Announcement of Election of Vice chair from Non Contracted Users House - Wolf Ulrich Knoben, from ISP Constituency

Dear members I share the GNSO Secretariat's announcement of the outcome of the 'House" election of our Vice Chair for the GNSO Council. Background that may be useful: For those of you new to the complex, layered approach of the organizational structure of the GNSO, the bylaws provide for Stakeholder Groups, which are organized into two Houses, and for three Nominating Committee appointees, who work together on managing the gTLD policy process, as provided by the ICANN bylaws. The GNSO does not have a chair, per se, of the SO, unlike the ccNSO, which has different bylaws. The Council is focused on gTLD policy and is a critical activity and focus for the BC, and our larger group -- the Commercial Stakeholder Group which includes the BC, ISPs and IPC. Other wider SO issues, such as the Review Teams established by the Affirmation of Commitments, or the Strat Plan/Budget Operating Plan are managed within the leadership of the SGs and Constituencies. The election process of the Council Vice Chair from our House is managed by the leadership of the two Stakeholder Groups of our House and took some time to finalize, but the election is concluded with Wolf-Ulrich's election to that critical leadership role in the GNSO Council. The role of the Council Vice Chair from our House is to ensure that the administrative and broader policy interests of our House are incorporated into the management planning process, so not to advocate a position, but to ensure that the over time management, resource focus, etc, are taken into account in how the Council's leadership organized and plans work. Each house has a V.Chair which is elected by that House, according to their procedures. The Council Chair is elected by the sitting Councilors, similar in timing to the Board election -- e.g. at the 'annual' meeting, which is typically the last meeting of the year, the 'old' Council closes. The 'new' council takes their seats, and then the election for the next year's Chair is held. While this has some logic as it follows the Board's example, it can mean that two brand new Nominating Committee appointees vote for a Chair, without any opportunity to get to know their 'role' or said candidate(s). We will send a thank you to Mary Wong, from the Non Commercial Stakeholder Group, who was last year's Vice Chair of the Council. And a note of congratulations to Wolf Ulrich. We will be tactful about appreciating coming to Dakar, but question ICANN's judgement on hotel endorsementand if the Gala turns out to exclude a lot of our members, I'll reference that as an expectation that should be better handled for "meetings for hte future. other talking points will be forthcoming for your review on that meeting. It's open, so come along -- I think Martin is joining Chris and I in that meeting. Others welcome, of course. Note that Ayesha is speaking in IGF Forum and I hope you will review the Newsletter -- both the Chair's column and the article, and come along to learn more if you are not well versed [as most of you are] in IGF! urgent change: MARTIN/PHILIP: with apologies, I am going to ask that I move your presentation to our next members call [Nov 11 probably]. The two rescheduled workshops have 'eaten' members availability. I do offer apologies for making this last minute cancellation. [and to Bene and Chris, who were with me this a.m. finalizing adm. work, and whom I asked to remind members of the meeting. On the way, I ran into a few members and they were courteous to advise me that they just saw the change, and would like to be at the workshops. It is an accident of scheduling that happened I gather yesterday or late the day before and was not 'noticed' unfortunately, so we didn't have the input yesterday to take this into account. Things move so quickly around here! It has felt like an excessively dynamic agenda this time. Trademark Clearing house has also eaten Phil Corwin's availability. Thanks, Phil, for your courtesy in letting us know. With apologies to all, I am thinking that I'll show up in the room, explain the situation, and make the executive decision that we can't be in two places at one time, after all. So, please participate in either the Trademark Clearing House or Consumer Choice workshops, and come to the GNSO Council. You have my brief talking pointsseparately for your review. It is unusual for the Chair to speak at the Council, and I am not encouraging that, as you will see. John asked for something else, and he and Zahid can continue to work toward support forJohn's proposal for more interaction with the participants. Dear BC members [finalizing also my proposed topics with Execom and members simultaneously. I would like to advise the Members of how I will handle the brief appearance as chair in the opening. It is my view that the Constituency does not report to Council on its work,and that the Councilors own the updates on the topics before the Council. I will do the following:Thank the Councilors/Council for this brief opportunity.1) say the above nicely. 