A couple of minor corrections: The biographical stuff is accurate but incomplete, in that I left Consumers Union at the end of May, after eight years, and am now at NARSAD, the National Alliance for Research on Schizophrenia and Depression. I am no longer with a consumer organization, though I do continue in consumer journalism, writing a column for AOL's Money and Finance section (http://www.walletpop.com/blog/bloggers/beau-brendler/) It was not necessarily a recent proposal to establish a consumer constituency -- I wrote the initial proposal back in February, I think. It's since been heavily rewritten and re-submitted to recast some presuppositions and correct some inaccuracies. Yeah right, Like they would volunteer such information.... beside it does not allow to conduct regular checks... and it does not stop the application , it may make it only a bit more difficult. What you explain to me is that one of the director has been convicted before, if he/she has done the time, in the local justice system, then I don't think it is the role of ICANN to supplant the local justice system. The way I read 5.3.2, is that ICANN reserve the right to terminate the contract if the registrar is convicted of financial fraud, but likely ICANN will not do anything because the local court will have already decided what to do with the convicted and unlikely there will be something like forbidding to do business.... Now if in the registrar agreement they were a clause that say tat all the directors should submit a police report (regularly), and that no director should have a criminal conviction, that would be something. I agree with you there is no public benefit in enabling criminals to become registrars, but that's more like moral or ethics, and that's usually different from laws, which seems to explain to me why ICANN is not doing anything. Report on Domain Names Registered Using a Privacy or Proxy Service

ICANN has just published a report on the above-mentioned subject. It is at http://www.icann.org/en/announcements/announcement-3-01oct09-en.htm It reports statistical data only. I personally consider it misses the point. Rough figures are meaningless if they are not used in context. There was no evaluation of use of proxy services by spammers, scammers and other cybercriminals. Dear Community Members, The Board has appointed the following individuals to serve as Non-Commercial Stakeholder Group (NCSG) representatives on the new GNSO Council: Mohammed Rafik Dammak – Tunisia Rosemary Sinclair – Australia Debra Hughes – United States Under the terms of the NCSG transitional charter approved by the Board on 30 July 2009, three of the six NCSG representatives on the new GNSO Council to be seated at the Seoul meeting were to be selected/appointed by the Board. The Board's Structural Improvements Committee (SIC) considered applications from a talented and diverse group of volunteers, conducted extensive due diligence, carefully reviewed the candidates, and recommended for full Board consideration a slate of three nominees to serve on the GNSO Council for the next two years. The individuals listed above were recommended by the SIC for Board appointment based on their combination of skills, experience, background, geographic location, knowledge and passion, with particular attention to their ability to help build non-commercial participation and contribute to the work of the GNSO. I will start of by saying that I do not know any of the new appointees nor was I a participant in the candidate evaluation process, and this comment is not supporting or objecting to the appointees. I believe that people have multiple interests, and that when being evaluated for an appointment such as this, it is the overall person that should be evaluated. In my mind, their employer or even their occupation should be the sole determination. Roberto said that Debra "is not in the Council as an individual, but as a representative of her organization". This is a new rule that I have never heard about before. If a person is elected/appointed by a group to represent them, such as a GNSO Councillor representing the RyR, it would be reasonable for the RyR to recall that person if they quit their job at a registry and went to work for a registrar. But for those appointed by the NomCom or by the Board for the old Interim ALAC, I have never heard mention of a rule that says you need to be recalled or resign if you change your job. Certainly a person could choose to resign as a matter of conscience, but I do not recall it mentioned anywhere that "thou shall not change employers". In theory, I would think it is fair game for a person to accept such as appointment based on their employment status, with the caveat that if that changes, they would resign. But I have never heard of such a rule within ICANN. Alan
