Hi, There has been a conversation ongoing on the NARALO list that seems to me to belong on this list. Some of that list, me among them, felt is was important tome someone [NARALO, ALAC, ICANN] make a statement similar to one made by ISOC on the problem with the continuing action of the Egyptian government related to its shutting off of access to the Internet. An action that continues from day to day while we remain silent. Some on that list felt it was none of our business and out of ICANN's scope. Others, me among them, argued that it was in scope, given ICANN responsibility for IP and AS numbers and core value #1. > "Preserving and enhancing the operational stability, reliability, security, and global interoperability of the Internet." and that besides it was contrary to Human Rights most of our countries have agreed to in binding covenants: > International Covenant on Civil and Political Rights > http://www2.ohchr.org/english/law/ccpr.htm > > 19.2 > > Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice. Others felt that it wasn't proper for a bunch of North Americans to bring up such things given our awful reputation. And especially for US citizens to do so, given that we have congress representatives who want to create an Internet Kill Switch, seemed hypocritical. Others argued that our government's drive to create a kill switch was indeed a reason for us from the US to speak up and do something before everybody was cutting off the internet every time there was a protest against the established government. Finally, it was said that such an effort should be lead by AFRALO and since no other RALO seemed to be discussing this, we should just let it go. Or maybe send a note to someone at some point. It was certainly _not_ for me to send such a note to anyone, but as far as I could tell, there wasn't any rule against my doing so. Hence, this note. I am still in my first year as an ALS member and a participant in At-Large so I guess I should ask: Does At-large think this issue is out of scope for ICANN? for ALAC? a.

"IGP has obtained a copy of the US Commerce Department's position paper for its February 28 negotiations with the ICANN Board over the new top level domain program. The "USG Submission to the GAC Scorecard" shows that the U.S. Commerce Department's ICANN crew has gone off the rails. It supports direct governmental veto power over domains and demands that ICANN completely rewrite most of the consensus policies developed over 4 years." ...after the good news from Tunisia I'd like to post what happens right now in Egypt: http://www.renesys.com/blog/2011/01/egypt-leaves-the-internet.shtml It seems that all egyptian ISPs have cut their international connections, except Noor which is one of four uplinks for the Egypt Stock Exchange. Fibre cables crossing Egypt are still intact. 9th Circuit Court ruling on ICANN Contract.

The 9th circuit has ruled that the section 3.7.7.3 of the registrar/registrant contract has no meaning. This is a result of the no third party beneficiary provision of section 5.10 of the contract. This not only eliminates the issue for spam liability, but the issue for copyright or trademark infringement. But through its coordination role of the Internet's naming system, it does have an important impact on the expansion and evolution of the Internet.

Hi Adam: Due consideration was given in the ALAC Ex-Com this past week and I'm sure the Chair of ALAC will announce a perspective from the ALAC soon. Speaking as a generic At-Large member, I have indicated my support for observer status to interested parties several days ago. Hi, At Large might like to support this letter asking the Board and GAC to hold the intersessional meeting on new gTLDs open to observers. I think open meetings have become the default for both Board and GAC, but it is worth emphasizing in this case. The letter: <http://www.circleid.com/posts/icann_board_gac_geneva_meeting_open_to_observ…> An important paragraph: "We respectfully request that this consultation between the Board and GAC be open to observers, consistent with the practices of GAC -- Board interactions at the public meetings which ICANN holds three times a year. Since this is the first meeting of this nature in ICANN's eleven year history, the precedent for all future such meetings will be established by this meeting." No idea if the comment that the meeting will be held in Geneva at the end of February is correct. But if At Large does support the letter it might also say that should the Board wish to launch the new gTLD at the San Francisco meeting (and given the years of process a decision during later teleconference would be a disappointment), holding such discussions at the end of February would leave too little time for public comment.
