Dear members, On behalf of Waudo Siganga and I, your 2013 Nominating Committee (Nom Com) member representatives, I am pleased to send you our Committee's first ever monthly 'Report Card', just one of the innovations launched at our first meeting, for more detailed reporting back to the ICANN community. This document represents a sea change in transparency for the Nom Com and one that we believe will underscore the Committee's commitment to openness and integrity in this year's process of selecting strong candidates to fill key roles in ICANN's ever-improving leadership. Regarding our 2013 Committee's new regime of openness, our Chairman, Yrjo Lansipuro noted: "We re-examined the reasons behind the exaggerated secrecy that has surrounded the NomCom institution. We went back to the 2007 NomCom Review, which offered an explanation: the justified requirement of absolute candidate confidentiality has led members and staff to "err on the side of caution" and treat many other aspects of the NomCom's operation as confidential "just to be safe." The 2007 Review noted: "Secrecy beyond what is required to preserve candidate confidentiality shields the NomCom from outside pressure and influence but also damages its credibility." Encouraged by our meetings with constituency representatives, with the Board and the CEO, the 2013 NomCom decided to make a clean distinction between our processes, which should be as transparent as possible, and information about the candidates, which shall remain absolutely confidential. I hope that this change will be noticed by the community. We'll keep on reporting, and we'll have an open session in Beijing." Both Waudo and I are pleased to report that the Committee has begun its mandate with a strong sense of mutual respect and camaraderie; fully united in its mission. I have also attached the 2013 Nom Com Timeline of activities and the Open Positions that we will be working toward filling. Soon, we will send an announcement to the BC list explaining the nature of the candidates we are looking for and the process for applying. We encourage you, however, to start thinking now about whom you know that would be a potential candidate to add to the pool. Highlights below: The GAC is supporting BC's suggestion that all applicant commitments become part of the Ry Contract and thereby become ICANN compliance matters: The GAC requests written briefing from the ICANN Board on: • the extent to which applicants will be able to modify their applications as a result of early warnings. • how ICANN will ensure that any commitments made by applicants, in their applications or as a result of any subsequent changes, will be overseen and enforced by ICANN. The GAC advises the ICANN Board: • that it is necessary for all of these statements of commitment and objectives to be transformed into binding contractual commitments,subject to compliance oversight by ICANN. • The GAC expects that applicants would not be penalised where the standard provisions of a contract are amended in order to meet specific obligations entered into in order to meet governmental concerns. GAC Early Warnings: GAC members are considering a range of specific issues including: • Consumer protection • Strings that are linked to regulated market sectors, such as the financial, health and charity sectors • Competition issues • Strings that have broad or multiple uses or meanings, and where one entity is seeking exclusive use • Religious terms where the applicant has no, or limited, support from the relevant religious organisations or the religious community • Minimising the need for defensive registrations • Protection of geographic names • Intellectual property rights particularly in relation to strings aimed at the distribution of music, video and other digital material • The relationship between new gTLD applications and all applicable legislation The GAC looks forward to discussing these issues with the ICANN community, and expects to finalise GAC advice on gTLD applications following the ICANN meeting in April 2013. As part of this work, some GAC members may initiate direct dialogue with applicants, including through the early warning process. The "RATIONALE FOR CONSOLIDATED MEETINGS STRATEGY PROPOSAL" is here<http://newgtlds.icann.org/en/about/trademark-clearinghouse/matching-rules-2…>. Summary of the proposal for ICANN meetings in 2014, 2015, and 2016: Asia/Pacific gets 1st meeting of each year Europe gets 2nd meeting of each year North America/Africa/Latin America alternate for the 3rd meeting. Discussion: Kieren McCarthy: over half of ICANN participants come from North America. It's more pragmatic to make North America one of the regular annual locations. Chris