The chairs of the Constituencies /and in our case, our CSG rep, Sarah Deutsch, will be discussing the Chair's Election and the House V. Chair's elections this week with priority. Some discussions are already underway at the Chair's level within the CSG, regarding Council leadership overall. The BC EXComm has a call on Thursday, 11/4, to discuss this, among other topics. We have a BC Members call on 11/11, and at this point, it is my plan to add this topic to the BC members call on 11/11. That would be an update discussion with members, due to the timing of the submission of nominations. Time Allocation for BC Members Call:At this point, we will allocate time accordingly on the BC Members Call: 15 minutes for any non policy topics. 45 minutes for policy discussions. The voting period has been shortened and now will end on 29 November 2010 and the results will be announced on 30 November 2010. These procedures are posted on pages: http://gnso.icann.org/ http://gnso.icann.org/elections/index.html COUNCIL ELECTION PROCEDURES OCTOBER/ NOVEMBER 2010 Approved 28 October 2010 This document contains the GNSO Council Election Procedures for the GNSO Council Chair to be seated in Cartagena in December 2010. References • ICANN Bylaws (http://www.icann.org/en/general/bylaws.htm#X ) Article X, Section 3, paragraph 7. The GNSO Council shall select the GNSO Chair for a term the GNSO Council specifies, but not longer than one year. Each House (as described in Section 6 of this Article) shall select a Vice-Chair, who will be a Vice-Chair of the whole of the GNSO Council, for a term the GNSO Council specifies, but not longer than one year. The procedures for selecting the Chair and any other officers are contained in the GNSO Operating Procedures. In the event that the GNSO Council has not elected a GNSO Chair by the end of the previous Chair's term, the Vice- Chairs will serve as Interim GNSO Co-Chairs until a successful election can be held. • GNSO Council Operating Procedures approved on 5 August 2010 (http://gnso.icann.org/council/gnso-op-procedures-05aug10-en.pdf ) 2.2 Officer Elections: Chair and Vice-Chairs - The GNSO Council shall select the GNSO Chair and two Vice Chairs as follows: a. The GNSO Chair shall be elected by a 60 percent vote of both houses. b. Each house will be allowed one candidate for GNSO Council Chair. A candidate for GNSO Council Chair does not need to be a member of a house but must be a member of the GNSO Council. Should a Chair be elected outside the houses that Chair will be a non-voting Chair. i. All ballots will include the "none of the above" option. In the event that this option gets 60 percent of both houses, each house will commence a new nomination period of not longer than 15 days. The election will be rescheduled for no sooner than 30 days. ii. In the case of a tie the election will be rescheduled no sooner than 30 days. In the case of a second tie, each house will commence a new nomination period of not longer than 15 days. The election will be rescheduled for no sooner than 30 days. iii. The leading candidate will be defined as the one with the highest score. For each candidate, determine the percentage of vote received in each house; add these percentages to determine the score; the leader is the one with the higher score. (Maximum score equals 200.) iv. In case neither candidate reaches the 60 percent of both houses threshold, a second ballot will be held between the leader and "none of the above." v. If the single candidate does not reach the 60 percent of both houses threshold, then each house will commence a new nomination period of not longer than 15 days. The election will be rescheduled for no sooner than 30 days. c. Each house shall select a Vice Chair within their respective houses. d. A Chair and Vice Chair may not be elected from the same Stakeholder Group. e. The Chair or Vice Chair shall retain their votes in their respective houses. f. In the event that the GNSO Council has not elected a GNSO Council Chair by the end of the previous Chair's term, the Vice-Chairs will serve as Interim GNSO Co-Chairs until a successful election can be held. g. The Council shall inform the Board and the Community appropriately and post the election results on the GNSO website within 2 business days following the election. Chair Qualifications Summary Nominees must be members of the council at the time the election is held and not necessarily at the time that the nominations are made. This means that: • A current council member who will not be in the new council is not eligible to run for chair. • An incoming council member who is not currently in the council is eligible to run for chair. Only current GNSO Council members are eligible to make nominations and second nominations. Chair Nomination Process Per the GNSO Operating Procedures referenced above (Section 2.2.b): “Each house will be allowed to nominate one candidate for GNSO Council Chair. Each house is responsible for determining how to nominate its candidate.” To allow for the possibility of a timely Council election