Request for input from the ALAC into the IRT's work on trademark issues with the introduction of new gTLDs

Building on the energy and enthusiasm that I trust those of you who were involved in the Mexico Meeting and At-Large Users Summit, still have I want, as Chair of the ALAC, to bring to the attention of At-Large and particularly the leadership of the RALO's and ALS's am matter arising from the Mexico ICANN meeting regarding tho formation and work of the IRT and indeed both the ALAC's and At-Larges input into its activities... Firstly I have included in the body of this message a copy in full, of a formal request from the President of the GNSO's Intellectual Property Constituency, Mr. Steve Metalitz, requesting ALAC specific input into this process in a very short time frame (we will add this to the Agenda for our March 24th ALAC Meeting) and pointing out the opportunity for individual (here I encourage also ALSes and RALO's to also respond directly) submissions to be provided directly to *ip-issues(a)icann.org*<ip-issues(a)icann.org> . Secondly two suitably qualified ALAC Members (in their individual capacity) have offered themselves to the IRT as Members these are Mr. Beau Brendler, and Ms. Vanda Scartezini, I would like at the ALAC Meeting to endorse these two IRT Members as formal representatives of the ALAC to this WG, and encourage discussion in the ALAC Working List regarding this matter prior to our discussion of this as an Agenda item at te March meeting as well... Related to this however is my desire to involve suitably qualified and experienced representatives from At-Large and the ALSes into an Ad Hoc ALAC WG (to operate as a subset of the existing new gTLD WG already established to give support and ensure that a balanced regional view on this important topic is provided (to include for example the matters of Traditional Rights that I heard discussed in the new gTLDs WG at the Summit meeting... I know we have plenty of talent ( all be it time poor talent) in this area of expertise so I want to encourage any one who can contribute over the next few days / weeks on this topic to join the Wiki Work space we will set up for the purpose, by sending your name and details to staff(a)atlarge.icann.orgas soon as possible this will help spread the workload AND ensure a good opportunity for input from "the edges" ... To this end I encourage the RALO leadership in each Region to actively, source, approach and encourage people you know of to step up and assist. I will ask staff to also send out an Announce email once the WIKI Work space is set up... CLO <email message from IPC> Dear Cheryl: During its March 6 meeting in Mexico City, the ICANN Board of Directors passed a resolution calling for the creation of an implementation recommendation team to "develop and propose solutions to the overarching issues of trademark protection in connection with the introduction of new gTLDs." That resolution directs the implementation recommendation team to "solicit input from the interested constituencies." The Board requested the GNSO's Intellectual Property Constituency (IPC) to convene an implementation recommendation team (IRT). Although the IPC is still developing the time line for the IRT's work and the criteria for membership on the IRT, the IPC wishes to begin soliciting input from the constituencies. Accordingly, we write to request that input from the At-Large Advisory Committee (ALAC). In particular, we seek the ALAC's proposals for solutions (new or existing) to trademark protection issues that have been identified in connection with the introduction of new gTLDs, concerns about such solutions, and any other pertinent information your ALAC believes the IRT should have as it begins its work. We encourage you to be as specific as possible. With regard to solutions, it is particularly important that solutions be scalable and fair. Finally, with the exception of identifying support for and/or identifying concerns with specific measures, it is not necessary to submit proposals about solutions that were set forth in public comments on the first draft of the Draft Applicant Guidebook; an IPC team is already hard at work identifying them. Your ALAC comments will have significant impact on the quality of the proposal and the speed that it will adopted, so please carefully consider your input, make it as complete as possible and try to respect the objectives of trying to protect consumers from harm while creating a fair and scalable solution. Proposed GNSO Motion on Post-Expiration Domain Name Recovery

Following the ALAC requesting an Issues Report on Post-Expiration Domain Name Recovery, the Issues Report (http://gnso.icann.org/issues/post-expiration-recovery/report-05dec08.pdf) was produced and submitted to the GNSO Council. The Council created a Drafting Team (DT) to address how best to handle the Issues Report, and the DT has now submitted a motion to formally initiate a Policy Development Process. The motion will be considered at the next GNSO meeting on March 26. A copy of the motion is attached. If adopted without change, I believe it will be the first time (at least in recent history) where a PDP will be initiated with an expected outcome of both a Consensus Policy and advice to various parties on how to ensure that the Policy is effectively deployed. RAA approved

