Towards Lisbon: Draft EURALO Bylaws / MoU and Lisbon Meetings

Hello Europe! As has been previously mentioned, the upcoming European ICANN International meeting in Lisbon is approaching fast (March 26-30 - http://www.icann.org/meetings/lisbon/) ICANN would like to provide for the European ALS community to come to Lisbon to finalise - at least - the Memorandum of Understanding between the European ALS community and ICANN and - ideally also - to conclude work on the Bylaws of the RALO. Whilst the Bylaws are in an advanced stage of work, there are still some areas where consensus has not yet been reached. What I would like to suggest to you as a plan of work is as follows: We should have a teleconference of all ALSes in the next couple of weeks to do the following: 1) Identify the remaining areas where work has to be done on the Bylaws; 2) Identify any areas with respect to the draft Memorandum of Understanding which need further review. The outcome of this teleconference will then give us the next steps with respect to both documents, and we can work during the remaining several weeks before Lisbon to further accelerate work, so that we can plan an agenda for meetings in Lisbon which gives time not only to finish the work on these documents but also to talk about the priorities of the EURALO in the coming year, and to work on policies currently under discussion in ICANN which the EURALO wishes to make representations about. I have attached a draft MoU to this email; it can also be found by navigating to www.euralo.org and choosing the RALO Organising Instruments page from the main menu. All European ALSes should have an account to login and edit the Wiki which is now the 'front page' of the euralo.org site (if you don't please let us know so we can get you an account). This draft incorporates the provisions of the Latin America and the Caribbean Islands' MoU, already agreed with ICANN, as well as some additional provisions from the current state of the Asia Pacific regional MoU (in the final stages of negotiation between the community now), and it allows for some of the specific needs identified by the European ALS community in the current draft Bylaws, without prejduging the outcome of some of the provisions in the Bylaws. At-Large Regional website content now managed by the regional ALS community

Dear All: I am happy to inform you that each of the regional URLS: www.afralo.org For Africa www.apralo.org For Asia-Pacific www.euralo.org For Europe www.lacralo.org For Latin America /Caribbean Islands www.naralo.org For North America All now point to the regional Wikis which began to come online in November/December 2006. This means that the ALS community in each region will be able to edit and manage the regional online home and the information it contains, whilst members of the public will be able to see the regional online home sites with the information which the region itself has decided should be made available. All ALSes should have received user accounts - if anyone does not have access to your regional site please let us know at staff(a)alac.icann.org. Of course ICANN At-Large staff will help to maintain sections related to forms, minutes of meetings where we are involved in taking minutes, providing FAQs, etc - in consultation with the regions themselves. Dear all, While I do neither agree with the tone and the conclusions of Danny Younger's message on the GNSO GA list, I would still like to pick out a sentence which, I think, is partially correct: "the vast bulk of these 66 accredited At-Large structures have had nothing to say on any DNS-related matter at any time nor have offered any written counsel to the Board whatsoever through any other public channels" I am indeed worried that we seem to be more focused on structure than content. Actually, I am yet to see *any* message on this list or the previous one which talks about current issues like whois, news gTLDS, DNSSEC, IPv6 in the root or what have you. Some individuals like Roberto, Vittorio, Wolfgang or Annette have been active through the ALAC or other committees and fora. Nevertheless, I think it is important that we Euralo members voice our concerns so that our European representatives in the ALAC know what the European consensus is. If you have any idea how we could organize ourseleves so that discussions are both inclusive and productive, please post. That commentary came from John Levine on behalf of CAUCE regarding the work of the WHOIS Task Force. I'd like to begin by thanking John for his personal contribution. Now, let's put the big question on the table: If the vast bulk of these 66 accredited At-Large structures have had nothing to say on any DNS-related matter at any time nor have offered any written counsel to the Board whatsoever through any other public channels, then what continuing purpose in the ICANN structure do these non-contributing bodies serve? Why do we continue to collect ALS applications and continue to spend hundreds of thousands of dollars in support of organizational policy advice that borders on nil? This is mismanagement taken to the extreme. Sure, there's lots of hoopla surrounding the formation of a RALO, but so what? Of what value are any of these constructs if well-considered advice fails to make its way forward to relevant Task Force groups or to the Board? The ALAC endeavor has been a monumental failure from day one that clearly cannot be cured with a dollop of additional time and more financial resources -- they've gotten enough cash and they've had more than enough time to get their act together -- it's time to throw in the towel on this losing proposition. I look at the efforts of the Intellectual Property Lobby and note that they can rally their troops to provide a great deal of thoughtful commentary when the situation so demands. By contrast, the ALAC can't generate a response (even with a $700,000 budget). It has no leadership skills, it has no recognized authority, and it hasn't had any buy-in from the At-Large community. Towards EURALO: A Proposed Roadmap

