Dear All, As Jonathan already mentioned in Durban, the GNSO Council has received funding under the FY14 Special Community Requests to organise a Council Development Session directly after the ICANN meeting in Buenos Aires. The objective of this meeting is to allow for the Council, including those members newly seated in Buenos Aires, to get to know each other better, provide information on the functioning and operations of the GNSO Council and allow for planning for upcoming projects and activities, with the aim to further enhance the co-operation within and effectiveness of the GNSO Council. We are currently working on the logistics as well as the programme for this meeting and plan to keep you up to date on a regular basis with regards to the details. For now, we would like to ask you to make sure to reserve Friday 22 November in your diaries for this meeting (with planned departure on Saturday 23 November). Furthermore, we would like your input on the logistics for Thursday evening / Friday morning and would like to ask you to respond to the following doodle poll: http://www.doodle.com/uq77rvafpx3cthkb (in short, the question is whether people prefer to travel to the new venue, approx. 1 hour outside of Buenos Aires, on Thursday afternoon/evening or on Friday morning). Dear Councillors, As a reminder for Thursday's Council meeting, 'In order for the GNSO Council to initiate a vote, a quorum must be present. A quorum is a majority of voting members in each House, which must include at least one member of each Stakeholder Group'. Also note that, 'An absent Council member does not count toward quorum even if a proxy has been established. A Temporary Alternate (see Section 4.7-Temporary Alternate below) if present, would count toward quorum'. Furthermore, as it concerns a vote to approve a PDP recommendation, absentee voting is allowed (but absentee voting does not affect quorum requirements). As noted in the operating procedures, 'Absentee ballots, when permitted, must be submitted within the announced time limit, which shall be 72 hours from the meeting's adjournment. In exceptional circumstances, announced at the time of the vote, the Chair may reduce this time to 12 hours or extend the time to 7 calendar days, provided such amendment is verbally confirmed by all Vice-Chairs present'. As it concerns a PDP vote, to approve a PDP Recommendation with a GNSO Supermajority it requires an affirmative vote of a GNSO Supermajority (A "GNSO Supermajority" shall mean: (a) two-thirds (2/3) of the Council members of each House, or (b) three-fourths (3/4) of one House and a majority of the other House."). Item 3: Consent agenda No items Item 4: MOTION - Locking of a Domain Name subject to UDRP Proceedings (15 mins) The "locking" of a domain name registration associated with UDRP proceedings is not something that is literally required by the UDRP as written, but is a practice that has developed around it. As a result, there is no uniform approach, which has resulted in confusion and misunderstandings. The GNSO Council initiated a PDP on this specific topic in December 2011 and tasked the WG to make recommendations to the GNSO Council to address the issues identified with the locking of a domain name subject to UDRP Proceedings. The PDP Working Group has now submitted its Final Report for GNSO Council consideration containing 17 full consensus recommendations (see http://gnso.icann.org/en/issues/locking/domain-name-final-05jul13-en.pdf). 4.1 - Review motion<https://community.icann.org/display/gnsocouncilmeetings/Motions+1-August-20…> (See: https://community.icann.org/display/gnsocouncilmeetings/Motions+1-August-20…) 4.3 - Discussion 4.4 - Vote (Threshold supermajority) Item 5: Any Other Business (5 min) Appendix 1: GNSO Council Voting Thresholds (ICANN Bylaws, Article X, Section 3) 9. The voting thresholds described below shall apply to the following GNSO actions: a. Create an Issues Report: requires an affirmative vote of more than one-fourth (1/4) vote of each House or majority of one House. b. Initiate a Policy Development Process ("PDP") Within Scope (as described in Annex A<http://www.icann.org/en/about/governance/bylaws#AnnexA>): requires an affirmative vote of more than one-third (1/3) of each House or more than two-thirds (2/3) of one House. c. Initiate a PDP Not Within Scope: requires an affirmative vote of GNSO Supermajority. d. Approve a PDP Team Charter for a PDP Within Scope: requires an affirmative vote of more than one-third (1/3) of each House or more than two-thirds (2/3) of one House. e. Approve a PDP Team Charter for a PDP Not Within Scope: requires an affirmative vote of a GNSO Supermajority. f. Changes to an Approved PDP Team Charter: For any PDP Team Charter approved under d. or e. above, the GNSO Council may approve an amendment to the Charter through a simple majority vote of each House. g. Terminate a PDP: Once initiated, and prior to the publication of a Final Report, the GNSO Council may terminate a PDP only for significant cause, upon a motion that passes with a GNSO Supermajority Vote in favor of