Urgent | Message to GNSO Council re: ALAC Position on IGO/INGO Identifiers Protection

Dear ALAC colleagues, At the CPWG call of 24 Sep, it was established that the ALAC/At-Large are supportive of the position that, very simply put, IGO/INGO Identifiers should be protected for the relevant IGO/INGO to apply if and when they choose to, and that this ability to apply should be preserved under all circumstances and certainly, not displaced by a third party's attempt to obtain a confusingly similar string. There is now an Option 3 being put before GNSO Council, and I plan to speak to this very briefly at today's CPWG call. The ALAC's position on the protection of IGO/INGO Identifiers

Dear Councilors, As mentioned on the call just ended, I have instructions from the ALAC to forward to Council, its position on the issue of protection of IGO/INGO Identifiers. The full version is attached by way of letter, and the shorter version is as follows. The At-Large Advisory Committee (ALAC) wishes to convey its position on this issue of protection of IGO/INGO Identifiers. After having considered the available information, the ALAC stands with the position expressed by the ICANN Board, the IGO/INGO Group spokesperson Brian Beckham and several SubPro IRT members in favouring Option 2 of including the IGO/INGO Identifiers in String Similarity Review. In supporting Option 2, the ALAC places predominance on the following: 1. Firstly, the ALAC recognizes and supports the role of the String Similarity Review (SSR) in helping to mitigate unacceptable risk of end-user confusion and loss of confidence in the DNS due to visually confusingly similar strings being delegated into the Root Zone. This goal should neither be taken lightly nor undermined. Given the status and functions of those IGOs/INGOs in globally advocating for issues and people outside of government, allowing a third party applicant to potentially secure a string that is confusingly similar to a protected IGO/INGO Identifier would not serve the public interest, as it is conceivable that this could lead to bad actors exploiting end-user confusion vulnerabilities to perpetrate harm “in the name of an IGO/INGO”. 2. The ALAC views the inclusion of IGO/INGO Identifiers in SSR, per Option 2, not as an ‘expansion of rights beyond those exact matches of those IGO/INGO Identifiers’ but as the appropriate mechanism to preserve the ability for an IGO/INGO to apply for its relevant identifier if and when it chooses to, as was intended by the relevant policy recommendations from the IGO-INGO PDP. It is inconceivable to the ALAC that policy which exists to protect those IGO/INGO Identifiers for application by their respective IGO/INGO could then be displaced by an unreasonably strict interpretation of policy recommendation text or absence of specific policy recommendation text said to be required to allow implementation by way of Option 2. No policy recommendation exists to suggest that the ability for an IGO/INGO to apply for its protected IGO/INGO Identifier would be encumbered or blocked by a confusingly similar string; or that an IGO/INGO must promptly apply for its IGO/INGO Identifier in order to avoid being blocked by a confusingly similar string/TLD in the next round or future application opportunities. Therefore, *the ALAC urges the GNSO Council to place public interest considerations towards the mitigation of risk of end-user confusion and loss of confidence in the DNS above the call for the strict interpretation of policy recommendation text expressed in Option 1.* *The ALAC would also be supportive of the Third Resolved Clause Option wherein the GNSO Council agrees to instruct the SubPro IRT to refer the issue to the ICANN Board for a decision.* ***** And I would like to reiterate that we should also consider the input from Brian Beckham on behalf of the IGO/INGO group, and whose Identifiers are the very subject of this issue. Dear Pari, Since you are asking us to express our opinion about the nomination for the ALT members, I would like to make the following remarks: · I fully agree with those who asked to read carefully the RoP · As per the RoP o The ALT members’ selection is an ALAC internal task, and the RALOs have no role in it o The Chair is selected prior the selection of the other 4 ALT members o The Chair is selected for 2 consecutive terms, not the Vice Chairs o Jonathan has been selected last year and will continue for 2026 o So, this year, the positions to be filled are 4 (2 co-chairs and 2 others) o As per art. 17.3.6, the selection of the ALT Members (excluding the Chair) shall be carried out using the STANDARD ALAC PROCESS OF CONSENSUS if possible, and barring that, by secret ballot. o the STANDARD ALAC PROCESS OF CONSENSUS consists of opening the nomination period (here for at least 7 days) for all ALAC members (self-nomination is accepted) o Oprning the nomination period, the Chair will for sure influence the result if he/she starts by nominating persons; it will be more a call for consensus which is not what is in the RoP (STANDARD ALAC PROCESS OF CONSENSUS) o This is not the only place where the result of selecting people is influenced because the call for volunteers is replaced by a call for consensus about the Chair selection which is against the bottomup decision making model that we are supposed to always follow except in very rare urgent cases o As for the ALT members selection, I do agree with ALAN that the team should be harmonous without big divergence for efficiency. Thus, I propose that the RoP be reviewed in a fashion that “the Chair proposes 4 names for the ALAC approval” in stead of “the selection shall be carried out using the standard ALAC process of Consensus” o But since the RoP is what it is, I think we are breaching our RoP. Dear ALAC, I would like to issue a call for nominations for the members of the ALAC Leadership Team (ALT) for the period of 2025 AGM-2026 AGM, which will be my final year as ALAC Chair. The terms of the 2025-2026 ALT will begin at the end of the 2025 Annual General Meeting (AGM) until the end of the 2026 AGM. As the ALAC Chair, I will automatically take the North American ALT slot. This call is to appoint the ALT slots for the four remaining regions. Dear colleagues, I would like to thank those who nominated me for the ALAC Leadership Team. I value this gesture as a recognition of the work I have been doing within ALAC and which I will continue to carry out with the same dedication until the end of my term. I also want to thank Pari for opening the conversation on our Rules of Procedure. The comments shared in this exchange highlight, on the one hand, the importance of ensuring that our processes are perceived as open and transparent, and on the other, that the Rules of Procedure support the path we are following. I believe that keeping both perspectives in mind enriches us as a community, as it helps us strengthen political confidence in our work while maintaining the normative clarity that guides us. With regard to the nomination for our region, I believe that Claire Craig is the right person at this time. Her continuity can provide stability to the work already underway and contribute to an orderly transition in a year that will be crucial for ALAC. Dear Pari, Since you are asking us to express our opinion about the nomination for the ALT members, I would like to make the following remarks: · I fully agree with those who asked to read carefully the RoP · As per the RoP o The ALT members’ selection is an ALAC internal task, and the RALOs have no role in it o The Chair is selected prior the selection of the other 4 ALT members o The Chair is selected for 2 consecutive terms, not the Vice Chairs o Jonathan has been selected last year and will continue for 2026 o So, this year, the positions to be filled are 4 (2 co-chairs and 2 others) o As per art. 17.3.6, the selection of the ALT Members (excluding the Chair) shall be carried out using the STANDARD ALAC PROCESS OF CONSENSUS if possible, and barring that, by secret ballot. o the STANDARD ALAC PROCESS OF CONSENSUS consists of opening the nomination period (here for at least 7 days) for all ALAC members (self-nomination is accepted) o Oprning the nomination period, the Chair will for sure influence the result if he/she starts by nominating persons; it will be more a call for consensus which is not what is in the RoP (STANDARD ALAC PROCESS OF CONSENSUS) o This is not the only place where the result of selecting people is influenced because the call for volunteers is replaced by a call for consensus about the Chair selection which is against the bottomup decision making model that we are supposed to always follow except in very rare urgent cases o As for the ALT members selection, I do agree with ALAN that the team should be harmonous without big divergence for efficiency.
