Hello Holly & All, good! Here's an outline for "New gTLDs: taking stock and looking forward from the user perspective". At this stage, I see no point in actually drafting, so the following are just place-holders or, at most, headings: 1) TAKING STOCK - the stated rationale for a vast and coordinated expansion of gTLD space - the genetic weakness of a constituency-by-constituency approach: magnifying detail, losing the wider view - the business bias: understandable, legitimate in its own logic, but insufficient - from rationale to implementation: diverging interests, incremental adjustments, the loss of global aim - consequences for the global Internet user: areas of negative impact 2) LOOKING FORWARD - the new gTLD programme must be placed in the wider context: what Internet governance, what MSM? - diverging interests (DNS businesses vs. general user): defining a new equilibrium, but consciously - it is time to refocus ICANN, from being perceived as an industry association, to recognition that it serves the global public interest - the difficult but inescapable overhaul this implies - process & calendar of this joint effort. Having only just discovered the very interesting remark by Fouad Bajwa that the ALAC needs a communication policy, I will be responding in a separate email. My point was not whether to trust compliance. We are not yet at the stage where they have any responsibility with regard to complaints about PICs. I have largely been absent from the debates of this last week or so, because I have been focusing either on ATRT work or in the moments when that was lighter, trying to catch up with other parts of my life that have been brushed aside recently. I have not had a chance to review the latest PICDRP document. But honestly, I don't think it will matter. The DRP is a dandy way for third parties who have been injured by PIC commitments not being followed. I am sure they have tweaked it a bit, and perhaps for the better. But it is not the mechanism that I really care about. We have been assured twice now, by Fadi during ALAC-Board meetings that there will be a parallel process for ICANN to take action. He has reasonably said that ICANN does not have the resources to police the PICs and detect every failure. With that, I have no real problem. But he has also said that if and when ICANN is alerted to problems, they will take action. The term he used at the last meeting is that the detection would be "crowd-sourced". Compliance has said that if given the mandate, they would take action, but so far (when it was said, I think in Beijing or perhaps at one of the ATRT meeting in in LA), they have only been given the responsibility of enforcing DRP rulings. Perhaps I have missed something, but I do not recall any public announcement of anything like what Fadi has described. If I am correct, then I strongly believe that THIS is what we need to make a strong statement about, but the details or even the concept of the PICDRP. As you know, numerous applications for gTLDs that are representative of, or related to, regulated sectors were received by ICANN. In recognizing the GAC's interest in how regulated industry/sensitive string applicants will adequately address core concerns about the public interest impact of their applications, I have been working with others to develop approaches that are high level and standardized to a great extent. This approach would allow applicants for gTLD strings associated with regulated industries and professions (or other high risk sectors, such as .KIDS, etc.) to demonstrate how they will develop, implement, and enforce policies for the registration practices and standards in their respective gTLDs. In our view, these practices and standards should reflect the concerns of regulatory authorities, public interest organizations -- and most importantly, users -- to enable those gTLDs applicants to move ahead through the review process as expeditiously as possible. An appropriate Policy Advisory Board (PAB) should be established prior to approval of a new gTLD application by ICANN, as the practices and standards it develops will determine acceptable registrants and uses. The attached Policy Advisory Board model documents provide a mechanism by which the GAC safeguard advice for protecting the public interest can be implemented to assure that, as Internet users interact with domains at new 'sensitive string' gTLDs associated with regulated industries and professions, they can be certain that the registrants are bona fide entities engaged in legitimate activities. This PAB approach establishes a standard framework for appropriate safeguards at sensitive string gTLDs that allows the flexibility to ensure that each Policy Advisory Board is reflective of a particular string and the concerns associated with it. The safeguards can be fully developed and implemented through the establishment of balanced and inclusive Policy Advisory Boards that can develop appropriate registrant eligibility criteria and registry policies -- those policies, in turn, can be incorporated within enforceable Public Interest Commitments Specifications (PICS) for the registry. The focus of this model is establishing baseline criteria and a standard threshold of certainty for the public, and for governments, through a standardized approach to accountability and public interest. On behalf of my colleagues and myself, we hope it might inform the NGPC and GAC deliberations on PICS in a useful and productive way. On Process-versus-implementation

Hello all, I am reminded -- quite correctly -- by Matt that in the last ALAC meeting, Alan and I said we would work on a comment regarding feedback to the GNSO Policy & Implementation WG<https://community.icann.org/pages/viewpage.action?pageId=42734846> . What would nominally be called for right now is a point-by-point answering of the questions sent by the GNSO working group to other community leaders. But I find, after reading and re-reading the original GNSO solicittation -- that I cannot bring myself to do this. To simply answer the questions -- to legitimize what is in my opinion a fraudulent and captured process -- is an abdication of our roles within At-Large. It does seems clear to me that certain ICANN actions have been outside (what I saw as) the intent of policy, and smack of certain interests asserting influence on implementation despite lack of success at the policy level. (Some of this activity indicates breakage in the policy-making technique, but that's a different matter) The search for bounds is legitimate, but it is a sham to leave the search for answers purely to the self-interested GNSO. This is legitimately an issue of cross-community engagement -- involving all ACs. SOs, and indeed ICANN staff -- and not to be left to the internal deliberations of the squeakiest wheel. (And no, being non-voting observers in a GNSO process does not count as cross-community.) When the GNSO originally explored a P&I working group I was concerned about its potential for captured agendas and prejudice; as I read the questions in the initial solicitation I see my concerns were justified. I also note that, once again, ALAC is being requested to respond to the agendas of others rather than taking leadership on issues ourselves. I am interested in ALAC producing a statement, but not like the one originally envisioned. I would like the ALAC to send formal advice to the Board requesting it to engage the *entire* community on better ways to have implementation issues inform policy, and to have implementation guided by both the letter and the spirit of established policy. This cannot be done in a vacuum, the issues are cultural as well as technical or procedural, and they and they certainly cannot be solved by the GNSO acting alone. ICANN was on the right track in creating a Policy and Implementation workshop <http://beijing46.icann.org/node/37133> at the Beijing meeting, one that had same-level involvement from across the community. In that workshop -- at which I was the ALAC participant -- it was agreed that cross-constituency engagement was required. This is indeed as the discussion *must* be, moving forward. The Board of ICANN needs to take leadership on this issue and must not leave its determination to just a single part of the community. I am happy to work on such a statement for ALAC's consideration. But I have no interest in validating what I see evolving into a GNSO power grab, and IMO neither should the ALAC. - Evan

This is a very good trio of NomCom Leaders. You all know Cheryl and Yrjö and I am thrilled Cheryl was appointed and she chose Yrjö as Associate Chair. You might know less about Stéphane. When he was GNSO Council Chair, we worked very well together, often emailing each other to collaborate to break the silos and make sure important matters did not get dropped by ICANN. Anyone who has Chaired the GNSO Council gets my respect. It is a incredible amount of work and takes a lot of blood and sweat and lack of sleep to reach consensus. Kudos to all three!
