Fadi Chehadé today officially assumed the position of President and Chief Executive Officer of the Internet Corporation for Assigned Names and Numbers (ICANN). He assumed his position two weeks ahead of his planned start date. Chehadé's appointment as CEO had been announced on 22 June, though he was not expected to assume his role until 1 October. Chief Operating Officer (COO) Akram Atallah had been serving as the interim CEO and will now reassume his role as COO. Today Chehadé thanked Atallah for assuming the top spot during the summer and then, during a staff meeting, he explained his plans for the future. "I have spent the past two months asking myself and many others from all over the Internet community worldwide the same questions," said Chehadé. "How can ICANN work better with its stakeholders to bring all interested parties to the table to debate and agree how to improve the DNS? How can we ensure that all global citizens can share an open Internet which is sustainable and resilient?" Chehade's strategy puts ICANN's stakeholders at its heart. The organization's staff will be brought together in collaborative teams organized in a global matrix that distributes key functions and leaders across the world to accelerate effective engagement. Chehadé's leadership team combines deep ICANN experience with fresh perspectives from international executives. Among the changes he announced today: * Akram Atallah's role will be expanded to include oversight of Registry and Registrar Services, the new generic Top-Level Domain (gTLD) program, Security and other important activities. * Tarek Kamel, Senior Advisor to the President of ICANN, who currently leads the development of an Africa strategy, will assume the role of Senior Advisor for Government Affairs, leading all aspects of Government Engagement. * Sally Costerton, most recently CEO of Hill & Knowlton Public Relations for Europe, the Middle East and Asia has been tapped to lead the new position of Stakeholder Engagement, a role that will incorporate the communications function. Both Costerton and Kamel will be based in ICANN's European region and will report directly to the CEO. Their goal is to strengthen ICANN's international engagement at all levels, and to implement the global matrix alongside ICANN's regional vice presidents. Chehadé said his other direct reports would include: * Kurt Pritz, Senior Vice President, who will take on a new role as Chief of Strategy. * John Jeffrey, General Counsel and Secretary of the ICANN Board, who will continue in that role. * David Olive, Vice President of Policy, who will also continue in his current role. In a further organizational development, Chehadé announced that Maguy Serad, Senior Director of Contractual Compliance will be promoted to Vice President of Contractual Compliance, with her department reporting directly to the CEO. "I've spent the summer putting the right team in place looking deep within ICANN and beyond to find the best mix of talents to help me to fulfill ICANN's mission," said Chehadé. "Frankly I am impressed and humbled by what these diverse leaders bring to the table. I've been fortunate to have great support from the ICANN Board as well as the staff and I know that we will be able to build upon the organization's many achievements." Follow-up: ALAC Voting Delegates to the NomCom for 2013

Dear all, as you all know, we have been faced with an unprecedented situation in the recent vote to select voting delegates to the NomCom for 2013. Our Bylaws incorporate rules for the Candidate Elections. These rules are valid for the election of all ALAC officers, including delegates to the NomCom. Rule 10.4 specifies that "Instant-runoff" voting is to be used as the voting system to determine the winner. http://en.wikipedia.org/wiki/Instant-runoff_voting Rule 10.5 specifies that voters rank *all* candidates in order of preference. This means that the type of instant-runoff voting required is "full preference" voting. It does not allow for the selection of only one candidate. Unfortunately, the Bigpulse system was programmed to allow for the selection of only one candidate, and some voters did so. As a result, the vote broke rule 10.5 and is therefore null and void. Because we need to select someone as quickly as possible, I have instructed staff to start a new vote which will closely follow our Bylaws. As a result, the vote will ask for *all* candidates to be placed in order, and the BigPulse system will be programmed to refuse partial votes. You will also note that there is no "none of the above" option since this is not mandated in our bylaws. So the only options ALAC members will have to vote will be: Candidate A - 1 Candidate B - 2 or Candidate A - 2 Candidate B - 1 or Abstain - 1 I know that there are other possible choices that could be possible with "partial preference instant-runoff voting" but our Bylaws do NOT allow it. If you have any questions, I would be happy to reply to them. One lesson learnt is that we need to make sure our re-write of the ALAC Rules of Procedures is quite clear about how votes are to be counted and what type of voting system is used. Dear All, I have read the explanation of the 2012 Nomcom vote results and I realise this unique situation has never happened before. Rule 10 of our ALAC RoP (https://community.icann.org/display/atlarge/Rules+of+Procedure) covers the election of ALAC officers which is done by Instant Runoff Voting which was how the Nomcom vote was being conducted (allbeit with only 2 candidates). Here are the key sections from Rule 10 ( https://community.icann.org/x/rLbbAQ ): 10.4 Instant-runoff voting (IRV) will be used as the voting system to determine the winner. (ref - Wikipedia - http://en.wikipedia.org/wiki/Instant-runoff_voting ) 10.5 Voters rank ALL candidates in order of preference. 10.6 If no candidate receives an overall majority of first preferences the candidates with fewest votes are eliminated one by one, and their votes transferred according to their second and third preferences (and so on), until one candidate achieves a majority. 10.10 If two or more candidates receive the same, highest number of preferences, a runoff election is to be conducted. 10.10.1 The Chair will select a new date and time for the runoff election, at least 7 (seven) days after the previous vote has concluded. in this vote, only the candidates that received the same, highest number of preferences will be eligible. The Chair will then immediately send a new “election summary” message according to rule 9.4, and the procedure will then restart from rule 9.5 As per Rule 10.6 and the Wikipedia reference to preference voting ( http://en.wikipedia.org/wiki/Instant-runoff_voting#Process) preferential voting works when there are 3 or more candidates. With two candidates, both having equal number of first preference votes, there is no candidate with the fewest first preference votes to eliminate and to distribute their votes according to their 2nd preference as per Rule 10.6 Unfortunately, the online system allowed ALAC members to select one preference in contravention of Rule 10.5 which states that ALL candidates must be ranked. Had ALAC members fulfilled their obligations by ranking all candidates and indicating their second preference, then the results would also be the same as the first preference as there were only two candidates. Thus, as per rule 10.10, since two or more candidates have receive the same, highest number of preferences, the ALAC should conduct a runoff election. Sala, these are sage words, but sadly not applicable to our position on Rec 8 (which is the one using the word "perhaps"). Although I would far prefer to offer unequivocal advice that the Board could act on its own, it is not at all clear. This recommendation talks about contract content and possible additional reporting. Some aspects of contracts with registrars and registries are decided by bilateral negotiations with ICANN (sanctions in my mind fall in this category), but requiring additional Whois-related reporting might well fall under Consensus policy. Without a thorough analysis from compliance, we really don't know what is missing at this point (we certainly know part of what is missing, but whether that is the whole story I don't feel competent to judge. However, on re-reading our statement, I find that it is less than clear. Or gramatically correct. I suggest replacing it with: >Perhaps, but not obvious. Analysis of AoC Whois Report Recommendations

Olivier, attached is a re-worked version of the Whois report recommendations. I have made some adjustments based on ALAC feedback - specifically that the statements be made clearer regarding whether GNSO action is required prior to the Board initiating action. I have also added a short preamble making the overall assessment clear - of the 16 recommendations, 12 do not require GNSO action, 3 may at a later stage, and only one requires new policy before the Board can take substantive action. Note that the Board workshop begins on Wednesday, so presuming that this document is satisfactory, it should be transmitted to the Board today. Alan
