Dear GNSO Council, The Registration Data Policy IRT has met today to review its position following the GAC letter<https://www.icann.org/en/system/files/correspondence/caballero-to-sinha-23a…> of 23 August 2023 and the RrSG letter<https://www.icann.org/en/system/files/correspondence/heineman-to-sinha-08se…> of 8 September 2023 offering to remove the contentious Urgent Request wording to allow for a speeding publication of the Policy. The IRT going back to the original Recommendation 18 requesting the IRT to “consider” Urgent Requests believes that in essence it has considered the topic and therefore is able to remove the wording from the final policy without requiring further input from either the GNSO Council or the ICANN Board. The IRT also notes that in the spirit of the above mentioned letters, the issue of Urgent Requests is a topic that must be resolved and asks the GNSO Council to consider it and relevantly prioritize it in its work. There should be adequate communication and coordination among existing forums, task forces and organizations of the Internet governance ecosystem. Periodic reports, formal liaisons and timely feedback are examples of mechanisms that could be implemented to that end. It would be recommendable to analyze the option of creating Internet governance coordination tools to perform on-going monitoring, analysis, and information-sharing functions. 5. In the follow up to the recent and welcomed announcement of US Government with regard to its intent to transition the stewardship of IANA functions, the discussion about mechanisms for guaranteeing the transparency and accountability of those functions after the US Government role ends, has to take place through an open process with the participation of all stakeholders extending beyond the ICANN community. The IANA functions are currently performed under policies developed in processes hosted by several organizations and forums. Any adopted mechanism should protect the bottom up, open and participatory nature of those policy development processes and ensure the stability and resilience of the Internet. It is desirable to discuss the adequate relation between the policy and operational aspects. This transition should be conducted thoughtfully with a focus on maintaining the security and stability of the Internet, empowering the principle of equal participation among all stakeholder groups and striving towards a completed transition by September 2015. 6. It is expected that the process of globalization of ICANN speeds up leading to a truly international and global organization serving the public interest with clearly implementable and verifiable accountability and transparency mechanisms that satisfy requirements from both internal stakeholders and the global community. Jeff, Regarding the hypothetical from yesterday involving new law passed in Narnia, you mentioned that once a policy is done and adopted by the Board, the Council should not revisit that policy and it's up to the Board to request that if needed. Since you are an original author of the PDP Manual, I am wondering what you make of Section 17, which deals with reviews of past policy recommendations and calls for periodic assessment of PDP policies. Views are requested on whether it is necessary for Council to provide a response on this, given that the IRT is not a GNSO-managed process. As previously mentioned, the Board will meet the GAC on 5 December, and so we should aim to send our responses to the Board in advance. On behalf of the ICANN organization Review Support and Accountability team, I am reaching out to leadership of the ICANN Supporting Organizations (SOs) and Advisory Committees (ACs) to plan for implementation of the Third Accountability and Transparency Review (ATRT3) Recommendation 3.6, to evolve Organizational Reviews into a Continuous Improvement Program (CIP). As we reported at the SOAC Roundtable meeting on 29 September, ICANN org proposes the formation of a CIP-CCG to convene in December 2023, with the goal of developing a framework for implementation of ATRT3 Recommendation 3.6. We will be looking forward to having some representatives with familiarity with Organizational Reviews, but also representatives with knowledge of continuous improvement work outside of ICANN; those that can contribute new and innovative ideas for improving the effectiveness and the accountability of the different ICANN structures. There is the importance of striking a balance between representatives with deep ICANN experience, and those that bring new perspectives. Please see attached the *full letter to SOAC Leadership on CIP-CCG and Terms of Reference for a CIP-CCG* documents as discussed and reviewed. The next step is to proceed with this approach by the end of November as mentioned in the letter. We will be happy to address any question or input that your organizations’ members may have by then, and invite you to submit them to larisa.gurnick(a)icann.org and evin.erdogdu(a)icann.org.