Disspain asked, and Nick confirmed that North America has the best availability of suitable venues. But Chris argued against using North America as a regular annual venue because of ICANN's global outreach priority. Avri Doria: VISA availability is key. Nick: If we pick a facility for re-use, we do better negotiating visas there. Avri: “A good reason not to use North America is that North America is not nice about visas” DelBianco (NetChoice): The title “Consolidated Meetings” implies fewer ICANN meetings. I don’t see how we can get our work done with just 2 meetings instead of 3. Asked if this 3-year plan is actually a transition plan to cut the meetings. Chris said no. Nick Tomaso said “Consolidated” was a term with respect to the meeting locations. Chris agreed. Euralo secretariat said that those who were denied a Canadian Visa will be on a list that could deny them future visas. (Is this even remotely true?!) Hungary GAC rep: the South Africa GAC rep said they were not consulted about Durban location selection. Chris disagreed. Marguerite (Chilean participant): some countries don’t have venues large enough to meet ICANN’s big-meeting requirements. Asked for flexibility. As the BC's Feb 2012 correspondence is on the Board correspondence page, I am wondering if we need to also post that again? It is not part of the consensus agreement, so is not appropriate to include as an attachment. It is available and we can provide a link to it, as well, as background, if that is useful. The BC notes that this consensus statement does not replace or override in any way the earlier BC correspondence which was specific to the objections period. Summary report from GNSO Council meeting in Toronto

GNSO Council met on 17-Oct-2012. (see Agenda<https://community.icann.org/display/gnsocouncilmeetings/agenda+17+October+2…> and motions<https://community.icann.org/display/gnsocouncilmeetings/Motions+17+October+…> as posted) Here is a quick report on what happened today: Nominations sought for second ATRT review team. Olaf said the second review is de-novo, so don’t pre-judge this review based on prior reviews. Motion on advice letter for Consumer Trust Metrics: John Berard withdrew motion, explaining WG plan to address open/closed TLDs and issue new advice. Jeff commented. Wolfgang says he has issues with def of consumer trust. Motion for a PDP on Uniformity of Ry/Rr Contracts w/r/t abuse. There was no second for this motion. Holding Zahid’s proxy, John withdrew the motion. Jeff Neuman opened discussion, criticizing the motion. Said the WG voted 8-6 on this item and said that all 8 votes for the motion were from BC members. Registrars also oppose PDP. Staff commented that they shouldn’t be tasked with reports that have little support. Afterwards, Mikey O’Connor suggested we “mine” the WG report for several types of abuse that should be addressed in ICANN compliance, RAA negotiations, etc. BC motion to request issues report on uniformity of reporting. Passed unanimously. Motion on Thick WHOIS PDP: Milton wanted to amend the charter to specifically call-out privacy rights. Jeff Neuman disagreed with Milton and said we should not expand the scope of this PDP. Jeff read the present PDP charter language: Impact on privacy and data protection: how would ‘thick’ Whois affect privacy and data protection, also taking into account the involvement of different jurisdictions with different laws and legislation with regard to data privacy as well as possible cross border transfers of registrant data? Mikey O’Connor went to mic and offered to help with draft language from Avri, specifically calling for consideration of “internationally agreed rights”. Neuman did not accept this as friendly, and the amendment failed. On the main motion, Wendy said she supported but agrees with SSAC that no further whois work should proceed until the purpose of whois is determined. The main motion passed unanimously. Nobody volunteered to be Council Liaison… Motion to Adopt IRTP Part C Final Report and Recommendations: Stephane accepted Mary’s amendment. Motion passed unanimously. Motion to initiate issues report on Internationalized Registration Data. Passed unanimously. -- Lyman Chapin (ICANN Staff) gave report on feasibility to do a study on WHOIS proxy/privacy relay and reveal requests. Conclusions: full study is feasible; would not answer all questions; all players felt study would be useful; privacy/proxy requesters were eager to participate; privacy/proxy services saw opportunity to show good industry actors. -- New Councilors were seated. Council Chair elections: Jonathan Robinson got only 3 of the 13 votes in non-contract house, but advanced to second round voting vs “None of the Above”.
