But it's not the only sleazy thing that people do with domains, and it is not at all obvious to me why ICANN should do something special about this particular flavor of sleaze. If registrars are warehousing domains in violation of sections 3.7.4 and 3.7.9 of the registar agreement, I suppose that ICANN should slap their wrists, but that's trivial to circumvent by creating a nominally separate customer to hold the domains. If we agree that this is a bad idea, it would be much more effective to persuade Google and Overture to stop paying for clicks on pages with no content, thereby dealing with a problem that is not limited to typo and expired domains. We've seen click arbitrage, people buying Google ads to drive traffic to pages that are simply other Google ads. Domain tasting, on the other hand, uses the five day add grace period to register domains without paying for them. It stops being arbitrage and instead is somewhere between larceny and extortion, because the registration cost is zero. As many people, most eloquently Bob Parsons, have noted, it's exploiting a loophole that shouldn't be there in the first place. There was a great deal of debate both in the ICANN community and on the ICANN board about the deletion grace period, but none at all about add grace which was apparently tossed into the package by an ICANN staffer without asking anyone. Firstly: John, feel free to join the European list; I'm sure that nobody will object. Secondly: If there are missing elements from the issues report - which was forwarded around recently, and is attached again here - we should identify those and make improvements to the report. Any thoughts on that subject would be very helpful. Thirdly: Just because the ALAC requests an issues report from the At- large staff does not automatically lead to the GNSO Staff asking the GNSO to initiate a PDP. Here's a snippet from the Bylaws (Annex A(1)): 1. Raising an Issue An issue may be raised for consideration as part of the PDP by any of the following: a. Board Initiation. The Board may initiate the PDP by instructing the GNSO Council ("Council") to begin the process outlined in this Annex. b. Council Initiation. The GNSO Council may initiate the PDP by a vote of at least twenty-five percent (25%) of the members of the Council present at any meeting in which a motion to initiate the PDP is made. c. Advisory Committee Initiation. An Advisory Committee may raise an issue for policy development by action of such committee to commence the PDP, and transmission of that request to the GNSO Council. In other words the ALAC would need to take action formally and transmit a request to the GNSO Council as provided above. HOWEVER: Just because ALAC asks the GNSO to start a PDP doesn't mean that they will. The Council has to vote to do so - and the weighted voting of the registrars and registries means that the extra votes they dispose - especially in this case - could block a PDP being raised. I'm not saying that they would block it, or that any other constituency might do so, but the voting position means that we must move carefully. The initiation of a PDP is a serious step and it is very political. If a PDP were to be sought, careful thought would need to be given to how to assure that the PDP process actually begins - and then how to raise the votes in the GNSO Council to help the process reach the desired conclusion. I would suggest strongly that careful planning and though, as well as advance discussions with members of the GNSO council and the ICANN Board, should be held so that the political climate can be assessed. The At-Large Community should also, in advance, have a clear idea of exactly what the outcome of a PDP ought to be. I support the Domain Name Tasting issue to be discussed at the upcoming ICANN Meeting in Lisbon. Dear all: Since ALAC, African and European ALSes are all meeting in Lisbon, I'm wondering if we can do some substantive work with respect to the domain name tasting issue. Of course, if one region wants to do more with this than another, that's fine - but it occurs to me we will have lots of experts and staff people around in Lisbon; lets make the most of them. I'd like to ask, in particular, the ICANN Staff Registry Liaison to come and talk, at least with the ALAC but if it is in an open meeting perhaps also with other groups - or separately also with regions - and that conversation could be about registry issues in general with a focus on tasting. Without objection, I'll put a placeholder into the draft agenda of each group for a discussion on registry issues. Response to the Ombudsman's report

It appears that the Ombudsman's "report" has been posted publicly. Here is my personal response: The Ombudsman is quick to extol the virtues of Ombudsmanship (Report, p.15), but slow to put them into practice. He praises the flexibility and equitable alternatives open to an ombudsman, as distinct from a court of law, then treats the At-Large Advisory Committee like the hostile target of a grand jury investigation with no opportunity to respond. Using selective quotation from interim drafts circulated on internal lists, he paints a skewed picture of the Committee's processes and conclusions, and therefore misses some of the key facts in the dispute. The Committee does not deny responsibility for some delays. At the same time, the Committee was often barred from more rapid response by its ICANN-appointed staff, who unilaterally blocked Committee publication of vote results and then sent notifications to applicants without offering the Committee any opportunity to review or correct them.
