Dear colleagues, Following the last call of the IOO DT (ICANN Ombuds Office drafting team) on October the 3dr, this is my report as rapporteur. Please if you are participant of the IOO DT and you have additional items, POV… Up to now we meet 9 times. We have a draft document (attached). My idea was to have this document ready for discussion during the Hyderabad meeting by participants of the ICANN meeting. It seems more realist today to try to have a document to be discuss by the ccwg-accountability WS2 plenary during our meeting November the 2nd 2016. Please add the IOO DT as one of the group willing to report and hopefully to have a document to be discuss during our F2F meeting in Hyderabad. Our last schedule call is on Monday October 24th. I am planing to send a « final » version of our draft by October 17th / 28th. One of the reason (appart for the difficulty to have a productive participation between meeting as many of the other groups) we need more time is that I/we discover during the presentation of ATRT2 Implementation Update that some overlap of ATRT2 recommendations with ccwg-accountability was to be taken on board by the IOO DT. Among various items one to be consider is the review of the Ombuds role. It was summarized by the ATR2 implementation team’s by: i) Review of the Office of the Ombudsman, ii) The role within ICANN, and iii) Whether the duties/scope of the Ombudsman should be expanded or changed in line with suggestions from the ATRT2. (1) An expert was expected to be retained and to perform a review of the Office of the Ombudsman by June 2015, with work expected to be completed by October 2015. Because of the unique nature of the Ombudsman role within ICANN, there were challenges in identifying a proper independent expert to undertake this review. (2) As ICANN was conducting a search for this review, work continued in the Cross Community Working Group on Enhancing ICANN Accountability on modifying the role of the Ombudsman. In addition to the changes to the Ombudsman role that are already reflected in the new ICANN Bylaws (particularly within the Reconsideration Process, where the Ombudsman has a new role), the CCWG-Accountability also noted that it will do a broader review of the Ombudsman role in its Work Stream 2 efforts that are under development now and anticipated to conclude mid-year in 2017. (3) The CCWG-Accountability’s Work Stream 2 efforts on the Ombudsman can be followed at https://community.icann.org/display/WEIA/Ombudsman <https://community.icann.org/display/WEIA/Ombudsman> . (4) ICANN committed to this work in the Bylaws as approved by the Board on 27 May 2016 (https://www.icann.org/en/system/files/files/adopted-bylaws-27may16-en.pdf <https://www.icann.org/en/system/files/files/adopted-bylaws-27may16-en.pdf> ). After multiple discussion, the IOO DT suggest to undertake the review with outside help as it was planed by the ATRT2 implementation. We therefore are asking for a budget to do so. As it was not in our plan when we discuss about the budget of the ccwg-account WS2 we may need to turn to the CFO as it may have been plan in the ATRT2 review? The outside expert will be able to review the IOO and to bring his/her expertise to the Drafting Team. We together with the currant ombudsman we are ready to provide possible name(s). IANA Transition update and next steps

Dear colleagues, The Iana contract has expired. ICANN's new bylaws, implementing our WS1 Recommendations, are now in place. This is a major milestone for the multistakeholder model, where communities are in charge, and where accountability is shared amongst all stakeholders. The events of the last few weeks have provided an excellent reminder, if we had ever needed some, of why this transition was required : we had all agreed that the Internet needs to be protected from partisan politics, post-truth rhetoric and interference from judiciary obstructions. In a way, we can thank those who have, almost to the point of risking exhaustion, tried everything they could to stop the transition. Their efforts have demonstrated the solidity of our principles. The transition is also the beginning of a new phase. It is now incumbent upon all of us to live up to the shared accountability model. Our work stream 2 efforts are under way, and we have to demonstrate that we can still deliver improvements to ICANN's accountability, as part of the continuous improvement journey. Let's celebrate, because this has been a tremendous group effort ! As of now, we are writing a new chapter of ICANN's history, let's make it a story of commitment, collaboration and respect for each other ! And what better way to start than to double down on implementing the post transition model we have agreed on, and delivering concrete proposals for WS2 ? But now our participants’ resources have been stretched - we have to get this done without it going on forever. We need to get this done right vs on time. · Julf Helsingius: I agree with Avri - better to get it right than to push something half-cooked through the process. · jorge cancio (GAC Switzerland): Avri is right. Internal participation is going down. We would need to make sure that the larger community is kept informed and nudged to participate - through specific consultations, focused meetings etc. - we need to be imaginative · Jordan Carter (.nz, ccNSO): I agree, but also think that we could take forever and work on this always - the challenge has to be to get the balance right - ccwg isn't meant to be eternal · Megan Richards: perhaps good for subgroups to identify short term, medium term and longer term