Dear Community and Working Group Members: You may wish to consider responding to the below in connection with your work on the Improving Institutional Confidence process at the Summit and since then. --- "Improving Institutional Confidence: The Way Forward" (http://www.icann.org/en/jpa/iic/iic-the-way-forward-31may09-en.pdf) [PDF, 112K], is published today for community review and follows from the work of the President's Strategy Committee (PSC). It is a staff evaluation of possible implementation steps from the PSC proposals. This preliminary evaluation is being published on 1 June 2009 at the same time it is submitted to the Board to allow the global Internet community to consider and reflect on these documents, and to facilitate discussions during ICANN's next public meeting in Sydney, 21-26 June 2009. The Board has not yet considered these proposals nor do these proposals represent the views of the Board. Further future steps emanating from Board consideration may also involve formal public consultation. The staff evaluation recommends the following board action and approvals: * Possible changes to ICANN's bylaws to establish a new and newly constituted Independent Review Tribunal with powers to review the exercise of decision-making powers of the ICANN Board under three general rubrics of fairness, fidelity and rationality. * Continue conversations with authorities in jurisdictions such as Belgium and Switzerland, but report back with a detailed analysis of risks and benefits to the Board and community of any additional of legal presence to inform future consultations with the community. * Accepting the PSC recommendation that ICANN maintain its headquarters in the United States, specifically in Marina del Rey, California. * Consider means to work with ICANN's Governmental Advisory Committee (GAC) and the ICANN community on a fully consultative process to publicly review the GAC's role within ICANN. This review process might focus on coordination and consultation between the GAC and other supporting organizations and advisory committees of ICANN. The report includes three further appendices: * Appendix A, "Improving Institutional Confidence: Implementation Report” - summary of the President's Strategy Committee recommendations presented at the Mexico City meeting in March 2009, the community feedback received to those recommendations, and the staff implementation recommendations for each. * Appendix B, Proposal to Establish a Special ICANN Community Vote Requesting a Board Re-Examination of a Board Decision * Appendix C, Proposal to Establish an Independent Review Tribunal Background: At its meeting on 6 March 2009, the Board thanked the PSC for its work and undertook to review the report. The Board posted the report for 60 days' public comment, and directed staff to evaluate implementation of the proposals and report its findings to the Board. Dear All, As per Cheryl's request, we have set up an online vote on the three ALS Applications ready for accreditation by the ALAC and the Supplementary Statement to the public consultation on the Report on Improving Institutional Confidence Plan, released by the President's Strategy Committee (PSC). The Supplementary Statement was sent to the ALAC internal list on May 11th by Sebastien Bachollet, Chair of the Working Group on the Future Structure and Governance of ICANN. Plan for Enhanced Internet Security, Stability and Resiliency Opened for Public Comment 21 May 2009 ICANN has developed a plan to enhance the security, stability and resiliency of the Internet's naming and addressing systems as called for in its Strategic Plan and in accordance within its bylaws. The plan notes how the Internet has thrived by engaging many stakeholders who collaborate to foster communication, creativity and commerce in a global commons. The interoperability of the global commons depends on the operation and coordination of the Internet's unique identifier systems. ICANN and the operators of these systems acknowledge that maintaining and enhancing the security, stability and resiliency of these systems is a core element of their collaborative relationship. The plan notes the growing risks to the security, stability and resiliency of the unique identifier systems and the need to collaboratively address these risks. The plan delineates ICANN's specific programs that will address security, stability and resiliency. It also details planned activities that will enhance its contributions through the next operational year. This first version of the plan is intended as a foundation for ICANN and its community to establish a framework for organizing its security, stability and resiliency efforts. The plan does not envision major new roles or programs for ICANN in this area. The programs and initiatives in which ICANN plans to engage during the 2009-2010 operating year include: Improving root zone management through automation; improve authentication of communications with TLD managers and support implementation of DNS Security Extensions (DNSSec) Ensure the maturation of the gTLD registry continuity plan and test the data escrow system Build on the collaborative efforts of the Internet security community efforts to effectively respond to malicious abuses of the Domain Name System (DNS). Improvements to the At-Large Policy Advice Development Schedule The first menu item on the left - "At-Large Policy Advice Development Schedule" - has been improved. It is now a one-stop-shop to find out: * If a draft statement is moving through the approval process in the community, what is it, the various deadline dates assigned to it and when the statement will be approved; * If community members are At-Large focal points in working group or other processes in other parts of the ICANN community, who they are and what they are involved in can easily be seen; * What working groups are active in At-Large, where to find each working group homepage, and who the staff focal point is. This is a dynamic document which we update whenever needed - if you see something missing, please send us a note at staff(a)atlarge.icann.org. We recommend you bookmark it or set it as an RSS feed. A new Opinions block on the homepage A few weeks ago, we advised the community that it was possible for RSS-enabled blogs and news sources to be aggregated and asked members of the community to submit their blogs, or other resources they thought relevant, so we could link them to this feature. We haven't had too many responses yet, but there is now a block on the front page labelled 'Opinions' where you can see the information sources that we have so far. We encourage you to send more sources. Of course, all information and opinions presented are those of the authors, and not of ICANN. Updates to the 'Current Issues' section One of the horizontal menu options ("Current Issues") has new information available. It is now the place to find: * Links to the working groups in At-Large; * Easy access to multilingual Policy Issue Briefs - brief narrative descriptions in an easy-to-read format that introduces the reader to topical subjects; * At-Large Issue Briefs - this new feature is where you'll find issue descriptions of issues developed by the At-Large community itself. * Informational Briefs produced for the At-Large Summit. * Recordings of Audio Briefings - the At-Large staff regularly arranges hour-long briefings on topical issues, designed to help facilitate a common level of understanding on issues that arise in the ICANN community. You'll find the recordings of each here. * A link to subscribe to the monthly Policy Update - available in six languages, this is a monthly summary of activities across the ICANN policy communities. You can receive it in the language of your choice by subscription from the link in the Policy Issue Briefs section. We hope that all these are helpful to all of you. Board action on GNSO Restructuring