2) announce that the BC has taken the opportunity of Dakar to preview our newest member service -- a quarterly newletter that we design and publish ourselves that is a part of our own outreach and participation directed both toward awareness about the BC and toward recruitment of further business members. I will say that contrary to some questions we have received, it was very affordable, with 500 hundred printed copies costing us about 1000 euros in total, including printing, and hand carrying in our luggage. We provide that information to say that we would welcome sharing our approach with any constituency who wants to talk to the team, which is led by our V.Chair, Chris Chaplow, and supported by our part time secretariat.3) hand out the insert, and way that we hope that this is a resource for all, and is our effort to contribute to our own and other's understanding of the complex, but important to understand management, participation, and leadership within the Council, and within the SGS/Constituenies. 4) note that the chairs of the SGs.Constituencies, joined by the Chair of Council and the V.chairs had an informal, non hosted breakfast and talked about the general topic of external risks and threats toward ICANN's role, e.g. in the IG area. It was a productive non policy discussion and I believe all enjoyed it. 5) updates on BC discussions related to the work of the Council will be provided, as is it appropriate to your meeting, by our Councilors. I will say one thing: It is my view that what the BC councilors had proposed was a mechanism to make the interaction between the 'sitting' Council and the audience of participants, both remote and on site. I will leave it to John Berard to discuss that further within the Council's further discussion.thank you for your time. The GNSO Council held a question & answer session over the weekend with Mr. van Gelder. Vote by show of hands Appendix 1: GNSO Council Voting Thresholds (ICANN Bylaws, Article X, Section 3)9. Except as otherwise specified in these Bylaws, Annex A hereto, or the GNSO Operating Procedures, the default threshold to pass a GNSO Council motion or other voting action requires a simple majority vote of each House. The voting thresholds described below shall apply to the following GNSO actions: 1. Create an Issues Report: requires an affirmative vote of more than 25% vote of each House or majority of one House; 2. Initiate a Policy Development Process (“PDP”) Within Scope (as described in Annex A): requires an affirmative vote of more than 33% of each House or more than 66% of one House; 3. Initiate a PDP Not Within Scope: requires an affirmative vote of more than 75% of one House and a majority of the other House (“GNSO Supermajority”); 4. Approve a PDP Recommendation Without a GNSO Supermajority: requires an affirmative vote of a majority of each House and further requires that one GNSO Council member representative of at least 3 of the 4 Stakeholder Groups supports the Recommendation; 5. Approve a PDP Recommendation With a GNSO Supermajority: requires an affirmative vote of a GNSO Supermajority; and 6. Approve a PDP Recommendation Imposing New Obligations on Certain Contracting Parties: where an ICANN contract provision specifies that “a two-thirds vote of the council” demonstrates the presence of a consensus, the GNSO Supermajority vote threshold will have to be met or exceeded with respect to any contracting party affected by such contract provision.Appendix 2: Absentee Voting Procedures (GNSO Operating Procedures 4.4) 4.4.1 Applicability Absentee voting is permitted for the following limited number of Council motions or measures. a. Initiate a Policy Development Process (PDP); b. Approve a PDP recommendation; c. Recommend amendments to the GNSO Operating Procedures (GOP) or ICANN Bylaws; d. Fill a Council position open for election. 4.4.2 Absentee ballots, when permitted, must be submitted within the announced time limit, which shall be 72 hours from the meeting‟s adjournment. In exceptional circumstances,announced at the time of the vote, the Chair may reduce this time to 24 hours or extend the time to 7 calendar days, provided such amendment is verbally confirmed by all Vice-Chairs present. 4.4.3 The GNSO Secretariat will administer, record, and tabulate absentee votes according to these procedures and will provide reasonable means for transmitting and authenticating absentee ballots, which could include voting by telephone, e- mail, web-based interface, or other technologies as may become available. 4.4.4 Absentee balloting does not affect quorum requirements. All, ICANN is taking a survey to gauge interest in the situation surrounding whois privacy. They are looking to do a more formal survey of how well the process works with regards to "relay" and "reveal" requests - in other words, finding out who is actually behind an anonymised whois entry and getting hold of them.
