BC members -- Wanted you to see this intervention regarding the IANA Transition and new ICANN bylaws. Last Thursday at the Approval Action Community Forum<https://icann78.sched.com/event/1T4Jk/approval-action-community-forum>, I was the only person to speak, and said this, at 22:40 of this zoom feed<https://icann.zoom.us/rec/play/l2LwV-lIVw-Toz_goWQemlIYYLun5k0ssot_q83DWUb5…> Steve DelBianco with the business constituency. I looked around, and about half of the folks in this room were around in 2014, 2015, and 2016, when we used the IANA transition as a leverage point to create bylaws, processes, and the empowered community. It allows the communities ICANN was designed to serve to hold the board and org accountable to those communities. For the other half in the room: You have to be mystified about Why there would be so much preparation from legal and org, and why the entire board is seated in the room to look at what seem to be insignificant and trivial amendments to the fundamental bylaws. But you couldn't be more wrong. This represents an exercise of the muscle of the empowered community. Because there may be times in the future when we're exercising this muscle on far more controversial amendments to fundamental bylaws, or a challenge to a decision that ICANN is made. And the fact that you're taking this so seriously gives me great comfort, and it gives me ammunition. Back in Washington, DC, where critics of ICANN and those who wish the transition never occurred are continuing to wonder whether the empowered community has any power at all. So I'll point to this as an instance that it's really being taken seriously. So when and if we need to hold board and org accountable on something more significant, we'll know how to do it. So I thank you for your seriousness.

On the 26-Jun call, Steve D. and Steve Crocker advocated a bulk upload capability for requesters. ICANN Org will not modify its systems development plan to facilitate uploads, so we have to do this outside of ICANN. Supporting discussion/voting on matters before the Commercial Stakeholders Group (CSG) Tim Smith is the CSG Liaison for the BC. At this meeting, Marie will succeed Tim. Mason Cole is leading CSG thru Dec-2023, when Philippe Fouquart of ISPCP will assume the role. NCPH Day Zero Meeting – October 20, 2023 – Hamburg Mason, Mark, Lawrence and I attended. All other constituencies in NCPH were also well represented with NCSG attendees consisting of Julf, Bruna, Tomslin, Wisdom, Stephanie, Juan, Benjamin, Manju, and David Morar. This was a productive day and while we agree that we cannot be aligned on all issues at all times, we need to work together where we can and respect each other. Ongoing communication was determined by arranging monthly NCPH ExCom Zoom calls, face-to-face sessions regularly at future ICANN meetings, and re-establishing the yearly intercessional – either as a stand-alone meeting or as an additional day to one of the ICANN meetings. 2024 candidate statement for Steve DelBianco, for role of BC Vice Chair for Policy Coordination

BC members, Thanks to Zak Muscovitch for nominating me as vice chair of policy coordination. Given that no other candidates are interested, I am willing and able to serve again. In my years serving as your policy coordinator, I’ve tried to be thoroughly prepared and provide support for BC members so that they can contribute to comment drafting and policy engagement at ICANN. Along the way I’ve also had to negotiate compromise positions among BC members with differing priorities. That approach seems to work for the BC, as we continue to be a major contributor to ICANN public comment opportunities and working groups. Thru Nov-2023, the BC submitted 16 comments/statements<https://www.bizconst.org/positions-statements> so far this year. While our public statements advance business interests, we also need to engage in working groups, reviews, and implementation teams. Here’s what I see as our top policy challenges/opportunities for 2024: Restore prompt access to accurate registrant data Businesses can no longer use Whois data to protect their customers from confusion and fraud caused by deceptive domain names and other DNS abuse. GDPR changed all that, and we have thus far not been able to muster a consensus to roll-back some of ICANN’s over-interpretation of GDPR. But there may be changes coming in 2024. The European Parliament approved NIS2, requiring member states to enact regulation requiring publication of accurate registrant data for legal persons. We hope that pro-consumer regulations from some EU states could pressure ICANN Org to adopt new policy or take a central role for disclosing registrant data for legitimate purposes in compliance with applicable laws like GDPR and NIS2. Mitigating DNS Abuse For the last 2 years, BC Councilor Mark Datysgeld and our chair Mason Cole continued focused on the issue of DNS Abuse. That pressured contract parties and ICANN to amend Registry and Registrar agreements to add modest obligations to address DNS Abuse. The BC generally supported the amendments while calling for new policy development in this area. There will be other policy areas for the BC to attend to in 2024, including the next round of gTLD expansion and the Holistic Review of ICANN. I look forward to serving the BC again in 2024, and hope to cultivate a new candidate for this role in 2025.
