Derek, John, and all, Same is essentially true for Google.com, gmail.com, googlemail.com, and wikipedia.org, as well as 68,000 other Domain names in the US, yet it seems that John is emphisizing Canada in particular? Bill and all, I am not going to comment on your case in particular, but I can contest and would be more than willing to sware under oath myself that no matter how many times anyone reports spaming, phishing, or other fraudulent uses of Whois acquired data, if those companies or organizations are of a significant stature, they are rarely pursued by law enforcment. One has to wonder why. I myself have reported some 99 such incidents in less than a year now, and not one as far as I know or can determine are being pursued by law enforcment. I find such extrodinary if not entirely disreputable of law enforcment, sad to say... Ross and all, I respectfully in part disagree with the tenor and tone of your response to Dereks valid concern. He indeed may or should clarify his concern as it is not the privacy of PII data contained in a Whois record that is the acctual problem, but rather the lack of accuracy of non-pii Whois data in a whois record that is essential to be corrected and overseen in an active and expediant manner so that correction of such can be effected appropriately and with all due haste. Derek and all, The privacy act took into account many various considerations in respect to criminal activity, database privacy, which Whois essentially is not withstanding. Criminal activity in respect to Domain registration and consequencial Whois related data has far more to do with lack of accuracy (read falsefying some registration information ) than it does with using privacy to protect the potential criminal activity. Conversly, lack of good privacy for registrants presupposes that all registrants are potential suspects in some criminal activity or may decide to become involved in same. This assumption is of course falaonious in nature and in fact as the vast majority of registrants are not now, nor are likely to become involved directly in criminal activity of any sort. Danny and all, I don't read or interprate the link below in quite the same way you do Danny, but also I think given some other of CIRA's statements they pander regarding privacy yet allow third party access to PII in Whois. Ergo, I see, as doe our members especially those in Canada, that CIRA is playing both ends against the middle. This is of course an old and well known political stratagy that usually ends up creating more disharmony, significant lack of accountability, and serious damage to stakeholders, whomever they may be or in which juandra is involved. ICANN, GNSO, and the GAC's desire for more studies is seemingly seeks to break the privacy issues instead of stalling, by continuing to have more Working groups, studies, ect., ect. This also is yet another old and failed political stratagy that also largely and usually serves no harmonious of productive ends due to the lack of creditable means. The only primary ligitimate concern is once or accuracy in Whois data, not one of whom has access to PII in whois. Yet the accuracy problem is being used as a wedge issue to rehash the latter privacy issue. Domain Tasting Motion open for Public Comment 30 April to 21 May 2008

The Public comment period on the Domain Tasting Motion is open for public comments from 30 April 2008 to 21 May 2008. The GNSO Council approved by super majority vote a motion to discourage use of the current "add grace period" (AGP), where domains can be returned within five days without cost, for "domain tasting" purposes. The motion, which is pending for Board action, would prohibit any gTLD operator that has implemented an "add grace period" (AGP) from offering a refund for any domain name deleted during the AGP that exceeds 10% of its net new registrations during that month, or fifty domain names, whichever is greater. An exemption could be granted based on extraordinary circumstances, as detailed in the motion. "Domain Tasting" refers to a situation where an entity registers a domain name and then tests to see if the name has sufficient traffic to provide more income than the annual registration fee (usually through pay-per-click advertising). If the name is profitable, it is kept. If not, the AGP is used to return the domain at no cost to the registrant. Recently, there has been a significant increase in the number of domain names registered and returned within the AGP. In October 2007, the GNSO Council launched a policy development process (PDP) on domain tasting and produced an Initial Report http://www.gnso.icann.org/issues/domain-tasting/gnso-initial-report-domain-… for public comment that outlined the possible actions to be taken, and the arguments for and against such actions. The public is invited to comment on this motion before final consideration by the Board. Dear All: I have been requested to provide some language which might act as a 'bridge' which could help to reconcile the views expressed about the Joint Proposal on GNSO Reform which has been the subject of considerable discussion in the NARALO in the last several days. I hope that what I have crafted is at least close to what is required. As always, whether it is used or not is entirely up to all of you. I have taken the liberty of doing the drafting using the wiki version of the ALAC Statement to the Board of ICANN on GNSO Improvements, since it seemed to me that this would make it easy for everyone to see the original text of that document and also the changes that I have introduced, Here are some URLs for you: 1.