Hello everyone! I hope you have had a great Festive break and New Years celebrations. As so many regions are accelerating their work towards forming RALOs, an effort which has sped up in many regions following the launch of LACRALO in Sao Paulo, I thought I would make a few comments about how we could move forward in Europe. Firstly, On the incorporation of a legal entity for EURALO: As you all know, it has proven somewhat contentious to agree the country of incorporation. During the public forum in Sao Paulo, Paul Twomey, ICANN CEO, may have made this issue slightly easier to resolve by the following statement: ...I WOULD JUST MAKE ONE OTHER OBSERVATION ON THE ONE LANGUAGE ISSUE. IT IS VERY IMPORTANT -- AND I THINK THIS IS TRUE IN MANY INTERNATIONAL ENTITIES. IT IS VERY IMPORTANT THAT WE MAINTAIN A SINGLE LANGUAGE FOR BUSINESS. THAT SORT OF FOR THE ACTUAL DOING OF BUSINESS AND FOR THE CONDUCTING OF LEGAL AFFAIRS, IT IS ACTUALLY VERY IMPORTANT THAT WE DO THAT IN ONE LANGUAGE. THAT DOESN'T MEAN WE CAN'T TRANSLATE DOCUMENTS. BUT THE OFFICIAL LANGUAGE -- THE OFFICIAL DOCUMENTS SHOULD BE IN THAT ONE LANGUAGE... This is excerpted from the scribe of the session on Thursday - you can see the whole notes of the session at: http://sp.icann.org/ transcript/7dec06/public-forum It had already been the subject of consensus that the country of incorporation would be determined by: 1) legal documents could be filed in English 2) The cost of incorporation is low 3) The cost of operating the company is low There are only two countries we had explored incorporating in which allow ALL legal documents to be filed in English: The United Kingdom, and Switzerland. As a result, these are the two countries we must choose between. Secondly, on completing work on the Bylaws: There are still open points on the Bylaws as you know. Some of these can likely be resolved via online debate and discussion, but some of them may require a face-to-face discussion. Thirdly, the ALS community needs to agree on the contents of a Memorandum of Understanding As previously stated, I will produce a draft text incorporating the ideas from Africa, Latin America/Caribbean Islands, and Asia-Pacific, for review; this should be done in the next 10 days or so at most. Proposed Process to conclude work: What I suggested on the ALAC monthly teleconference yesterday was that we should borrow from the LAC region's experience on how to conclude these discussions. The model they used was as follows: 1) Work in advance had produced an MoU and Operating Principles which had a high degree of consensus, with only a few areas which were still the subject of discussion. 2) Arrangements were made for the ALS community to come to the ICANN International Meeting in Sao Paulo and meet for several hours to conclude work, over three separate sessions. ICANN staff prepared draft agendas and put forward proposals for discussion in relation to the remaining open areas, with the participants completely free to go in other directions with respect to those points, but with the staff proposals as a place to start 3) Agreement was reached on a text, which was reviewed onsite by the ICANN General Counsel's office to make sure that there were no problems with the MoU in that respect. After that was concluded, the regional ALS representatives elected the two representatives from the region to the ALAC. 4) A signing ceremony involving the press, and Vint Cerf and Paul Twomey, were conducted in the plenary hall, and a resolution of the board was adopted accepting the MoU subject to completion of a public comment period. If the region is willing, we can proceed on this basis, with the Lisbon ICANN meeting scheduled for 26-30 March 2007 as the venue for the F2F meetings(http://www.icann.org/meetings/lisbon/ ).