actions, goals? · Sabine Meyer (GAC - Germany): I think that's already going on · Mathieu Weill: We have to find the right balance because the work of he CCWG cannot be eternal. A strong case for consideration to get funding to support subgroups request. Group polled to see level of support for request for outside consultant to do review of Ombudsman Office for the group. Per its Charter, the Project Cost Support Team (PCST) has supported the CCWG-Accountability in developing a draft budget and cost-control processes for the CCWG-Accountability activities for FY17, and has also developed a historical analysis of all the transition costs to date (see https://gnso.icann.org/mailing-lists/archives/council/pdfpklU5q6Ojg.pdf) 2. The CCWG-Accountability FY17 budget was presented at its plenary meeting of June 21st and approved for transmission to the Chartering Organizations for validation as per the process agreed with the PCST. This request for validation was received on 23 June. 3. Following review and discussion during ICANN56, the GNSO Council requested a webinar on this topic which was held on 23 August (see transcript at https://gnso.icann.org/en/meetings/transcript-ccwg- accountability-webinar-23aug16-en.pdf, recording at http://audio.icann.org/gnso/gnso-ccwg-accountability-webinar-23aug16-en.mp3 and AC recording at https://icann.adobeconnect.com/p8fu99qpt7d/) 4. The GNSO Council notes that many members of the GNSO community have expressed the view that the projected budget does not likely support revisiting the topic of the jurisdiction of ICANN’s organization in that such exploration would likely require substantial independent legal advice on alternative jurisdictions and their potential impact on the text and structure of ICANN’s Bylaws. 5. The GNSO Council has discussed and reviewed all the relevant materials. RESOLVED, 1. The GNSO Council hereby accepts the proposed CCWG-Accountability FY17 budget, as well as the cost-control processes presented in conjunction with the CCWG budget, expects the working groups to be restrained and judicious in their use of outside legal assistance, and believes that the Legal Committee should exercise reasonable and effective controls in evaluating requests for outside legal assistance and should approve them only when deemed essential to assist a working group to fully and objectively understand and develop a particular course of action for which the group has reached a substantial degree of consensus and requires legal advice on its risks and feasibility. 2. The GNSO Council expects to receive regular updates on actual expenditures as tracked against this adopted budget, and reserves the right to provide further input on the budget allocation in relation to the CCWG-Accountability related activities. 3. The GNSO Council expects ICANN staff, including its office of General Counsel, to provide the assistance requested by the CCWG and its working groups in an expeditious, comprehensive, and unbiased manner. 4. The GNSO Council expects the CCWG-Accountability and staff to work within the constraints of this approved budget, and that excess costs or requests for additional funding beyond said budget should be recommended by the Legal Committee only when deemed essential to completion of the CCWG’s work and objectives. . 5. It is the position of the GNSO Council that revisiting the jurisdiction or organization of the ICANN legal entity, as established by CCWG-Accountability Work Stream 1, would not likely be supported by this projected budget and, further, that such inquiry should not be undertaken at this time because the new accountability measures are all premised and dependent on California jurisdiction for their effective operation, and any near-term changes in organizational jurisdiction could be extremely destabilizing for ICANN and its community. 6. This means that the IANA Stewardship Transition can now proceed as planned and as such, the CWG has fulfilled its purpose. It has been a long and, at times, very challenging journey for the group. We co-chairs would like to sincerely thank you all and ICANN staff for the hard work and stamina you have shown. You will recall that we had an initial attempt at a model and when this failed to get adequate support from the community, the CWG went back to work and produced a revised model. We did this by modifying the way we worked and we divided the group into design teams in order to have dedicated, focused groups. However, throughout the process, we always returned to the CWG as a whole to evaluate and approve the work. For us as co-chairs it has been very challenging at times, but we have learned a huge amount from all of you and the process itself. This has been an excellent example of how the multi-stakeholder model can work in practice. Not the easiest way to work, but ultimately thorough, inclusive and holistic. In addition to the primary task of producing the IANA Stewardship Transition Proposal on behalf of the Names Community, we also believe that the work of this group has made a significant contribution to the effective working methods of Cross Community Working Groups. Most recently, there were several political and other issues which threatened to delay or derail the process but the crisis which that would have potentially represented has been averted in the end. This is a very good start for the Stewardship Transition and we believe that the CWG has been the best team to facilitate this work. Our work is now complete and we will have no more meetings. Therefore we will now proceed to dissolve the CWG by writing to the Chartering Organisations