termination. h. Approve a PDP Recommendation Without a GNSO Supermajority: requires an affirmative vote of a majority of each House and further requires that one GNSO Council member representative of at least 3 of the 4 Stakeholder Groups supports the Recommendation. i. Approve a PDP Recommendation With a GNSO Supermajority: requires an affirmative vote of a GNSO Supermajority, j. Approve a PDP Recommendation Imposing New Obligations on Certain Contracting Parties: where an ICANN contract provision specifies that "a two-thirds vote of the council" demonstrates the presence of a consensus, the GNSO Supermajority vote threshold will have to be met or exceeded. k. Modification of Approved PDP Recommendation: Prior to Final Approval by the ICANN Board, an Approved PDP Recommendation may be modified or amended by the GNSO Council with a GNSO Supermajority vote. l. A "GNSO Supermajority" shall mean: (a) two-thirds (2/3) of the Council members of each House, or (b) three-fourths (3/4) of one House and a majority of the other House." Appendix 2: Absentee Voting Procedures (GNSO Operating Procedures 4.4<http://gnso.icann.org/council/gnso-operating-procedures-22sep11-en.pdf>) 4.4.1 Applicability Absentee voting is permitted for the following limited number of Council motions or measures. a. Initiate a Policy Development Process (PDP); b. Approve a PDP recommendation; c. Recommend amendments to the GNSO Operating Procedures (GOP) or ICANN Bylaws; d. Fill a Council position open for election. 4.4.2 Absentee ballots, when permitted, must be submitted within the announced time limit, which shall be 72 hours from the meeting's adjournment. In exceptional circumstances, announced at the time of the vote, the Chair may reduce this time to 24 hours or extend the time to 7 calendar days, provided such amendment is verbally confirmed by all Vice-Chairs present. 4.4.3 The GNSO Secretariat will administer, record, and tabulate absentee votes according to these procedures and will provide reasonable means for transmitting and authenticating absentee ballots, which could include voting by telephone, e- mail, web-based interface, or other technologies as may become available. 4.4.4 Absentee balloting does not affect quorum requirements. Dear Councilors, While reviewing my emails and notes in preparation for our Council Meeting on Thursday, it appears the motion on Locking of a Domain Name subject to UDRP has not been seconded. If I missed that email or action, please accept my apologies. If the motion has not yet been seconded, I offer my second to this motion now. Again, I want to take this opportunity to reiterate the IPC's support for this motion and underscore that the IPC's decision to oppose the motion was not based on the merits of the final report; rather, "in the interest of consistency and predictability" the IPC believed the GNSO Council rules needed to be followed. What This Working Group Will Do The Working Group is tasked to provide the GNSO Council with a set of recommendations on: 1. A set of principles that would underpin any GNSO policy and implementation related discussions, taking into account existing GNSO Operating Procedures. 2. A process for developing gTLD policy, perhaps in the form of "Policy Guidance", including criteria for when it would be appropriate to use such a process (for developing policy other than "Consensus Policy") instead of a GNSO Policy Development Process; 3. A framework for implementation related discussions associated with GNSO Policy Recommendations; 4. Criteria to be used to determine when an action should be addressed by a policy process and when it should be considered implementation, and; 5. Further guidance on how GNSO Implementation Review Teams, as defined in the PDP Manual, are expected to function and operate. Background Mainly as a result of discussions stemming from implementation related issues of the new gTLD program, there is increased focus on which topics call for policy and which call for implementation work, including which processes should be used, at what time and how diverging opinions should be acted upon. In order to facilitate these discussions, ICANN Staff developed a draft framework for community discussion that identifies a number of steps and criteria that might facilitate dealing with similar questions in the future. The paper identifies a number of questions that the community may want to consider further in this context, as well as a couple of suggested improvements that could be considered in the short term. While developing a bright-line rule as to what is policy or implementation may not be possible, the hope is that by developing clear processes and identifying clear roles and responsibilities for the different stakeholders, it will become easier to deal with these issues going forward and allow for broad participation and involvement. Following several discussions by the GNSO Council on this topic, the GNSO Council has now formed a Working Group which has been tasked to provide concrete recommendations on how to address some of these issues from a GNSO perspective.
