Welcome Matthias Langenegger to the ICANN At-Large Staff

Dear all: It is my pleasure to introduce you to Matthias Langenegger, who has just joined the At-Large staff in the Policy Unit as At-Large Coordination Officer. He’ll be helping support the global At-Large community in scheduling, meeting support and logistics, servicing information requests, minuting meetings, and helping keep the websites and community communications tools (like the new membership system) up- to-date amongst other essential tasks. Many of you may know Matthias from the IGF Secretariat, where he interned throughout much of 2007 - while there he assisted in the preparations for the Rio de Janeiro Internet Governance Forum in November 2007, coordinating the sessions schedule and providing logistical coordination. He also assisted in the assessment process for the different workshop and best practice proposals. Before and during his university education, he worked in different office environments such as banks and a small language school. He is originally from the German-speaking part of Switzerland and is a native German speaker who is fluent in English and French. He also speaks fair Catalan and Spanish having lived in Barcelona for a year. Matthias recently graduated from the Graduate Institute of International Relations at the University of Geneva and holds an MA in international relations. He lives in Geneva. Continuing the tradition of very long email addresses amongst the At-Large staff, he can be reached at matthias.langenegger(a)icann.org (or, in short form, matthias(a)icann.org ). Asia-Pacific Internet Users Big Part of ICANN's New Delhi Meeting http://www.icann.org/announcements/announcement-14feb08.htm Ceremony recognizes Regional At-Large Organization, first Asia-Pacific At-Large General Assembly 14 February 2008 NEW DELHI, INDIA: Individual Internet users from Asia, Australia, and the Pacific Islands have direct input into the Internet Corporation for Assigned Names and Numbers, a fact recognized today with the ceremonial signing of a Memorandum of Understanding between ICANN and the Internet user groups who participate in the Asia-Pacific Regional At-Large Organization (APRALO). The APRALO conducted its first General Assembly as a part of ICANN's 31st International Public Meeting in New Delhi. They discussed issues that will affect Internet users throughout the region and the world. The Internet user groups who are a part of APRALO are incredibly diverse, and include users from India, Japan, China, Australia, New Zealand, Hong Kong, and the United Arab Emirates. "Today's ceremony recognizes the ICANN community's success in creating a formal, global structure to help ensure ideas and feedback from individual Internet users around the world is heard in our policy processes," said Dr Paul Twomey, ICANN's President and CEO. "ICANN's work to introduce a process for applying for new top level domains – the part after the dot – especially those using the more than 100,000 characters from the languages of the world which do not use the Latin character set – will benefit from formal inputs through the Regional At-large Organizations worldwide. The Asia-Pacific RALO is a key contributor to this process." There are now more than 100 user groups taking part in ICANN's five Regional At-large Organizations, or RALOs, from the Asia-Pacific, Latin America and the Caribbean, North America, Europe, and Africa. APRALO was created on 30 March 2007 and has been informing the region's individual Internet users about ICANN activities and providing advice to ICANN on their behalf for nearly a year. The RALOs have direct input to ICANN, especially through the international At-Large Advisory Committee (ALAC), which represents Internet users in ICANN and whose members are chosen largely by the RALOs. "ICANN's ongoing coordination of the domain name system, and its policy work, has a large impact on the Internet and the more than one billion people around the world who use it – and the billions more who should be able to use it," said Cheryl Langdon-Orr, ALAC Chair. The debate comprised issues like domain tasting, new gTLDs, IDNs and changes to the GNSO's structure and the GNSO Improvements report submitted by the Board Governance Committee (BGC) early February 08. In the afternoon I followed Workshops on the IPv6 Update, Translation Policy and the Operating Plan. In the evening ALAC plus Secretariats had cocktails and hors d'oeuvres with members of the GNSO Council. In this report I would like to share a comment of the Consumer Union of the US on ICANN's Joint Project Agreement (JPA) which is supported by many at ALAC with you: ___ COMMENTS OF CONSUMER REPORTS WEBWATCH, Consumers Union of the U.S., On ICANN Joint Project Agreement with U.S. Commerce Department February 14, 2008 Consumer Reports WebWatch of the Consumers Union, representing 9 million consumers in the United States and Canada, supports ICANN's efforts to evolve and move forward toward an existence apart from the JPA agreement with the U.S. Department of Commerce. However, at this mid-term review phase, we do not believe the organization is ready to function without a similar accountability mechanism to the JPA in place. Major changes need to occur within the organization to assure more efficient and meaningful user community representation, with long-term guarantees that such representation would endure unforeseen scenarios in the future. Our justifications for this position are simple: First, we do not believe the structure of ICANN as it exists today sufficiently takes into account the needs and opinions of end-users. Based on a review of operational documents and bylaws, we do not see any sort of language guaranteeing meaningful user participation into the future. To address this issue, Consumers Union believes the at-large community needs multiple seats on the ICANN board; the initial bylaws, in fact, called for fully half the board to be elected by the at-large. We base this opinion on Consumer Reports WebWatch's own 11-month experience as an "at-large structure" recruited by ICANN, and our eight months' experience as an elected representative to the at-large advisory committee.__Second, though the outreach work of ICANN at-large staff Nick Ashton-Hart and Kieran McCarthy is commendable, ICANN's staff and public communications budget is insufficient to address a much larger problem of outreach. To elaborate: Currently, the NA-RALO is made up of a scant handful of organizations. While these are valuable partners, in no way could the NA-RALO be characterized as a viable representation of a broad-based user community in the United States and Canada. Further, many consumer organizations in the United States with a mission that includes the intersection of technology and consumer issues, remain skeptical of ICANN's intentions and its viability as an organization that takes consumer views into account. Until something is done to bridge this gap and ICANN demonstrates its good intentions and long-term structural viability to organizations such as the Electronic Frontier Foundation, Privacy Rights Clearinghouse and others, we do not believe ICANN can be considered to be acting in accordance with the concerns of the user community in North America.