in order to communicate that our work is now complete. Thank you for your recent good words on our mailing list, but we think it is critically important to once more thank you and acknowledge the work of the whole group and ICANN staff. From: https://www.icann.org/news/blog/cheers-to-the-multistakeholder-community Blog post from Steve Crocker, Chair of ICANN Board Cheers to the Multistakeholder Community Two and a half years ago, the ICANN multistakeholder Community embarked on a journey to develop a globally agreed on plan to transition the U.S. Department of Commerce, National Telecommunications and Information Administration's (NTIA) stewardship of the IANA functions to the global Internet Community. The process signaled the historic final step in transitioning the coordination and management of the Internet's unique identifiers to the private-sector that began with the formation of ICANN in 1998. The process to develop the package of transition proposals embodied the spirit of the Internet itself - global, diverse and inclusive. People from different economic sectors, cultures, interests and backgrounds worked together to develop two consensus proposals that ensure the continued stable and secure operation of the IANA services and an enhanced accountability for ICANN. One of the proposals focused on ICANN's transparency and accountability. The other focused on arrangements with the three operational communities, the Regional Internet Registries for numbers, the Internet Engineering Task Force for protocol parameters, and the top-level domain registries for names. The proposal development process reflected the Community's dedication and commitment to achieving this historic final step. The community spent hundreds of hours in calls and meetings and exchanged tens of thousands of emails exploring and discussing complex governance issues, debating different views, and eventually finding consensus. This process tested and strengthened the trust in and across the ICANN community, and is a good demonstration of global multistakeholder policy development working. The resulting package of proposals has broad support because it reflects the Community's work, and preserves the existing multistakeholder system while laying the foundation for a more accountable and equitable balance within the ICANN ecosystem. Today, after months of preparation and implementation of the community's tasks, ICANN's contract with NTIA expired. As a result, the coordination and management of the Internet's unique identifiers is now privatized and in the hands of the volunteer-based multistakeholder community. The transition will help to ensure the continuation of a single, open Internet that users around the world can rely on for years to come. I am honored to be ICANN's Chairman of the Board during this historic process. The operational mechanisms and enhanced accountability frameworks outlined in the proposals are enshrined in ICANN's new Bylaws, which are now in effect. The ICANN Community, Board and organization will now move forward together as a more accountable and transparent body. These changes, while vitally important for the relationships and management of ICANN, will have no visible effect on the operation of the Internet. The very large ecosystem of Internet System Providers, content providers and users will continue to function without change. Thank you all again for your work throughout this process. I look forward to our ongoing collaboration on further accountability and transparency enhancements in Work Stream 2 of the Cross Community Working Group on Enhancing ICANN Accountability, and everything else yet to come.

This historic moment marks the transition of the coordination and management of the Internet’s unique identifiers to the private-sector, a process that has been committed to and underway since 1998. “This transition was envisioned 18 years ago, yet it was the tireless work of the global Internet community, which drafted the final proposal, that made this a reality,” said ICANN Board Chair Stephen D. Crocker. “This community validated the multistakeholder model of Internet governance. It has shown that a governance model defined by the inclusion of all voices, including business, academics, technical experts, civil society, governments and many others is the best way to assure that the Internet of tomorrow remains as free, open and accessible as the Internet of today.” Internet users will see no change or difference in their experience online as a result of the stewardship transition. In managing the coordination of the Internet’s unique identifiers, ICANN plays a small but significant role in the Internet’s ecosystem. For more than 15 years, ICANN has worked in concert with other technical bodies such as the Internet Engineering Task Force, the Regional Internet Registries, top-level domain registries and registrars, and many others. The final chapter of the privatization process began in 2014, when NTIA asked ICANN to convene the global multistakeholder community, which is made up of private-sector representatives, technical experts, academics, civil society, governments and individual Internet end users, to come together and formulate proposals to both replace NTIA’s historic stewardship role and enhance ICANN’s accountability mechanisms. The proposals reinforce ICANN’s existing multistakeholder model and are also aimed at enhancingICANN’s accountability. The improvements include empowering the global Internet community to have direct recourse if they disagree with decisions made by ICANN the organization or the Board.
