Dear all, As it may have relevance to members of the BC, I thought I should make you aware of a blog post I made on CircleID regarding the long delays and long timelines that lay ahead vis-à-vis new gTLDs [ http://www.circleid.com/posts/and_then_there_was_the_issue_of_time/ ]. The October 12th BC meeting in Washington, particularly the session on brands as gTLDs that Fred Felman chaired, was extremely valuable in fleshing out the complexities around brands as TLDs and got me to thinking more about how ICANN best handle this important aspect. I recommend that members go back and read the transcripts or listen to the MP3 to learn more if they didnt participate remotely. It got me to thinking more about what still needs to be done and how we should address that. In my post, I suggest putting all brands on a separate path towards gTLDs until such time as the issues around SRSU and the like have been properly considered and appropriate recommendations are put in place. I believe that this would address a number of concerns from different groups and build institutional confidence in ICANN. Kind regards, RA Ronald N. ACDR is located in Amman, Jordan; The comment period closes on October 28th. The BC opposes approval of this application at this time on the grounds that no new UDRP providers should be accredited until ICANN implements a standard contract with all accredited providers or finds some other mechanism for establishing uniform rules and procedures and flexible means of delineating and enforcing arbitration provider responsibilities. It makes no sense to require that domains be registered or renewed via ICANN-accredited registrars who are under a standard contract (the RAA) but then provide that registrants can have domains transferred away through a process administered by an organization that has been granted this power by ICANN -- yet is under no contract that defines its practices and procedures, is not subject to any regular or standardized review by ICANN, and for which ICANN's only disciplinary tool is accreditation revocation (so extreme a sanction that it is unlikely to ever be used). The Business Constituency suggests that ICANN implement a contractual relationship that defines and constrains this grant of power, and provides flexible and effective enforcement mechanisms, because that delegated power can extinguish substantial monetary investment and goodwill in a domain. Granting this kind of power absent any restraints is not an accountable practice. We appear to be transitioning from a DNS that featured an effective duopoly of UDRP providers (WIPO and NAF) and in which all significant gTLDs were based in the developed world -- to one in which the majority of gTLDs and UDRP providers may well be headquartered in nontraditional jurisdictions. Business interests may well be investing substantial amounts in these new gTLDs, for both defensive and new branding purposes. In this type of environment it is even more important that a proliferating cast of UDRP providers be subject to uniform and enforceable responsibilities, as that is the only means of furthering the goal that UDRP decisions are consistent within and among UDRP providers, and that the UDRP remains an expedited and lower cost means of addressing cybersquatting. In closing, we note that this issue of whether UDRP providers should be under standard contract with ICANN is almost entirely separable from the question of whether the UDRP evaluation standards for determining the existence of cybersquatting should be reformed. There is no need to debate the substantive elements of the UDRP in order to address the fundamental issue of whether UDRP providers should be under standardized contract. Yesterday's meetings were a combination of CSG working session; informational roundtables with special guests, including ICANN, and a BC members policy forum/meeting. The purpose of this email is to provide a brief and very high level update from yesterday's meeting on a few of those items. A more detailed "next steps" summary is under development by the officers and others who took work item assignments and should be sent out by Monday. You should also expect to receive the PPs from the speakers as they are gathered. It will be a busy time between now and Cartegena. We will try to manage the email notices to you by having clear subject headings, so that you know whether an email requires action, or is for information/action, or is informational only. This email is informational. To recap: CSG Charter drafting will continue and draft will be circulated. A vote by members on a final draft will be scheduled for November, to meet a Board deadline. Sarah Deutsch is the lead as our CSG rep. A small drafting group supports her from BC: Marilyn Cade, Ron Andruff and Philip Sheppard. Other members are from the other two CSG constituencies. During the call, members did discuss other ways to improve communications [discussion of a more formalized 'newsletter style approach] and move to a more frequent members calls. Steve Delbianco, our V.Chair, Policy Coordination, will be advising on a priorty topical approach for the policy topics for monthly members calls. We also discussed launching a few 'working group' approaches on key issues, where the BC can provide strategic leadership. Stay tuned for more news on that front. We discussed a newsletter approach, and other changes in communications support tools; heard an update on finances, and membership; discussed other administrative functions updates, including announcing the Finance Committee members: Jon Nevett and Anders Halverson, and heard a report on options to manage the banking account and administrative support. Outcomes will be summarized in thee follow up report. Other actions that need your involvement will be announced shortly, including opening our elections for Councilor - 2 year term and V.Chair, Operations and Finance -- completion of term for this year. We will have separate working sessions on Charter development. The present small group of volunteers for working further on the BC Charter are Marilyn Cade, Chris Chaplow, Steve DelBianco, Sarah Deutsch, Philip Sheppard, Ron Andruff, and Mikey O'Connor. As we have worked with the Charter, we have identified some gaps that need addressing, along with changes coming from GNSO Improvements recommendations. A staff developed topical outline was presented on our call and we will continue to utilize staff support and consultation to advance further drafting/discussions re both the CSG charter and BC Charter. BC Members: in order to ensure that we are complying with all responsibility to post public notices of our activities,I am posting a notice to the BC archived list: Please also consider this a reminder of the deadlines for nominations, consultations and when ballots will be distributed. Marilyn CadeBC Chair On Oct. 17, the BC opened an election process for two positions via an internal announcement to all BC members:1) GNSO Councilor: term annual meeting 2010 to annual meeting 2012. 