Wolf et al Yesterday's announcement is very important. And I suspect a LOT of EU based registrars and their legal counsel are looking at this very closely. Some of us have been discussing the decision and trying to understand what (if any) impact it will / can have on the current situation with regard to EU registrars and the 2013 contract. It should also be noted that there are privacy implications with the standard new TLD registry contract. The ECJ's decision will mean that the Irish case has to go back to the Irish courts.. And of course while the ruling means the directive is "bad" it can't automatically overrule the legislation in all the member states overnight .. How ICANN will deal with this is another question entirely and it'll be interesting to see if their legal counsel are adopting their tone in light of this .. Just my two cents .. As an example, Germany didn’t transpose this EU Directive 2002/58/EC into its national legislation so far and was sued by the European Commission for “non-compliance with EU rules”. Now the EU Commission and most member states have to do their home work for respecting this European Court decision (life can be cruel ;-) Besides Europe, this court decision impacts IMO also ICANN incl. recent discussions in Singapore (and before) whether or to what an extent European registrars have to comply with and exert ICANN rules clearly violating European privacy standards – particularly after yesterday’s court decision? On 9 april, the European Union Court of Justice (EUCJ) ruled that "Directive 2006/24/EC of the European Parliament and of the Council of 15 March 2006 on the retention of data generated or processed in connection with the provision of publicly available electronic communications services or of public communications networks and amending Directive 2002/58/EC is invalid". This ruling follows requests by associations representing civil society in Ireland (Digital Rights Ireland, Ltd.) and Austria (Verfassungsgerichtshof). It - requires the European Union to provide enhanced protection for Internet and telecommunications users; - while recognizing the legitimate concerns posed by criminal and terrorist activities, imposes improved protection of personal data and privacy. For those not familiar with the legal system of the European Union, when the new Directive will have been adopted as a result of this ruling, it will be transposed into the national legislation of each Member State. To my knowledge, this ruling represents one of the most (if not the most) advanced legislation in the world regarding the protection of Internet user rights and privacy. There are two key words used in this draft document that are mutually exclusive but not acknowledged as such - "universal" and "distributed." Universal is mechanistic and comes from the world of management control, where systems are closed and rules are imposed on them from outside. It reflects a conventional belief that the future can and should be rendered more predictable. Distributed describes a functional principle of complex adaptive systems, i.e. the world of ecosystems, where systems are open and rules emerge from internal relationships. The future of such systems cannot be known from their initial conditions. These two words represent structural principles of governance that are incompatible. I have always believed that the existence of the Internet was a symptom of the distributed systems worldview in action. To effectively increase the resilience of the Internet Governance Ecosystem, it is not enough to reference open systems. The processes of rules formation and future anticipation should be trending towards that word distributed and its internal relational implications. It seems to me that this document does not fully take the implications of distributed open systems to heart. The evidence of an intention to cling to the universal is the call that: > All the organizations, forums and processes of the Internet Governance ecosystem are expected to commit to implementing, as well as explicitly adhere, to all the principles agreed in NETmundial. To make such a commitment would be to accept that there are universal principles external to the Internet Governance ecosystem that govern what it can do and that can render its future more predictable. ....when I see this thread I don't know why Robin Crawford comes top of mind...... To my mind the issue is moreso about culture than any one voting member. ICANN is an American corporation; shorthand for saying it is acculturated in a specific way. Its world view, decision model and management practices springs from a certain philosophical base. In this framework certain interests are inherently constrained. Some sentient ones understand this and so now, some moves are in play to address this. Time will tell whether they are fit to purpose or not. Wouldn’t this be a worthy topic for some drill down discussion in the context of https://community.icann.org/display/atlarge/ATLAS+II+Draft+Agenda ? It would be of particular interest to those of us with feet on both sides of the lines, but I’d think it’d also be of wider interest as well. Bill

In a paper submitted to NETmundial <http://www.coactivate.org/projects/campaign-for.nyc/blog/2014/03/08/260/> we addressed the question of suffrage in ICANN's governance processes. We look at voter eligibility at ICANN today and draw a parallel to America in 1787 when the 3% of the population was eligible to vote: basically large farm owners (no blacks, women, or poor). Our paper proposed that we take a first step in extending suffrage at ICANN by reverting to the selection of 5 board members by the At-Large Structures, one member per region. Let me reiterate, this is "a step" with more suffrage extensions required. The paper <http://www.coactivate.org/projects/campaign-for.nyc/blog/2014/03/08/260/> also proposed a formalized role for cities in the ICANN governance process.
