The GNSO Council intends to appoint a single, neutral chair to the IGO Work Track. The deadline to submit Expressions of Interest is 30 November 2020 at 23:59 UTC. Background on the Intergovernmental Organization (IGO) Work Track IGOs may face certain challenges when using existing second-level domain name dispute resolution processes to protect their acronyms from misuse (i.e. curative rights). After much consideration, a GNSO International Governmental Organization (IGO) – International Non-governmental Organization (INGO) PDP Working Group has recommended that, in the admittedly rare case where the below conditions are met, the original Uniform Domain Name Dispute Resolution Policy (UDRP) or Uniform Rapid Suspension (URS) panel decision is to be set aside: 1. An IGO has prevailed in a UDRP or URS proceeding. 2. The losing registrant files suit in a court of competent jurisdiction. 3. The IGO successfully claims immunity from the jurisdiction of that court. Assuming an IGO is able to avail itself of the UDRP process, the effect of this recommendation is that the parties to the dispute will be placed in the original situation as if the UDRP or URS proceeding had never been commenced. During the GNSO Council's deliberations over the final PDP recommendations, concerns were expressed as to whether this particular recommendation will: - Require a substantive modification to the UDRP and URS (notwithstanding that these two dispute resolution procedures are currently under consideration in the Review of All Rights Protection Mechanisms PDP). - Result in a potential reduction of the existing level of curative protections currently available to IGOs (notwithstanding the fact that the Access to Curative Rights PDP had been chartered to determine "whether to amend the UDRP and URS to allow access to and use of these mechanisms by IGOs and INGOs …or whether a separate, narrowly-tailored dispute resolution procedure at the second level modeled on the UDRP and URS that takes into account the particular needs and specific circumstances of IGOs and INGOs should be developed"). Consequently, the GNSO Council did not approve this particular recommendation and tasked the IGO Work Track to develop an appropriate policy solution. This solution should be consistent with the other recommendations in the PDP Final Report <https://newsalerts.icann.org/n0Cg0fR022NP0ER08200dc0> and: - Account for the possibility that an IGO may enjoy jurisdictional immunity in certain circumstances. - Leave intact the right and ability of registrants to file judicial proceedings in a court of competent jurisdiction whether following a UDRP/URS case or otherwise. - Recognize that the existence and scope of IGO jurisdictional immunity in any particular situation is a legal issue to be determined by a court of competent jurisdiction (see https://gnso.icann.org/en/council/resolutions#20190418-03 <https://newsalerts.icann.org/NR00gC2d0002gcE0SN0082P>). The ICANN Board recognizes Biaou's commitment to local and regional capacity-building programs in his home country of Benin as well as across Africa. He has worked to improve the technical skills of women in Africa and encouraged their participation in endeavors related to the Internet and Domain Name System (DNS). Through his efforts, the diversity and number of new ICANN community members increased. The GAC provides advice to the ICANN Board on policy matters where there may be an interaction between ICANN’s policies and various laws, international agreements, and public policy objectives. NEW: ICANN org Responds to the European Data Protection Board’s Public Consultation on the Board’s Guidelines on the Concepts of Controller and Processor ICANN recently announced <http://r20.rs6.net/tn.jsp?f=001XwkZSMKGBDCQ5jLElccofyFZTi02XvJ_c5fVGUyPwJCH…> that it has responded to the European Data Protection Board's (EDPB) public consultation on its Guidelines 07/2020 on the concepts of controller and processor in the GDPR <http://r20.rs6.net/tn.jsp?f=001XwkZSMKGBDCQ5jLElccofyFZTi02XvJ_c5fVGUyPwJCH…>. The EDPB is an independent European body whose purpose is to ensure consistent application of the General Data Protection Regulation (GDPR) and to promote cooperation among the European Union data protection authorities. The issue of controllership has been critical throughout the work of the Expedited Policy Development Process on the Temporary Specification for gTLD Registration Data (EPDP) and remains important for the implementation of a System for Standardized Access/Disclosure as recommended by the EPDP Phase 2 Team. In ICANN org's response to the public consultation, which closed today, it was noted that while the guidelines are a helpful step, ICANN org believes that further clarity would be beneficial in three areas: Precise attribution of "control" to particular stages in the processing under a micro-level analytic framework. Final Report of the ALS Mobilization Working Party

Please find attached the Final Report of the ALS Mobilization Working Party (ALS-Mob-WP). I will be happy to formally make a presentation to the ALAC and At-Large Community at Maureen's convenience, and I can also do presentations to any RALO that wishes. The report is the result of ten months of work by the WP. Everything in it was determined by consensus and the vast majority by unanimous consensus. The next step is a review by the ALAC and RALOs. Presumably the latter will be initiated by the ALAC Members from each region. Once the ALAC, with the support of the RALOs provides approval, the substance of the report will go to the ICANN Board for their agreement (or non-objection). Any Bylaw changes will be submitted to the Board and would be subject to the standard Bylaw amendment procedure as specified under Bylaws Article 25. In parallel with this report being submitted to the ALAC, the proposed Bylaw changes are being submitted to the Office of the General Counsel for their review and comments. Should the ALAC or Board require further modifications to the report, the WP will be reconvened. I will be happy to address and questions, comments or concerns. Alan
