Regional Advise on the Foundation for Building Sustainable Communities

Dear all, The Staff asked for regional advise from the North American RALO on the ALS application from the Foundation for Building Sustainable Communities (FBSC). It was decided during the monthly NARALO teleconference on August 11th that the regional advise would be to approve the application if no dissent was sent to the list within seven days after conclusion of the meeting. Not having seen any negative comments on the NA-discuss list until August 18th, it is the Staff¹s understanding that the region intends the approval of the application. Statement on Stakeholder Group Openness

At its August 28th meeting, the Board approved a number of aspects of GNSO restructuring. Included in its resolution was the following: "The Board requests that existing constituencies confirm their status with the Board during the intervening time period, and requires constituencies to formally confirm their status every 3 years to ensure that they continue to meet the requirements of Article X, Section 5, subsection 3 of the ICANN Bylaws. This will be an opportunity for existing constituencies to demonstrate compliance with the principles of representativeness, openness, transparency and fairness set forth in the ICANN Bylaws." This reaffirms and in fact strengthens the Board's oversight of GNSO Constituencies and is in line with a request we made to the Board through our Liaison. However, it is troubling that the statements are solely in reference to principles of representativeness, openness, transparency and fairness of Constituencies, and not of Stakeholder Groups once they are defined in the Bylaws. I volunteered to draft a statement to the Board commenting on this and I propose the following statement to be sent to the Board at least one week prior to their meeting of September 30. If I may note the conversation that I had with Cheryl, and also with the Staff in relation to this request. It has become the practice for the At-Large community to have at least a week, and often two weeks, to comment on a draft statement. I have let my colleagues know that asking a global community to respond using a bottom-up process to develop their view cannot really happen in less than several weeks. Where the issue at hand was of particular importance, or on an issue where there was likely to be differences of view, it takes longer than on other subjects. What I did suggest was that a preliminary response could be developed, subject to community review, for those instances where there was limited time in which a response could be developed. What I would hope is that the ALAC would not return to developing statements amongst itself and only allowing a handful of days for the ALS community to respond. So many of you have said that it is essential for the grassroots of the At-Large community to become more engaged in policy. May I submit that this goal is not awfully compatible with very short timelines for that same community to be consulted on an issue, especially one of this significance. Hello all, For any of you going to Geneva next week for the IGF prep meeting, or if you live in Geneva or near to Geneva, can I cordially invite you to a special ICANN meeting on the Monday 15 September. The meeting is part of a series of regional consultative meetings we are running as part of the "Improving Institutional Confidence" consultation. What is that? It is a number of proposals developed by the President's Strategy Committee to address comments made in the recent Midterm Review of the Joint Project Agreement (http://www.ntia.doc.gov/ntiahome/domainname/jpamidtermreview.html) There are three IIC documents, outlined at the Paris meeting in June and which have already been through one public comment period. A second comment period on revised documents is due to start very soon. Proposals in NARALO Related to the Registrant

Dear Community members: There has been considerable activity in recent weeks on various community lists (as well as in online news forums) relating to domain registration, accreditation of registrars, proposed initiatives intended to create better safety nets for registrants and related issues. At the same time, the ICANN community as a whole is engaged in a consultative process related to the key agreement (the Registrar Accreditiation Agreement (³RAA²) that governs many aspects of domain registration and the rights and responsibilities of registrants and registrars, as well as ICANN since it is one of the two contracting parties to the agreement. As you all know, many of these these issues are complex. At the same time, several proposals and issues raised, especially in the NARALO of late, seem to me to have elements which are interrelated (especially as regards the fundamental objective they seek to produce). What I would like to propose is that a couple of briefings be arranged to help further the understanding of these and related issues in the community. I would propose two sessions, of an hour to 90 minutes each, as per usual with simultaneous interpretation: 1. The Registrant/Registrar Relationship * What safeguards are available to registrants? * How are they implemented? * What compliance activities could, or already do, help ensure their implementation? * What proposals are being discussed to increase the protection available to registrants? 2. The RAA and the Internet User * Does the RAA impact the non-registrant user of the internet? * If so, how does it impact them, and are there different impacts for different types of users? * What if any changes being discussed would (or could) affect the non-registrant end-user, and how? It seems to me that these two sessions would likely help everyone have a much increased understanding of the issues and lead to a very productive debate. For what it is worth, it would seem to me that providing an opportunity for community members to learn more about these issues would not be a disadvantage. Of course, if everyone feels they are sufficiently well-informed then it the briefings would be unnecessary. With respect to the information below being of use to the briefings, it normally requires about 2-3 weeks advance notice to arrange a briefing, to allow those presenting time to prepare and also to give the community enough advance warning to incorporate the briefings into their schedules. It would seem to be likely that the consultation summary etc would therefore already be posted before the briefings would take place.
