NORC will then analyze Internet content associated with each sampled domain to classify the entities that appear to be using those domains, along with any observable potentially commercial activities. Draft study results are expected to be published in mid-2012.Entity and activity classifications are not predefined but will be developed during the study, based on sampled data, to help the Generic Names Supporting Organization (GNSO) and ICANN community better understand the variety of possible correlations that may emerge. NTIA Actively Exploring Inclusion of Ethics and Conflict of Interest Provisions in IANA Contract

NTIA Actively Exploring Inclusion of Ethics and Conflict of Interest Provisions in IANA Contract Submitted by Philip Corwin on Wed, 09/28/2011 - 16:19 In a September 21st letter sent by Assistant Secretary for Communications and Information Lawrence Strickling to U.S. Senator Ron Wyden, the National Telecommunications and Information Administration (NTIA) disclosed that it is “actively exploring how to best meet this requirement” for “a clear and enforced ethics and conflict of interest policy” in the next version of the Internet Assigned Numbers Authority (IANA) contract. This Department of Commerce letter was sent in response to a September 14th letter from Senator Wyden to NTIA raising concerns about news reports of a “revolving door” at ICANN (Wyden press release and link to letter at http://wyden.senate.gov/newsroom/press/release/?id=2e414e69-1250-4ca3-ae6b-… ). The Senator’s letter stated: As you know, any designated IANA is hugely important in regulating the multi-million dollar domain name industry. At the same time, because the IANA is not a branch of the federal government, its executive leadership is not subject to the same financial disclosure, ethics, or conflict of interest rules as executive leadership at federal agencies or in Congress. While I support the control of this system by NTIA, I also believe that any IANA employees ought to be made subject to the same ethics rules in place as NTIA employees. With the growth in importance of this authority, it is important to ensure that decisions are made impartially. Senator Wyden’s interest in this issue was reportedly sparked by a September 21st story in the Washington Post headlined “A ‘revolving door’ at nonprofit keeper of domain names” (http://www.washingtonpost.com/business/icann-departures-draw-criticism/2011…) Secretary Strickling’s letter of response also notes that the NTIA has conducted two Notices of Inquiry regarding the IANA contract in February and June of this year, and has “received 136 comments from a range of domestic and international stakeholders including governments, private sector entities, and individuals who also noted the need for increase (sic) transparency and accountability” -- all as part of the first comprehensive review of the IANA contract since it was initially awarded to ICANN in 2000. NTIA recently exercised its option to extend the length of the current IANA contract, from the end of September 2011 to March 2012, to allow for extended consideration of whether the contract should be re-awarded to ICANN, as well as what additional conditions should accompany it. The IANA contract provides the technical foundation for ICANN’s DNS policymaking, including the addition of new gTLDs to the root zone file under the program approved by its Board in Singapore this past June and which will open for applications in mid-January 2012. A series of leaked European Commission discussion papers recently proposed that the IANA contract be amended to address ethics issues as well as to give governments greater leverage over the approval of new gTLDs and ICANN’s overall operation. At the same time, the Chairman of ICANN’s Board Governance Committee recently revealed that it has begun an internal discussion of Board and staff ethics issues, has directed staff to draft proposed guidelines, and anticipates community discussion on this matter at the upcoming ICANN meeting in Dakar, Senegal. ICA will be in attendance in Dakar and will continue to closely monitor the ethics, transparency and accountability issues as they are important on their own and have significant implications for ICANN’s future relationship with the U.S. and other governments, as well as for the broader ICANN community including domain investors and developers. Yesterday's IGF<http://www.intgovforum.org/cms/> sessions brought accusations that the private sector is blocking civil society's efforts to influence Internet Governance. "the private sector has no interest in furthering public values that true multi-stakeholderism would promote, ahead of its own power and profits, which could be threatened by further democratizing governance processes." They are damning the same private sector motivations that produced the most democratizing technologies the world has ever known: Internet search, email, social network services, e-commerce platforms, etc. Here's a post I did on that debate. With respect to your concern that the ICANN Board is only concerned with updating its conflicts approach solely to address the issue of Board compensation, I can assure you that the Board is looking much wider than that. The topic will be a area of discussion in the ICANN meeting in Dakar, Senegal. The BGC discussed that as a private sector organization, ICANN is limited in its ability to place restrictions on future employment, though there are many things that ICANN can do to address these concerns, such as continued strict adherence and enforcement of confidentiality provisions. The BGC noted that the conflicts/ethics discussion has been going on within ICANN prior to the approval of the new gTLD program. The BGC agreed that community discussion should occur in Dakar about this issue. ◦ Action: Staff to draft proposed guidelines for Board members and staff members, to provide additional information and guidance through the use of examples, for BGC consideration at its September workshop, in preparation for community discussion