At its meeting in Mexico City, the package of Registrar Accreditation Agreement amendments was unanimously approved. This was following a GNSO meeting earlier this year where the package was rejected. The ALAC had previously formally supported the acceptance of the RAA, not because it was felt to address all of our concerns, but rather that the proposed changes were in their own right, very important for the community. Going into the Mexico City meeting, there was significant distance between the various constituencies (and ALAC) and in fact two very distinct motions were on the table. The level of cooperation shown to achieve this result speaks well to the collaborative model that ICANN uses. The new motion below approved the amendments, but at the same time sets a hard deadline for completing a Registrant Charter of Rights and puts the Registrars on record as committing to quickly begin working in good faith to address further changes to the RAA. Alan =================================== Motion made by Tim Ruiz Seconded by Kristina Rosette Whereas, the Registrar Accreditation Agreement (RAA) has not been amended since May 2001, and ICANN has undertaken a lengthy consultative process related to amending the RAA, including several public comment periods and consultations; Whereas, the proposed changes to the RAA include important compliance and enforcement tools for ICANN; The Council wishes to approve the set of proposed amendments as quickly as possible so that the ICANN Board may review them, and if approved then implement them as quickly as possible; and Whereas, The Council would like to proceed on the drafting of a charter identifying registrant rights that registrars would be obliged to link to, as contemplated in the set of amendments; The Council would like a specific process and timeline to move forward with additional potential amendments to the RAA; and The Registrar Constituency is supportive of these efforts and is willing to participate on a good faith basis on anticipated next steps. Resolved: The GNSO Council supports the RAA amendments as documented in http://gnso.icann.org/drafts/current-list-proposed-raa-amendments-16dec08.p… and recommends to the Board that they be adopted at its meeting of March 6, 2009; Within 30 days of Board approval of the set of amendments, representatives from the GNSO community and the ALAC shall be identified to participate in drafting a registrant rights charter, as contemplated by the amendments and the current GNSO Council discussions, with support from ICANN staff. A draft charter shall be completed no later than July 31 2009; and Within 30 days of Board approval of the set of amendments, the GNSO Council will form a Drafting Team to discuss further amendments to the RAA and to identify those on which further action may be desirable. The Drafting Team should endeavor to provide its advice to the Council and ICANN staff no later than July 31, 2009.

Revised RAA amendment/motion

As you may remember, RAA amendment package that has been discussed needed to be approved by a 66% majority of the GNSO to allow the Board to put the changes in place. For a variety of reasons, when the GNSO voted on this, it did not receive a sufficient majority. There has been a discussion of various next-step motions. The following motion has just been circulated to the GNSO Council. As you will see, it is a cooperative effort of several constituencies. You will notice that a Registrant Bill of Rights, with a tight time-line, has a prominent place in this proposal, and the ALAC is explicitly included in the process. Dear Niromol and all, I support most of what you said in the meeting and wrote below. I am quite concerned that the RALO structure becomes too much constraint, rather than a conduit, for ALSs to provide their voices and, in return get the feed backs, thus becoming real resources of At Large. Not all issues related to AtLarge at ICANN are of regional nature - I mean RALO may not always be the efficient mechanism to channel the voices of the global users. I mean, an ALS in Tokyo may not agree with another in Munbai, but with Cape Town, perhaps, but they do not necessarily make up the single AP-RALO view. And that is OK, I guess, on the introduction of new gTLDs, perhaps. RALO may be a good channel to out-reach the new ones into the playground, but it could also become its own subject, then it is not really efficient. Dear colleagues and friends, It is indeed important, Cheryl clearly stated this morning during the review session, the number of c's in the TLD world is much higher than the number of g's. Being elected ALAC liaison ccNSO, and just warming up in this job, I'm asking all of you to bring me as many possible items you want me to bring up in the ccNSO meetings I'm participating in. We all know the process of new GTLD's will certainly influence the views and opinions in regards the participation of users in the workspace of the ccTLD's through the ccNSO. Recently several ccTLD's joined the ccNSO, which clearly proves something is going on or starting to go on. Reason why I would really appreciate to have your input. I'm available during this Mexico for personal discussions if such is needed, and I surely welcome every input to help me bringing the ALAC views to the ccNSO. Other than all Summit events and meeting with NCUC on Monday 6 pm and with the Board , I could not find one. Or there will be no ALAC meeting or no open meeting but all closed? Registrar compliance

