Questions/Options for Protection of IOC/Red Cross Names

I've participated in the last two meetings of a GNSO Working Group on answering the GAC's request for "reserved" status for Red Cross and the Olympics. Jeff Neuman of Neustar has been an outstanding chair and is driving us towards specific recommendations, at both the top-level and second-level. We have another call on 8-Feb and I'm eager for BC member input on the questions below, with respect to just top-level domains: --Steve Question 1. How should the Olympic and Red Cross/Red Crescent Terms be Treated in the Current Application Round GAC Proposal At the top level, the request is to protect the Olympic and Red Cross terms like the words “test” and “example” in the Applicant Guidebook (Section 2.2.1.2), extending those terms to multiple languages and receiving consideration during the String Similarity review. Right now, these terms (in not every language) is in the section entitled “Strings Ineligible for Registration” and would not invoke String Similarity Review. · Option 1: Recommend no changes to Guidebook and reject GAC Proposal. This means that the names set forth in 2.2.1.2.3: a) Are not considered “Reserved Names” b) Applied for strings are not reviewed for similarity to the names in Section 2.2.1.2.3. · Option 2: Treat the terms set forth in Section 2.2..1.2.3 as “reserved names” under Section 2.2.1.2. This means that: a) the names are not available as gTLD strings to anyone; and b) applied-for gTLD strings are reviewed during the String Similarity review to determine whether they are similar to those in Section 2.2.1.2.3. An application for a gTLD string that is identified as too similar to a Reserved Name will not pass this review. c) Like other applied for gTLDs not passing String Similarity Review, there is no appeal. · Option 3: Treat the terms set forth in Section 2.2.1.2.3 as “modified reserved names” meaning: a) The names are available as gTLD strings only to the International Olympic Committee, International Red Cross and Red Crescent Movement, as applicable. b) applied-for gTLD strings are reviewed during the String Similarity review to determine whether they are similar to those in Section 2.2.1.2.3. An application for a gTLD string that is identified as too similar to a Reserved Name will not pass this review. c) Like other applied for gTLDs not passing String Similarity Review, there is no appeal. · Option 4a – Same as Option 2, except there would be an appeal process for those organizations that can demonstrate legitimate rights to the “reserved names.” Appeal mechanism TBD. · Option 4b – Same as Option 3, except there would be an appeal process for those organizations that can demonstrate legitimate rights to the “modified reserved names.” Appeal mechanism TBD. · Option 5a: Same as Option 3 except that the “modified reserve names” are available as gTLD strings only to the International Olympic Committee, International Red Cross and Red Crescent Movement or, to those entities receiving a letter of non-objection from the International Olympic Committee, International Red Cross and Red Crescent Movement as applicable. · Option 5b: Same as Option 5a but also to include entities receiving a letter of non-objection from a relevant government. · Option 6a: Same as Option 5a, except that there would be an appeal process for those entities that can demonstrate legitimate rights to the “modified reserved names.” Appeal mechanism TBD. · Option 6b: Same as Option 5b, except there would be an appeal process for those entities that can demonstrate legitimate rights to the “modified reserved names.” Appeal mechanism TBD. Question 2. Should the protections set forth in Question 1 apply to languages in addition to those set forth in the chart in Section 2.2.1.2.3? If yes, which additional languages? a) Option 1: No, just the languages set forth in the Applicant Guidebook b) Option 2: Accept GAC Proposal stating asking for protection in “multiple languages - all translations of the listed names in languages used on the Internet.” c) Option 3: Extending protections to other languages, but a subset of languages. Question 3. Should the Protections in Questions 1 and 2 apply to subsequent gTLD rounds? a) Option 1: Yes, it should apply in all future rounds b) Option 2: No, it should only apply to this current round. c) Option 3: It should apply in this current round with no decision on subsequent rounds. We should evaluate the results of this initial round, document lessons learned, and then decide on recommendations on subsequent rounds based on the results of the evaluation.

latest draft of "advice" on Consumer Trust, Consumer Choice, and Competition

As I've mentioned on recent BC member calls, John Berard and I are on a Working Group looking at definitions and metrics for Consumer Trust, Choice, and Competition in the gTLD expansion. I've just circulated the 4th draft of "Advice" to the board on the definitions and measures. (attached) I changed the measures tables to include explanations of anticipated difficulties in obtaining and/or reporting each measure. The intention is to help the community understand the reasoning behind our assessments of difficulty. Hopefully this will stimulate community members to offer suggestions during public comment period. Our WG still needs to carefully review proposed measures in Choice and Competition sections. If possible, indicate your comments and edits about Measures and 3-year targets within the respective table row.After the WG finishes its edits, this draft advice will be posted for public comment. We will conduct a public work session in Costa Rica as well. Then a final version will go to GNSO, ccNSO, ALAC, and GAC for them to amend / send to the Board. Thanks, Steve. As Chair, I want to note that although numerous discussions took place on the BC lists, since some members raised concerns, and others expressed support, the ExComm , after discussion, supported a new and focused opportunity of 14 days for members to discuss, debate, and identify support and non support for additions to the list of Improvements to the new gTLD program. But time is limited to be prepared for discussions w GAC and ICANN for Costa Rica. This discussion is a priority. The BC letter to the Board made it clear that the BC supports ICANN, did not ask for a delay, but noted the need for focused improvements, which can occur before names go live into the "Root". Improvements may include additional suggestions from members. If so, please add those to the list. For instance, a member recently asked me if the BC can weigh in again about mechanisms within the Guidebook that specifically affect a brand holder as a registry. I want to thank our Vice Chair of Policy Coordination,other members of the Excomm, members who expressed views of any kind, and urge members to use the mechanism provided, via this process -- e.g. If you have changes, or comments, please use the format that this process provides. BC members, We've discussed this list of implementation improvements for several weeks. And we want BC members to have a full 14 days to review and approve the final list before we deliver to ICANN Board and management ahead of the Costa Rica meeting. So please review the attached list, which includes two sections: Section 1: Existing BC positions that are re-stated, with background from supporting BC positions . For these items. Please indicate any comments or suggestions regarding BC advocacy of these items. section on We explain that voting would be held if at least 10% of paid members object to the draft. That voting would be managed by the newly-elected officers after they take office Feb 17. UPDATE from calls with community regarding GNSO Budget: Over the two days, Officers Ron Andruff, Chris Chaplow, and Marilyn Cade joined the two calls. Neither call was well attended, with probably less than 8-9 participants per call. However, separate calls were scheduled with SOs and ACs.However, we have received confirmation that Janice Lange is gathering all the community input as well as the action items and these will be posted with all public comments on the ICANN website.