2) Vice Chair, Finance and Operations - 3 month term completing 2010 term which ends in January 2011 The process for the election was described in a notice provided to all BC members, including time frames.Due to questions, the BC ExComm undertook an examination of eligibility for standing for Councilor and the outcome of thatconsultation was posted to the BC members on October 22. Any member in good standing [paid up dues] is eligible to stand as councilor. Officer positions must have been a member for 12 months before standing for office. Two positions are open, as noted above. Election Time table:1) Nomination period of two weeks: 10/17-10/30 [the process of submitting nominations is limited to BC members and is provided on the private distribution. 2) Discussion with Candidates: 10/31 - 11/3 - Members will be notified separately of conference call schedule3) Vote - 11/4 - 11/10 - via e -ballot 4) Voting count /publication of results: 11/15 to BC Members, and then to the BC archive list. The details for candidates and acknowledgement for those who are nominating them will be provided separately to BC Members. Phil -I would also urge removal of the language in your text calling for ICANN to sanction dispute providers. Let's focus on uniform rules governing their qualifications and responsibilities. The contract/sanctions model would not only run into problems with IGOs as Mike notes, but would also undermine the whole nature of independent third party dispute resolution providers. People use these providers exactly because they are independent and trusted third party not affiliated with ICANN. But that's not to say that they shouldn't be subject to high standards and uniform qualifications. If an entity fails to meet the standards, then they should be deaccredited. Sarah B. In fact this type of rigid “contract” language is what stalled individual ccTLD participation within the ICANN process for so long. It was only after ICANN adopted an accountability framework document that more participation/recognition occurred. I think Phil’s concerns can be address without the hard coded “contract” language. Having dealt with IGOs over the past several years I can tell you that getting them to sign “contracts” can be a complicated process. Therefore making WIPO sign a UDRP provider contract is likely to run into some complications that would likely draw the support/empathy of the GAC. Do we really want to pick that fight? Having dealt with WIPO during the past 11 years ago (remember that first UDRP meeting at Georgetown Sarah/Marilyn – seems almost like yesterday) I think as a trustee of this process WIPO would be in agreement about ensuring some uniformity of the rules. So let’s figure how to make them part of the solution, instead of making them part of the problem. Just my two cents. The following language addresses my concern but keeps the same meaning Phil originally intended: The Business Constituency (BC) cannot support approval of this or any other UDRP accreditation application at this time on the grounds that no new UDRP providers should be accredited until ICANN implements with all accredited providers a standard mechanism for establishing uniform rules and procedures and flexible means of delineating and enforcing arbitration provider responsibilities. Dear BC members, We are carefully monitoring on-line discussions regarding the draft BC position on UDRP arbitration providers and we thank the drafters and contributors. We are not experts on this issue, but while searching the ICANN site for relevant official information we found that: 1) The approved dispute resolution service providers are 4 and not 2 (see http://www.icann.org/en/dndr/udrp/approved-providers.htm) The draft BC position speaks about "... an effective duopoly of UDRP providers (WIPO and NAF)...." Therefore, the draft needs to be corrected. In addition, without taking a positive or negative position as regards the BC draft, but in order to better understand the issue, what do we answer to those who may ask, but what about the approval of the Chinese Centre or of the Czech Centre? 2) In page http://www.icann.org/en/udrp/#proceedings, under "Approval Process for Dispute Resolution Service Providers" it is stated that: "ICANN is not currently soliciting additional dispute resolution service providers; however, interested parties may contact ICANN on an individual basis to express their interest. The procedures used for approving providers in the past are provided for reference below." Does anybody know if there is such a "decision" and what it says? If there is such a 'decision" (and a reasoning), perhaps the BC could use in the arguing. We understand that time is limited, but we would appreciate if anyone can provide clarifications on the above, in order to understand the issue and to shape a view. Revised Draft BC Position on Establishing Standard Contract for UDRP Providers

Last week our Chair, Marilyn Cade, circulated a marked up version of the draft position statement on this issue that was originally drafted by me and subsequently edited by Mike Rodenbaugh. This morning, Berry Cobb suggested that the position statement should be cross-reference one of the pending recommendations of the RAPWG. I regards these suggestions as "friendly amendments" and have revised the draft statement to take account of them. Two versions of an updated draft are attached -- one is a redline markup of what Marilyn forwarded, and the other is a clean version of same. Marilyn also inquired whether there would be a cut off date at which the draft would be locked down for final consideration by BC members. As the comment must be filed by Thursday, October 28, iI would suggest that we lock down the draft no later than this Thursday or Friday, if that is in compliance with BC administrative rules. Draft CSG Charter for Review

All, I'm attaching for review and comment a draft of our Commercial Stakeholders Group Charter. We prepared this draft with active participation from volunteers from all three constituencies, including the CSG Executive Committee and with the help of two of our BC members who volunteered for the drafting team, Philip Shepherd and Ron Andruff as well as several other BC members who attended and contributed to our drafting session in DC last week. As you'll see from the attached, the CSG Charter builds upon the framework Philip drafted for our interim charter. It keeps all substantitve decision making within each Constituency, but outlines those areas where the CSG can work together on issues of common interest. ICANN staff also contributed various standard provisions that are required in all charter drafting. If you have edits or suggestions, please email them to directly so as not to burden the list. The deadline is one week from today -- Thursday October 28. All three Constituencies will be collecting comments during the next week with the goal of finalizing this shortly thereafter.