in October. Having concluded the detailed stakeholder discussions on policy and implementation for this program, ICANN is preparing for its launch: applications for new gTLDs are planned to be accepted 12 January – 12 April 2012. (Note: all applicants must at least register in the online application system by 29 March 2012.)The Applicant Guidebook is a comprehensive guide for applicants that describes the New Generic Top-Level Domain program's requirements and evaluation processes. The Applicant Guidebook has been developed and improved through extensive public review by specialized working groups and ICANN's Supporting Organizations and Advisory Committees. Each draft has been accompanied by extensive public comment analyses, explanatory memoranda, and independent reports. The modifications made to this version of the guidebook (version 2011-07-29) are primarily limited to changes directed by the Board resolution from the 20 June meeting in Singapore.What's next?The Applicant Guidebook is intended to be an inclusive guide and will be regularly updated as aspects of the process are deemed necessary and are implemented. In addition to the Applicant Guidebook, a summary of changes since the last version and a discussion version of a process for amending the Applicant Guidebook are also posted. There are certain areas where work is still ongoing, such as: whether single character Internationalized Domain Names (IDNs) can be delegated as TLDs, ensuring continued registry operation through a continued operations instrument, and providing support for needy applicants through the work of the Joint Applicant Support (JAS) working group.As to the last issue, the Board is committed to providing support for applicants from developing countries, and the JAS working group has recommended the criteria for that support. ICANN is launching the first phase of an Applicant Support Program. ICANN is launching a program where established organizations can apply to operate a generic top-level domain (gTLD) of their choosing. Operating a gTLD is a technology based service comprised of many requirements and expenses, e.g., acquiring equipment, establishing operations, hiring and training staff and providing customer service. Some entities planning to apply for and operate a TLD may seek technical or financial information or assistance to facilitate establishment of a new registry. The ICANN community is rich with talented, experienced and resourced participants who may be interested in helping others who seek such assistance. ICANN is seeking to facilitate cooperation among those entities seeking to establish a gTLD registry that serves the public interest and those entities willing and able to provide assistance to those entities. This page is intended to establish connections across both types of organizations by providing a “landing” page, where entities can state whether they are seeking or able to provide assistance. The page will contain contact information so that parties may contact one another. ICANN and Ethics

FYI, I have just published a rather lengthy opinion piece title "ICANN and Ethics" at CircleID.com -- http://www.circleid.com/posts/icann_and_ethics/ I began working on this shortly after last month's Washington Post "revolving door" story, and it has been through multiple edits. The article notes that the views expressed therein are solely my own and not those of any client, including ICA. The piece is very careful not to allege that anyone associated with ICANN has acted in an unethical manner. However, it does take the position that the business community generally benefits from its multi-stakeholder model rather than a governmental regulator under UN auspices; that ethical questions about ICANN threaten its independence and perhaps even survival in a period of multiple major challenges; that its present ethics policy is narrow and outdated; and that the Board should proactively undertake an initiative to update and improve its ethics policies. In passing, I also note that many parties beyond "contracted parties" now have an interest in ICANN policy decisions that can raise ethical questions. When I wrote the piece I was aware that NTIA was looking at baking ethics provisions into the IANA contract renewal. Since then the EC papers have become available, which also propose stringent (and somewhat misguided) ethics rules. I welcome BC member feedback on the article and the overall issue. A relay request is a request to forward a message to the registrant of a domain registered using a privacy service. A reveal request is a request to reveal the identity of the licensee of a domain registered using a proxy service. ICANN is seeking input from providers of privacy and proxy registration, from those who interact or communicate with privacy and proxy providers (in particular those who make relay and reveal requests), from registrars, and from other interested parties. The objective is that any potential future policy-making and any efforts to develop or support standardized procedures, tools, formats, etc., be based on data that accurately and broadly represent the experiences of those who use these aspects of the WHOIS system. By taking a brief survey, you can help lay the foundation for significant future studies. Ethical behavior/integrity @ and within ICANN is an increasingly important topic, and we will be discussing our BC views about how we deal with conflicts, as many of our members, or potential members may seek to act as a registry for their brand name, but primarlly retain their 'user' status. But, beyond our own safeguards, and firewalls, ICANN's Board, its staff, and its policy making processes may be significantly challenged. Marilyn CadeBC Chair http://wyden.senate.gov/newsroom/press/release/?id=2e414e69-1250-4ca3-ae6b-… Press Release of Senator Wyden Wyden Calls for Ethics Rules to Prevent Revolving Door for Internet Domain Name Regulators Wednesday, September 14, 2011 Washington, D.C. – As the online community prepares for a massive expansion in