with EPAG requires that information to be collected. EPAG is one of over 2,500 registrars and registries that help ICANN maintain the global information resource of the WHOIS system. ICANN is not seeking to have its contracted parties violate the law. Put simply, EPAG's position spotlights a disagreement with ICANN and others as to how the GDPR should be interpreted. On 30 May 2018, the Regional Court determined that it would not issue an injunction against EPAG. In rejecting the injunctive relief, the Court ruled that it would not require EPAG to collect the administrative and technical data for new registrations. However, the Court did not indicate in its ruling that collecting such data would be a violation of the GDPR. Rather, the Court said that the collection of the domain name registrant data should suffice in order to safeguard against misuse in connection with the domain name (such as criminal activity, infringement, or security problems). The Court reasoned that because it is possible for a registrant to provide the same data elements for the registrant as for the administrative and technical contacts, ICANN did not demonstrate that it is necessary to collect additional data elements for those contacts. The Court also noted that a registrant could consent and provide administrative and technical contact data at its discretion. On 13 June 2018, ICANN appealed the Regional Court's ruling to the Higher Regional Court of Cologne, Germany, and again asked for an injunction that would require EPAG to reinstate the collection of all WHOIS data required under EPAG's Registrar Accreditation Agreement with ICANN. ICANN appreciates and understands the dilemma of EPAG in trying to interpret the GDPR rules against the WHOIS requirements, but if EPAG's actions stand, those with legitimate purposes, including security-related purposes, law enforcement, intellectual property rights holders, and other legitimate users of that information may no longer be able to access full WHOIS records. In addition to the court proceedings, ICANN is continuing to pursue ongoing discussions with the European Commission and the European Data Protection Board to gain further clarification of the GDPR as it relates to the integrity of WHOIS services. About the Assessment Report The goal of the assessment report is to achieve maximum agreement between the wider ICANN community and the independent examiner as to which areas of the SSAC work well and which may benefit from improvements. Background to the SSAC2 Review A periodic review of the SSAC is mandated by ICANN Bylaws [icann.org]<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.icann.org_resource…> Section 4.4. The purpose of the review is to determine whether the SSAC has a continuing purpose in the ICANN structure and, if so, whether any change in structure or operations is desirable to improve its effectiveness. The review will also determine if the SSAC is accountable to its constituencies, stakeholder groups, organizations, and other stakeholders. As with all Organizational Reviews, the SSAC2 Review is following a two-phased approach, in which the independent examiner first completes its assessment and then makes recommendations to address the findings noted during the assessment. This approach contributes to more useful and relevant recommendations by providing an opportunity for the community and the independent examiner to discuss what works and what needs improvement before the independent examiner develops recommendations to address the observed situations.