Ladies and Gentleman As you may or may not know, I am actively involved in regularly reporting scam domains with fake whois details to registrars, concentrating mainly on advance fee fraudsters. Many of the real perpetrators are known, these gangs have been busted theoretically except for their locality. Hours and hours are spent verifying facts before the first report goes off. While some registrars have been a pleasure to work with and are willing to enforce the RAA (thank you PublicDomainRegistry/DirectI, Enom and the others that abide by the RAA), I must admit I am utterly and thoroughly disgusted in some of the other registrars. To make matters worse, ICANN's wonderful WDPRS system does not work! If the registrar decides to ignore a report, so does ICANN. I have reported numerous domains recently where I really went out of my may to make sure the evidence was extremely conclusive. These domains survived the "WDPRS process" unchanged, also follow up reports. Yet where I challenged a bank to have their lawyers contact one such registrar where the registrar ignores my reports, copying the registrar as well, they could disable the fake HSBC domain within hours? Hello MelbourneIT? The other domains reported in the same batch remain online and actively scamming! This is by no means an isolated incident for MelbourneIT. When making ICANN aware of registrar issues and extreme violations of the RAA, also making them aware of ignored WDPRS reports, I have been given the cold shoulder. As such, why should RAA compliant registrars continue to abide by the RAA if the "world's largest domain name registrar" blatantly ignores the RAA? Why should the public waste time on a placebo called the WDPRS system? Systems do not enforce compliance, the willingness of the people behind the systems do! As such, in the only avenue left to me, I have published some pertinent facts online at a blog, http://www.badwhois.info/wp (I am adding more info on the reported domains soon), regarding the holding company of the "world's largest domain name registrar" and their attitude towards compliance. Yet their website sports an ICANN logo???? How can the ordinary internet user survive the new Internet where everybody wants to make rules, but nobody is willing to enforce them? I am sickened to the core by this so called system. I saw the Internet born, I make a living out of IT, helped build it, I am involved in Internet security, but it is becoming increasingly difficult to say I am proud of it. "Business on the Internet", "the promise of the Internet" etc have all become oxymorons. As an example, take a quick look at how many spoofs of one bank there has been that has been found - NatWest bank - http://db.aa419.org/fakebankslist.php?psearch=natwest - now try Barclays, Citi. Obviously these could be mistaken for UDRP issues, but are not. The legal title holders to these marks are not directly affected so don not defend against these actively, so the public is left to fend for themselves. LEAs will not and impossibly cannot shut down each one of these - they simply do not have sufficient resources. Anyway, why use the taxpayer's money to sort out a mess that started elsewhere, why not stop this at the core? Bogus whois details where a registrar refuses to do anything without court orders etc does not help when the RAA is blatantly ignored. Ordinary citizens are under attack, they are being scammed every day on the internet, they see the trash in their email boxes, their identities are stolen and further scam domains are registered with those self same details. Corporates are willing to accept this and self blind or hide behind other legalese (also private domain registrations), since it allows the money to flow in, yet the victims are the ordinary innocent citizens who do not understand how the system works (or does not work). The system is now devoid of reality and "decency" - but that is the OPM and OPP I refer to in my posting. Definitely no integrity and not working for the ordinary internet user. To date nobody can quantify the financial losses on the Internet due to scams. Small businesses, and not so small, cannot survive once scammers get involved and spoof them. They simply do not have the financial means. What happened to BuyerGuardian.com? What message is the registrar community and ICANN is sending out? With ICANN Mexico happening, I would appreciate it if some of the attendees could find out what chance a normal internet user has of using the "system" if I, who I believe am more knowledgeable on domain and RAA issues than the average internet user, can not get either the registrar, or failing that ICANN, to actually look at reports of serious breaches of the RAA.
