Board comments on Recommendation 2 (Escalation timeframes and thresholds)

Hello All, The Board will support the community in making reasonable adjustments to the escalation timeframes to support the community's ability to take quick action to exercise its powers, while still having the time it needs to socialize the issues appropriately. Where the community believes that some of the tight timeframes might require adjustment by a matter of days, or have flexibility to simplify some of the steps when broad community support is clear, these are all areas that the Board can support adjusting. As the CCWG works to finalize a revised proposal on this, the Board notes that it would not support an extension of the initial petition phase beyond 30 days, and urges the timelines to be drafted with efficiency and quick action in mind. On thresholds, the Board supports the CCWG modification at Paragraph 62. On Board removal, the Board does not support the change at Paragraph 64. Demonstration of full community support for the exercise of this ultimate power is essential, and the Board does not support a change to lower this threshold. The other areas where this reduced threshold is proposed (blocking budget, fundamental Bylaws changes) do not raise this same concern. A proposed redline of Paragraph 64 to address this concern is: "The CCWG-Accountability also recommends that in a situation where use of the community powers of either blocking a budget or approving changes to Fundamental Bylaws, where only four Decisional SOs or ACs participate, and the threshold is set at four in support these two powers will still be validly exercised if three are in support and no more than one objects. The CCWG-Accountability came to this decision after considering the extended escalation process now proposed prior to the use of Community Powers, and to avoid the risk of powers being un-useable (especially the risk of making changes to ICANN's Fundamental Bylaws effectively impossible)." I was told that an additional CT person was being recruited when I met with several ICANN executives in October 2014. Hello All, The Board discussed recommendation 12 in the Board information call today, and offers the following response: First, the Board agrees that a transitional bylaw can be used to define the Board's commitment on WS2 matters. Second, the effort anticipated in WS2 should be performed through cross community working groups chartered by multiple groups across ICANN, effort and not all work must be done by the existing CCWG-Accountability. Third, the Board agrees that it will treat consensus based-recommendations on the limited list of WS2 topics (set out in the CCWG-Accountability's redline) just as it will consider the consensus-based WS1 recommendations from the CCWG-Accountability. Fourth, the Board does not support the inclusion of a timeline for the required completion of WS2 efforts in the transitional Bylaw. Finally, the Board supports that the costs of WS2 must be subject to the budgetary process for the year. If the budget is exhausted and additional resources are necessary, the chartering organizations must support a request for Board consideration on additional funding. improve working methods for drafting of reports issued in name of CCWG - ACCT

One issue that has been troubling me for some time is 'how are decisions made to accept some edits and reject others in the report?’ The recording of the call between the lawyers and the co-chairs <https://community.icann.org/x/15dlAw> indicated that staff is handling the edits and making the decisions about which edits to accept and which to reject. We need a better process for managing the editing of reports. Like the lawyers, Members who proposed important edits to the document were disappointed to find out (after the document was published) that many of these edits were rejected and we don’t know why. At some point, this report is no longer a report of the Members, especially given the vague “black box” process for staff to accept or reject Members’ edits to the draft. If staff can be allowed to continue to draft and decide which words go into the report, then we should at least be provided with a rationale from them to explain *why* Members’ edits are being rejected from our report. We need a much more transparent and responsive process for the drafting and publishing of reports that go out in our name. I am simply not comfortable with this vague secretive "black box" process that removes decisional authority from the Members. Please don’t give me another silly argument about the timeline. That is no excuse for the staff to over-rule Members on the content of the report. CCWG needs to improve this process before another report is issued in our name. Thanks, Robin
