Dear Council Members: I just wanted to apprise the Council of the following action items that the ICANN Board took during our teleconference earlier this week. To date a copy of the preliminary report has not yet been posted, http://www.icann.org/minutes/. However, I am confident that ICANN staff will see to the posting of this document within the five business day timeframe. In fact, I believe it is important to acknowledge the increased efficiency which John Jeffrey has been posting these documents which are part of the bedrock of ICANN's bottom-up, open and transparent process. Approved the Minutes from our last teleconference; Approved execution of the .MOBI registry contract Approved ICANN's continuing budget resolution Approved .HK Redelegation Request Approved financial expenditures in connection with legal bills Approved reimbursement of Director's travel expenses Approved staff to move forward with contractual negotiations with regard to .TEL application (http://www.icann.org/tlds/stld-apps-19mar04/tel-telnic.htm) During the call I also requested an update on the .NET contract negotiations. As you may be aware this contract was recently executed by VeriSign and ICANN and will go into effect July 1, 2005 (tomorrow). VeriSign has sent out notification to the registrars yesterday evening. I have asked ICANN staff to expeditious post the final .NET contract and its appendixes on the ICANN website as soon as possible as I know a number of members of the ICANN community had concerns regarding the initial draft contract. U.S. principles on the Internet's Domain Name and Addressing System

Palage Today Assistant Secretary Michael Gallagher made an announcement on the U.S. principles on the Internets Domain Name and Addressing System, see http://www.ntia.doc.gov/ The Principles are: U.S. Principles on the Internets Domain Name and Addressing System The United States Government intends to preserve the security and stability of the Internets Domain Name and Addressing System (DNS). Given the Internet's importance to the worlds economy, it is essential that the underlying DNS of the Internet remain stable and secure. As such, the United States is committed to taking no action that would have the potential to adversely impact the effective and efficient operation of the DNS and will therefore maintain its historic role in authorizing changes or modifications to the authoritative root zone file. Governments have legitimate interest in the management of their country code top level domains (ccTLD). The United States recognizes that governments have legitimate public policy and sovereignty concerns with respect to the management of their ccTLD. As such, the United States is committed to working with the international community to address these concerns, bearing in mind the fundamental need to ensure stability and security of the Internets DNS. ICANN is the appropriate technical manager of the Internet DNS. The United States continues to support the ongoing work of ICANN as the technical manager of the DNS and related technical operations and recognizes the progress it has made to date. The United States will continue to provide oversight so that ICANN maintains its focus and meets its core technical mission. Dialogue related to Internet governance should continue in relevant multiple fora. Given the breadth of topics potentially encompassed under the rubric of Internet governance there is no one venue to appropriately address the subject in its entirety. While the United States recognizes that the current Internet system is working, we encourage an ongoing dialogue with all stakeholders around the world in the various fora as a way to facilitate discussion and to advance our shared interest in the ongoing robustness and dynamism of the Internet. In these fora, the United States will continue to support market-based approaches and private sector leadership in Internet development broadly.

