Please be assured that ICANN organization is committed to and interested in gathering the community’s feedback on each of the features that we will be rolling out with the objective of improving the findability, transparency, and accessibility of ICANN public content. The deadlines are, unfortunately, what they are in order to ensure that we are able to deliver on this major project on budget and on time. This new website implies a shift towards greater consultation and community participation in ICANN's content strategy, but we cannot actually wield any influence by commenting here. (And not just because if you press the 'provide feedback' button, you see "The feedback survey is temporarily unavailable.") From what I understand we are not even being asked to comment on anything important. The list of 250 definitions, which I would like to review for neutrality and accuracy, are not online and it sounds like they have already been approved internally and are not open to community review. Are we really being asked to comment on just the glossary tool itself, and did ICANN really produce a video mockup and slide deck of something so incredibly mundane when it is up for public comment for just a week? Please forgive the negative sentiment to my message here, but it really seems a poor allocation of resources to me. Dear all, I suggest reading the attached letter dated 21 December 2018 that the Contracted Parties House [submitted](https://community.icann.org/display/EOTSFGRD/Public+Comments+on+… to the EPDP leadership team. I think it provides an honest assessment of where the EPDP is at, where the EPDP team's Initial Report recommendations originated from, and why the EPDP leadership team's decision to deviate from usual practices vis-a-vis the public comment process was perhaps not recommendable. Update from EPDP leadership regarding the EDPB letter

Dear GNSO Councilors: We are writing to report some specific recent actions by the EPDP team. As you know, the EPDP Charter states that, "the Initial Report should be submitted to the European Data Protection Board [EDPB] or other relevant DPAs to request feedback on the applicability of the law in relation to the proposed recommendations, particularly those that may carry over from Temporary Specification to Consensus Policy recommendations to the ICANN Board.” After a detailed and constructive discussion, the EPDP team has decided (for the time being) to not directly contact the EDPB in order to request feedback on the Initial Report. We are writing to explain the thought process that went into that decision and seek any feedback the Council has to offer. As the EPDP team debated and discussed charter questions and issues leading to the publication of the initial report, it identified a set of legal questions (i.e., interpreting the GDPR) that required resolution before certain policy recommendations could be made. During an EPDP meeting, the team debated whether: 1. To send the set of legal questions to the EDPB for input, and 2. To send the Initial Report to the EDPB along with certain messages: o the Initial Report is available for their review and comment, o the Initial Report is a prelude to the Final Report, likely to become ICANN Policy, and o that we are wading through certain legal questions and are getting independent input on those So far, we have decided to do neither, primarily for two reasons. First, the EDPBs own writings and the personal experiences of some EPDP members indicate that the EDPB is NOT a consulting resource. The EDPB provides advisories and guidance to governments and DPAs. The EPDP team determined that we should seek answers to our legal questions through independent legal advice and, perhaps through DPAs. Second, perhaps recognizing that the Initial Report had not yet resolved all issues, the EPDP Team thought that is would not yet be a good use of the EDPB’s time and good will to ask them to opine on something that is incomplete. So, other than a notice that ICANN is working on GDPR issues and is making progress, the team believes that a letter to the EDPB would have little to offer. It was suggested that such a letter would be useful as it would serve to manage EDPB expectations: so that the final report would not provide the “first look” at our work. While some in the EPDP that agreed with this, there were also strong opinions in the EPDP that the letter as currently drafted and timed might actually harm relations with the EDPB. Given that one cannot “unsend” a letter, it was decided to hold off for the time being. As we progress our discussions and watch the interactions between the EDPB and ICANN or between the EDPB and other organizations, we can continue to re-assess our decision and possible send a notice (or a more meaningful notice) at a later date. CONSENT AGENDA Motion - Adoption of the GNSO Review of GAC Communiqué for submission to the ICANN Board - deferred from the November 2018 meeting Submitted by Pam Little, seconded by Rafik Dammak Whereas, 1. The Governmental Advisory Committee advises the ICANN Board on issues of public policy, and especially where there may be an interaction between ICANN's activities or policies and national laws or international agreements. It usually does so as part of a Communiqué, which is published towards the end of every ICANN meeting. 2. The GNSO is responsible for developing and recommending to the ICANN Board substantive policies relating to generic top-level domains. 3. The GNSO has expressed a desire to provide feedback to the ICANN Board on issues in the GAC Communiqué as these relate to generic top-level domains to inform the ICANN Board as well as the broader community of past, present or future gTLD policy activities that may directly or indirectly relate to advice provided by the GAC. 4. The GNSO hopes that the input provided through its review of the GAC Communiqué will further enhance the co-ordination and promote the sharing of information on gTLD related policy activities between the GAC, Board and the GNSO. Resolved, 1. Nomination of a Mentor for the ICANN Fellowship Program Submitted by: Erika Mann Seconded by: Maxim Alzoba Whereas, 1. On 16 October 2018, the ICANN Fellowship Program invited ICANN’s Supporting Organizations and Advisory Committees to nominate one individual each (total of 7) to serve on the capacity of Fellowship Program mentor for the 2019 calendar year (see https://www.icann.org/news/announcement-2-2018-10-16-en) 2. On 20 November 2018, the GNSO launched an Expression of Interest (EOI) process to solicit volunteers for the GNSO-nominated mentor position (see https://gnso.icann.org/en/announcements/announcement-20nov18-en.htm) 3. The GNSO Council tasked the GNSO Standing Selection Committee (SSC) with reviewing applications and recommending one individual for the GNSO to nominate. 4. The SSC reviewed the applications received, taking into account the criteria outlined in the EOI announcement. 5. The SSC submitted its full consensus recommendation to the GNSO Council on 19 December 2018. 6. The GNSO Council considered the recommendations of the SSC. Resolved, 1. The GNSO nominates Andrew Mack to serve as a ICANN Fellowship Program mentor for a period of one year. 2.