__In addition, there are no guarantees beyond mention in the bylaws that the "at-large community," itself currently under review, would remain a part of the ICANN structure 20 or even 10 years from now. The at-large advisory committee is without a vote in any meaningful policy forum. Without direct user community representation on the ICANN board, we do not believe ICANN is truly acting as a "multi-stakeholder" organization. We are concerned, in fact, that ICANN does sees itself as a multi-stakeholder organization, with industry, government, and industry groups as the stakeholders. It does not help matters much that many within the ICANN community view domain name registrants as the Internet's "end-users," and therefore the farthest realm the ICANN needs to reach. Until these issues are addressed we do not believe the organization is ready to progress beyond the JPA, which refers to "the global participation of all stakeholders" and "mechanisms for involvement of those affected by the ICANN policies." As the Internet-using public is a key set of stakeholders affected by ICANN's policies, it is critical, including for Internet security and stability, that the organization be accountable to the public and account effectively for its input. We believe the following three things need to happen in order for ICANN to move forward beyond the JPA: 1. Address lack of meaningful user representation, and assure its long-term viability within the organization, by creating multiple "user community" seats on the ICANN board. 2. Allocate significant budget to get the message that it has done so, out to civil society stakeholder groups in North America and the global user community. 3. ALAC Reps Further to consultation with board members of PICISOC there is agreement regarding the direction of ICANN with respect to the mid term review of JPA. There should be no control (oversight) by the US government or any other single or group of governments and the GAC can continue to provide the necessary participatory process. Furthermore, there should definitely be no control (oversight) by the UN or any UN body. ICANN should be the mechanism or vehicle for global co-ordination where ALS's though the RALOs and then ALAC can provide the bottom up guidance and participation. The JPA should be terminated as soon as possible through a process that ensures the transition to ICANN's co-ordination role is both effective and sustainable. This position is based on ISOC principles and builds on past submissions. We continue to support a transition to a private sector model for administration of the domain name system, and we continue to be supportive of ICANN's efforts as they evolve to this model. When the JPA was created in September 2006 it had two parts: • the agreement itself and • an annex written by the ICANN Board. The annex contained 10 commitments that the Board voluntarily made to the US government. The present mid-term review was also promised in the JPA. Some, including ICANN itself, seem to think it is possible that the JPA could be terminated at the mid-term. Others see obstacles – political and otherwise. - Irrespective of whether early termination is possible. For three major reasons, ISOC's position is that the JPA should continue until its end in 2009 so that ICANN can prepare itself for private sector management. Briefly those reasons are: (1) ICANN has done a lot in the first half of the JPA with respect to advancing work on the JPA responsibilities in areas such as transparency, to making progress in other key areas such as IDNs, and working to improve stability and security. The next 18 months will be an opportunity to put these into operation and ensure that the new mechanisms are adequate to meet community expectations. This is essential for the stability of the organization post-JPA, and is central to strong engaged community support – a central tenet of the private sector model envisaged for ICANN. (2) ICANN needs to develop a vision or plan for what it will look like and how it will work without the US government oversight. This will need community support and buy-in and must be developed within ICANN's processes, following principles of openness, transparency and accountability. The community needs to understand how ICANN plans to operate and evolve in the absence of the USG oversight role. That needs to be elaborated & test-driven over the next year(s) in order to be credible, to gain support, and before various constituencies should be comfortable with ending the JPA. (3) In the 2006 DoC proceedings, both ISOC and IAB strongly expressed the need for all parties to recognize that the protocol parameter function carried out by ICANN is on behalf of and performed fully under the IETF's direction. ICANN's responsibilities for these assignments is therefore different from ICANN's other responsibilities within the IANA function. In the next 18 months, concrete steps must be taken to recognize this, and to ensure that the IETF's protocol parameter needs will continue to be met to its satisfaction, regardless of any changes that may be made in ICANN's relationship with the DoC. The deadline for making the formal submission to the US government is February 15, and this summary of our position is provided as background for our discussions during the ICANN meeting. I am aware that some Chapters and individual members have already made submissions to the DoC – some not entirely agreement with the position we are planning to put forward. I think it will be important for ISOC members speaking publicly in Delhi to identify themselves and make it clear that they speak on their own or their Chapter's behalf. If you do not agree with the formal ISOC position outlined above, I would also encourage you to state that as well. Because of the short time remaining before the deadline for comments, I don't think it will be possible to engage in discussion on the chapter delegates' list. A focus was improvement of information that ICANN provides to its regional organisations (RALOs) to be passed on to their respective At-Large structures to enhance participation. Immediately afterwards we met some of the board members for an exchange of information and opinions. There had been other interesting cross constituency meetings such as preparation of today's GNSO Council session and a conference on "IT success of India" with four leading Indian business managers. In the afternoon ALAC met with Robin representing the Non-commercial Users Constituency (NCUC – of the Generic Names Supporting Organization, GNSO) discussing common concerns and exchanging view points. All those who haven't had enough so far could just follow the rest of the Board meeting with the GAC. The focus of this open meeting was on the midterm review of the JPA and what transition to the private sector will look like for ICANN.