process in Cartagena, each house is asked to submit its nominee for Council chair for the term beginning at the end of the 2010 ICANN annual meeting not later than 10, November 2010. Nominees shall submit a candidacy statement in writing to the GNSO Secretariat (gnso.secretariat(a)gnso.icann.org) as soon as possible after they have been selected by their house and not later than 22:00 UTC on 12, November 2010. A candidate for GNSO Council Chair does not need to be a member of the house selecting the candidate. Should the non voting NCA be elected as chair he/she would be a non-voting chair. The two houses may, separately, select the same candidate from the nominee pool if they so wish. House nominations for Council Chair should be sent to gnso.secretariat(a)icann.org. The GNSO Secretariat will send each House’s nomination to the Council list as soon as it is received. Voting Procedure The candidates from each of the houses shall have the opportunity of meeting with Council Members during the GNSO Council meeting on 18 November 2010. The first round of voting for Council Chair will be held electronically from 19 November until 29 November 2010. The GNSO Secretariat will announce the results of the first round of voting no later than 30 November 2010. If no election of chair occurs in the first round of voting, the GNSO Operating Procedures quoted above in Section 2.2.b will be followed. Seating of the New Chair Chuck Gomes, current GNSO Council chair, will serve as chair of the Council meeting on 8 December 2010. The newly elected chair of the Council shall assume responsibilities at the end of the 2010 ICANN Annual meeting or as soon as an election occurs thereafter. If no chair has been elected by the end of the Annual meeting on 10 December 2010, the vice-chairs will assume the chair responsibilities as defined in the Bylaws and a runoff will be scheduled as described in the GNSO Operating Procedures. The winning candidate needs 60% of the votes of each house. The Council shall inform the Board and the Community appropriately and post the election results on the GNSO website within 2 business days following the election. Dear BC Members The upcoming weeks before Cartegana's meeting will be action packed. I. BC Meetings Schedule: now to Cartegena Policy Discussions: As committed to Members, the ExComm is convening a BC Members Policy Discussion on November 11, at 10 a.m. EDT. The call will be recorded and transcribed.A bridge will be posted to members separately.The policy topics for the call will be posted shortly. Members who are activelyengaged in different topics will be reporting on status of key topics. Councilors will update on key Council topics, and Steve DelBianco, V.Chair, Policy Coordinationwill moderate the policy segment. Only urgent management topics will beaddressed on that call, so that the main focus can be policy discussion. TBC: BC Members Policy Discussion devoted to the new gTLD Guidebook;separately scheduled, after the Guidebook is published for comment.Steve DelBianco, V.Chair, Policy Coordination is soliciting volunteers to analyzedifferent sections and contribute as lead discussants on those sessions in that call. V. Elections and Charter Approvals:--The BC presently has two elections underway: BC Councilor and Completion of termfor V.Chair, Finance and Operations. Those elections will conclude by Nov. 15. --The CSG Charter will be circulated for BC Member vote in a separate administrative process. A oneweek comment period on the draft has concluded. The BC will use an online ballot for approval for theCSG Charter. the other two constituencies are also undertaking consultation and approval process. --Beginning next week, we will start working on the updates to the BC Charter with a small group of volunteers. We will not complete that process by November 15 but will target having a final draft version under discussion during Cartegena, with a separate sessionwith remote participation. Comment is shown below and is posted now at http://forum.icann.org/lists/acdr-proposal/msg00004.html --Steve ------ Forwarded Message Date: Thu, 28 Oct 2010 16:58:06 -0400 To: <acdr-proposal(a)icann.org> Subject: Business Constituency comment on recognizing new UDRP providers Business Constituency (BC) Comment on ICANN Proposal to Recognize New Domain Name Dispute Provider *Background* There is a pending request for comment regarding the application of the Arab Center for Domain Name Dispute Resolution (ACDR) to become a certified Uniform Dispute Resolution Procedure (UDRP) arbitration provider. *Summary* The Business Constituency (BC) cannot support approval of this or any other UDRP accreditation application at this time on the grounds that no new UDRP providers should be accredited until ICANN implements a standard mechanism for establishing uniform rules and procedures and flexible means of delineating and enforcing arbitration provider responsibilities. *Explanation* The BC notes that the voluntary registration or renewal of a gTLD domain must be undertaken via an ICANN-accredited