Dear Community Members: At today's Board meeting, Directors considered the status of Stakeholder Group (SG) formation and acknowledged that the GNSO community has made an effort to comply with the Board's timetable for GNSO restructuring (i.e. seating a new Council in Sydney), that the Board has received proposed SG charters for review, and that the restructuring schedule has slipped past Sydney. The Board approved a resolution that: noted that the proposed SG charters require revisions to ensure equitable participation and representation by new constituencies; directed the Board's Structural Improvements Committee (SIC) and ICANN Staff to propose changes to the SG charters to make them consistent with the Board’s stated objectives; and directed the SIC to post the revised charters, and an explanatory memorandum, for GNSO consultation and public comment. The resolution will be posted by the Board Secretariat shortly at < http://www.icann.org/en/minutes/>, but I wanted to alert you to this development ASAP. ALAC Statement on Future Structure and Governance of ICANN

Dear Maria, We have been requested by the Chair of the At-Large Advisory Committee, Cheryl Langdon-Orr, and the Chair of the At-Large Working Group on the Future Structure and Governance of ICANN and Vice Chair of the ALAC, Sébastien Bachollet, to transmit the input for the public consultation on the Report on Improving Institutional Confidence Plan on behalf of the ALAC. This statement is the result of a process begun when representatives of eighty-eight (88) At-Large Structures ("ALSes") from five Regional At-Large Organizations ("RALOs") representing ICANN's global At-Large community met in the At-Large Summit (ATLAS) as a part of the 34th International ICANN meeting in Mexico City. Amongst the various activities of the Summit were five working groups on issues of concern to the At-Large community. One of the five was devoted to the Future Structure and Governance of ICANN. The final statements of all five working groups was compiled into the Declaration of the At-Large Summit (see: http://www.atlarge.icann.org/files/atlarge/correspondence-05mar09-en.pdf) , presented to the Board of ICANN at the Public Board Meeting in Mexico City. In order to ensure that the entire At-Large community had the opportunity to review the five statements, and for their perspectives to be taken into account, the ALAC resolved upon a process of consultation and amendment for the statements by resolution at its 24th March 2009 teleconference (see: http://tinyurl.com/q5dodv) As a result, the Summit Working Group statement was opened for public comments by the At-Large community on 1st April, closing on 25th April. The Chair of the ALAC then requested the Staff to open a vote on the document opening on 3rd May and closing on 10th May. The results were announced on 11th May by the Staff, said result being that the Statement was endorsed by a vote of 15-0-0. ALAC Statement on the Draft IRTP Report

We have been requested by the Chair of the At-Large Advisory Committee to transmit the input for the public consultation on the Draft IRTP Report on behalf of the ALAC. The attached statement was originally drafted by ALAC Member Patrick Vande Walle, as agreed during the April 26th 2009 meeting of the At-Large Advisory Committee. It was then published for review by the ALAC and the Regional Secretariats on 2nd May 2009. The original version statement may be viewed under: http://tinyurl.com/qlupnj. Due to the timelines built into the IRT process itself, it was understood that the statement would not be able to undergo the full, At-Large community-wide consultation as doing so would prevent the comments of the ALAC from being taken into account by the IRT as it completes work on its report. Members of ALAC proposed some amendments (a comparison between the original statement and the final version may be viewed under: http://tinyurl.com/pxem8b) The Chair of ALAC requested the Staff to begin a vote on the draft Statement for a five day period, which began on 7th May 2009 and closed on 12th May 2009. The results were announced on 13th May by the Staff, said result being that the Statement was endorsed by a vote of 10-0-1. ALAC Statement on FY 10 Budget and Ops Plan Framework

Dear Kevin, We have been requested by the Chair of the At-Large Advisory Committee to transmit the input for the public consultation on the Proposed Framework for ICANN's FY10 Operating Plan and Budget on behalf of the ALAC. The attached Statement was originally drafted by ALAC Member Gareth Shearman, as agreed during the April 28th 2009 meeting of the At-Large Advisory Committee and following a presentation on the Proposed Framework for ICANN's FY10 Operating Plan and Budget given by ICANN Chief Financial Officer Kevin Wilson to the At-Large community. It was then published for review by the ALAC 5th May 2009. The original version was posted to the At-Large Advisory Committee internal list on 30th April 2009 and may be reviewed under: https://st.icann.org/alac-docs/index.cgi?al_alac_st_0509_1. Due to the timelines built into the Budget Development process, it was understood that the statement would not be able to undergo the full, At-Large community-wide consultation as doing so would prevent the comments of the ALAC from being taken into account by ICANN¹s Finance Department as it completes work on its Draft Budget and Operational Plan for Financial Year 09/10. The Chair of the ALAC then requested the Staff to open a vote on the document, said vote opening on 7th May and closing on 12th May.