It does appear that due process has been short circuited and whilst it may have been possible to argue this was urgently required to bridge a gap in the near term, a 9 to 12 month appointment does not support that case. Support is offered for the proposals made by Grant. My suggestion and request is that: - Paul Twomey appoint one of his senior staff to work with the GNSO Council to recruit a new Senior Vice President, Policy - Council appoint a small committee (say 3 people?) to work with the senior ICANN staff member on the appointment's panel - an open and transparent international search be undertaken to fill the position of Senior Vice President, Policy - the appointment's committee be tasked with making a recommendation of appointment to the President within 90 days. I look forward to your and fellow Councillor's response to my request and getting this process underway without any further delay. This was the ALAC's view as well: have the Council define the standard but give the registrar sufficient flexibility in the implementation to take account of language and cultural differences in its customer base. The Council decided form a working group with a representative group of volunteers from the GNSO to review the staff Transfers report in order to seek clarification, further information and provide guidance for the 6 month review and to report back to the Council. This is a call for volunteers that wish to participate and work with the ICANN staff. Ross Rader has volunteered to act as chair of this working group. See below for a description of the working group task. GNSO Council members should forward the names of volunteers to the GNSO Secretariat within 7 days, and the GNSO Secretariat will then arrange a time for a teleconference with the working group and ICANN staff. The aim should be to report to the Council at the GNSO Council meeting in Luxembourg. The GNSO Council will then use the report as a basis to request the staff to carry out specific tasks necessary to produce the 6 month report. Regards, Bruce Tonkin I Background ============ Recommendation 28 of the Consensus Policy on Transfers: (http://www.icann.org/gnso/transfers-tf/report-12feb03.htm ) states: (I have replaced references to the DNSO and Names Council with the new terms) "That the implementation and execution of these recommendations be monitored by the GNSO. Specifically that; a. ICANN Staff analyse and report to the GNSO Council at three, six and twelve month intervals after implementation with the goal of determining; i. How effectively and to what extent the policies have been implemented and adopted by Registrars, Registries and Registrants, ii. Whether or not modifications to these policies should be considered by the GNSO as a result of the experiences gained during the implementation and monitoring stages, iii. The effectiveness of the dispute resolution processes and a summary of the filings that have been resolved through the process. b. Pursuant to which, the GNSO Council may instruct the staff to; i. Continue bi-annual reviews in a manner consistent with the aforementioned requirements, or; ii. Report again to the GNSO Council in an additional twelve month time frame. c. The purpose of these monitoring and reporting requirements are to allow the Names Council to determine when, if ever, these recommendations and any ensuing policy require additional clarification or attention based on the results of the reports prepared by ICANN Staff." The ICANN staff have produced a 3 month report dated 14 April 2005, available at: http://www.icann.org/transfers/transfer-report-14apr05.pdf The report is based on public comments received, statistics from registry operator reports, and questions and complaints received by ICANN staff. Note also that the ICANN Security and Stability Advisory Committee is preparing a report on domain name hijacking, and one of its possible recommendations which was discussed in the ICANN meeting in Mar Del Plata was making it mandatory for a losing registrar to send a notification to the Registrant (this is presently optional for the losing registrar). Note that it is still the gaining registrars responsibility to authenticate the registrant, and receive authorisation. II Working Group task ====================== The task of the working group is to: (1) review the content of the report of 14 April 2005 with respect to: i. How effectively and to what extent the policies have been implemented and adopted by Registrars, Registries and Registrants, ii. Whether or not modifications to these policies should be considered by the GNSO as a result of the experiences gained during the implementation and monitoring stages, iii. The effectiveness of the dispute resolution processes and a summary of the filings that have been resolved through the process. (2) Identify the work items for the 6 month review. In particular determine what additional information and analysis is required to assist the GNSO in determining whether any refinements are required for the policy. Note this analysis may include a similar process to that used in the recent analysis of the practices of registrars with respect to requirements of registrars to provide information on the purpose for data collection and information on the recipients of the data. In this analysis an ICANN staff member documented the business processes used by the top 10 registrars, and a 10 other registrars chosen randomly. This analysis could complement the anecdotal evidence provided from public comments and queries received by ICANN staff. III Deliverable ================ The working group should produce a report to the GNSO Council with recommendations to the GNSO Council for work to be done by ICANN staff in the 6 month review.

Hello Marilyn, The staff are preparing a paper for the Board meeting in Luxembourg on the external review of the GNSO Council undertaken last year. Although the Board approved a change to the bylaws that related to the number of representatives per constituency on the GNSO Council at its meeting in Mar Del Plata, the Board has yet to consider the external reviewers report in total. I would prefer a dialogue between the Board and the Council on this report. The Council reports directly through to the Board. I believe the Board should review the recommendations and communicate to the Council which recommendations it believes should be implemented - or even better, which recommendations should be prioritised. With respect to the recommendations that are endorsed or prioritised by the Board, I think the Council can report on progress within an annual report. The resourcing to work on the recommendations will need to part of ICANN's operational plan. I agree with your suggestions for additional material in the annual report. We do need to look forward 1 year (operational plan) and 3 years (strategic plan), and also look a relationships with the other SO's. Regards, Bruce