potential domain names and the expiration of the contract with the non-profit, non-governmental organization responsible for domain name regulation, U.S. Senator Ron Wyden (D-Ore) raised concerns about the potential for bias and unfair favoritism stemming from a revolving door between internet regulators and the multi-million dollar domain name industry they formerly regulated. In a letter to Acting Commerce Department Secretary Rebecca Blank and Assistant Secretary Lawrence Strickling – the administrator of the National Telecommunications and Information Agency (NTIA) – that is responsible for overseeing internet regulators. Wyden highlighted the need for ethics and transparency rules -- similar to that of Federal officials -- to be included in any contract with future domain name authorities known as an Internet Assigned Numbers Authority (IANA). The contract with the Internet Corporation for Assigned Numbers Authority (ICANN) is set to expire on September 30. “As you know, any designated IANA is hugely important in regulating the multi-million dollar domain name industry,” Wyden said in the letter. “At the same time, because the IANA is not a branch of the federal government, its executive leadership is not subject to the same financial disclosure, ethics, or conflict of interest rules as executive leadership at federal agencies or in Congress.” “While I support the control of this system by NTIA, I also believe that any IANA employees ought to be made subject to the same ethics rules in place as NTIA employees. With the growth in importance of this authority, it is important to ensure that decisions are made impartially,” Wyden continued in the letter. Over the last decade, the selling of internet domain names has grown into a multi-million dollar industry and is poised to grow significantly as an expansion of potential domain name suffixes (ex: .com and .org) is implemented. However, ICANN – the non-profit that regulates these sales – is not a government agency and is not subject to the same ethics rules as other federal agencies. As news reports have indicated, a formerly high-ranking official at ICANN has left the organization and was immediately hired by one of the domain name companies regulated by ICANN. Wyden has raised concerns about the revolving door between the organization and the industry and called for strict ethics guidelines highlighting transparency at any future domain name regulator be worked into the upcoming contract negotiation. Dear Members, Here is my update that I was intending to report on the call. Third FY12 budget has just been published. To remind you these were Draft in 17-May, then Public and Constituency comments, board approval 21-June subject to unspecified changes. Approved budget published 9-August. (Only changes I can see from draft to approved were the AC/SO support requests reduced from 970k to 597k) although the introduction does mention board minuted approval of RPKI (no numbers) and JAS ( 2m$ but I can not see it in the budget) Rational for the 9 Sept Budget is Based on the Board's decision to approve the launch of the New gTLD Program and to open the application window on 12 January 2012, the application processing now extends into the 2013 fiscal year. Therefore, it became obvious that including the New gTLD revenue and expenses across FY12 and FY13 presents a more accurate view of the overall FY12 budget. Also published are a <http://www.icann.org/en/financials/consolidated-budget-fy12-09sep11-en.pdf> new consolidated budget schedule which simply summarizes the consolidated budget detail into two pages. (somebody must have taken my idea from the sheet I waved at the BC board meeting) and a new schedule presenting the <http://www.icann.org/en/financials/new-gtld-program-cash-flow-09sep11-en.pd f> estimated cash flows for the New gTLD program, to include the processing of the 1st round applications over FY12 and FY13. Also mentioned is a re-allocation of approved constituency funding from three At-Large regional meetings to one General Assembly are reflected in this <http://www.icann.org/en/financials/adopted-opplan-budget-fy12-09sep11-en.pd f> updated FY12 Budget ( although this was in the 9-Augand and the heading does not mention the denial of the constituency requests element) So what highlight of this new budget. 97m gTLD income (500 * 185k) is moved from FY12 to 27m in FY12 and 64m FY13. Costs move as well but this has the effect of moving the previous this has the effect of reducing the 18m increase in net assets (profit) to only 180k. (a number so small and positive that it must have been worked backwards) Also new is out of 94m income that is allowance for 8.2m refunds. Costs already occurred in previous years seem to be included again. So it look like the whole exercise is not to show profit for the program. With the upcoming launch of the New generic Top-Level Domain (New gTLD) program, the Internet will see a number of new gTLD registry operators. Although all applicants must meet technical, operational and financial requirements (see the gTLD Applicant Guidebook – http://www.icann.org/en/topics/new-gtlds/dag-en.htm) the community developed new gTLD program includes provision for a backup process. The EBERO is designed to be activated should a registry operator require assistance to sustain critical registry functions for a period of time or in the case of transition for one registry operator to another.Candidates are expected to meet the requirements outlined in the RFI, which requires, for example, at least three years of experience in operating Domain Name services (DNS) and one year of experience operating Registration Data Directory Services (RDDS) and Extensible Provisioning Protocol (EPP) services. Besides the technical requirements, ICANN seeks candidates from geographically diverse regions in order to provide local service to registries in all regions and provide alternate sites in case of local disasters.ICANN is looking forward to receiving comprehensive information from the potential candidates.