registrar. All registrars are subject to a uniform contractual agreement with ICANN, the Registrar Accreditation Agreement (RAA). ICANN recently strengthened the RAA with additional amendments and the addition of flexible enforcement options, and a Final Report proposing additional RAA amendments has just been delivered to the GNSO for its consideration. In stark contrast, the involuntary termination or transfer of a domain can be ordered under the authority of a UDRP provider that has been accredited by ICANN but which is not bound by any constraints on or requirements pertaining to the exercise of that delegated authority. This has led to increasing concerns about the lack of adequate procedural and substantive consistency in the UDRP process. Such concerns are likely to grow if additional providers are accredited in the absence of the uniform framework of a standard mechanism. The BC strongly advocates that ICANN must first implement a standard mechanism with any and all UDRP arbitration providers that defines and constrains their authority and powers, and establishes regular and standardized review by ICANN with flexible and effective means of enforcement. The ultimate sanction of cancelling accreditation is an extreme sanction that ICANN has demonstrated a reluctance to initiate in other contexts. ICANN appears to be transitioning from an environment in which the vast majority of UDRP cases (approximately 98%) were handled by two arbitration providers (WIPO and NAF) and in which significant gTLDs were based in a limited number of national jurisdictions to one in which the majority of gTLDs and UDRP providers may well be headquartered in a widely distributed group of jurisdictions. In the future, business interests may well be investing substantial amounts in these new gTLDs, for both defensive, new branding, and other purposes. In this type of environment it is even more important that all UDRP providers be subject to uniform and enforceable responsibilities, as that is the only means of furthering the goal that UDRP decisions are consistent within and among UDRP providers, and that the UDRP remains an expedited and lower cost remediation for addressing cybersquatting. The BC notes that the issue of whether UDRP providers should be under a standard mechanism with ICANN is almost entirely separable from the question of whether the UDRP evaluation standards for determining the existence of cybersquatting should be reformed. There is no need to debate the substantive elements of the UDRP in order to address the fundamental issue of whether UDRP providers should be under a standard mechanism. *** The rapporteur for these comments was Phil Corwin. hi all, this is the first of a couple notes that are the result of a recent chat with Danny Younger. he raised a really interesting issue with the recent de-accreditation of the 4Domains registrar. this US-based registrar closed and the the domains were transferred to Bahamas-based Internet.bs. the question is this -- what are the implications of an unexpected and involuntary change in jurisdiction (US to Bahamas in this case) for the business domain registrant? i know that i would be concerned if i woke up and found that the domain i base my business on had been transferred to a registrar outside the jurisdiction i registered it in. i'm wondering if others think this is an interesting topic too and would like to work on a statement from the BC suggesting that ICANN strive to select gaining registrars in the same country as the de-accredited one whenever possible. mikey - - - - - - - - - phone 651-647-6109 fax 866-280-2356 web http://www.haven2.com handle OConnorStP (ID for public places like Twitter, Facebook, Google, etc.)

All, Below are a few notes from todays call for the DSSAWG. If you have any questions or comments, please let me know. To sum up todays call: the WG is still working on drafting a charter. We should have a final draft in the next few days. Joint DNS Security and Stability Analysis Working Group (DSSA WG) 27 Oct 2010: First conference call - discussion on the Charter draft v5 Main Topics of discussion: What should come out of this WG: - The level, frequency and severity of threats to the DNS (Is there a problem with the DNS?) - The current efforts and activities to mitigate these threats to the DNS (What are the problems and how are we working to mitigate them?) - Are their gaps (if any) in the current security response to DNS issues? (A DNS CERT is not completely off the table, but... if needed who is already conducting this type of work and who would be best to conduct it?) Questions that should be asked: - What is the true health of the DNS? - Is this about the core system, or everything that happens on the DNS? - Should we limit this to ICANN's mission? Other Items: - We need to evaluate the facts and the need. We need to come at this issue with NO assumptions nor preconceived notions. - We shall provide regular feedback and opportunity for comment from the SO's and AC's - We may allow observer status to those interested.
