Dear councilors, The following resolution was passed by the GNSO Council at its meeting on Tuesday 30 January 2018. It has been posted on the GNSO website here: https://gnso.icann.org/en/council/resolutions#201801 Adoption of Revised GNSO Operating Procedures and Proposed Modifications of the ICANN Bylaws consistent with the recommendations of the Bylaws Drafting Team. Submitted by: Rafik Dammak Seconded by: Darcy Southwell WHEREAS: 1.On 30 June 2016, the GNSO Council approved the creation of a Drafting Team (DT) that was to work with ICANN staff to "fully identify all the new or additional rights and responsibilities that the GNSO has under the revised Bylaws, including but not limited to participation of the GNSO within the Empowered Community, and to develop new or modified structures and procedures (as necessary) to fully implement these new or additional rights and responsibilities"; 2. In creating the DT, the GNSO Council requested that the DT provide the GNSO Council with an implementation plan "which will have the consensus of the Drafting Team, including any recommendations for needed further changes to ICANN Bylaws and/or GNSO Operating Procedures to enable effective GNSO participation in ICANN activities under the revised ICANN Bylaws, not later than 30 September 2016"; 3. The DT submitted its Final Report to the GNSO Council on 12 October 2016 (https://gnso.icann.org/en/drafts/bylaws-drafting-team-final-report-12oct16-…<https://urldefense.proofpoint.com/v2/url?u=https-3A__gnso.icann.org_en_draf…>); 4. On 1 December 2016, the GNSO Council accepted the recommendations in the DT's Final Report and directed ICANN Policy Staff to draft proposed language for any necessary modifications or additions to the GNSO Operating Procedures and, if applicable, those parts of the ICANN Bylaws pertaining to the GNSO. The GNSO Council also requested that ICANN Legal evaluate whether the proposed modifications were consistent with the post-transition Bylaws and report their findings to the GNSO Council; 5. Staff worked with the Bylaws DT to address any open issues, inconsistencies identified and confirm assumptions. As a result, the staff report on how each recommendation was addressed as well as proposed changes to GNSO Operating Procedures & ICANN Bylaws were published for public comment on 19 June 2017 (see https://www.icann.org/public-comments/gnso-op-procedures-2017-06-19-en[ican…<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.icann.org_public-2…>); 6. The public comment period closed on 10 August 2017, with the report of public comments published on 1 September 2017 (see https://www.icann.org/en/system/files/files/report-comments-gnso-op-procedu…<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.icann.org_en_syste…>). 7. The GNSO Council reviewed and discussed the proposed changes as well as comments received during subsequent meetings in September and October and during the GNSO Council Strategic Planning Session (29-31 January 2018). 8. As resolved previously, the GNSO Council intends to subject the adoption of the proposed modifications to existing procedures and/or ICANN Bylaws to a GNSO Supermajority vote. RESOLVED: 1.The GNSO Council adopts the proposed modifications to the GNSO Operating Procedures (see https://gnso.icann.org/en/council/proposed-revisions-gnso-op-procedures-red…<https://urldefense.proofpoint.com/v2/url?u=https-3A__gnso.icann.org_en_coun…>), including the two minor updates as suggested by staff in the report of public comments in response to input received from the Registrar Stakeholder Group and Intellectual Property Constituency. 2. The GNSO Council instructs ICANN staff to post the new version of the GNSO Operating Procedures, effective immediately upon adoption. 3. The GNSO Council recommends that the ICANN Board of Directors adopt the proposed changes to section 11.3.i of the ICANN Bylaws to reflect new GNSO voting thresholds which are different from the current threshold of a simple majority vote of each House (see https://www.icann.org/en/system/files/files/proposed-revisions-bylaws-artic…<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.icann.org_en_syste…>). Dear Councilors, As mentioned during the GNSO Council Strategic Planning session, staff has committed to share some materials for your review and consideration. Firstly, you can find the letter from the New gTLD Subsequent Procedures PDP WG co-chairs on Work Track 5 (geographic names at the top-level) to the chairs of the ALAC, ccNSO, and GAC on the GNSO Correspondence page or directly here: https://gnso.icann.org/en/correspondence/langdon-orr-neuman-to-ccnso-alac-g… Secondly, it was mentioned that there are supplemental materials to the CCWG Framework. The CCWG Framework in its entirety and as adopted by the GNSO Council is available here: https://gnso.icann.org/drafts/uniform-framework-principles-recommendations-…. However, staff developed a “user guide” of sorts to help in understanding the framework and that can also be found on the GNSO Correspondence page, or directly here: https://gnso.icann.org/en/issues/ccwg/ccwg-recommendations-framework-princi…. In addition, a comparison chart (attached) was developed to highlight the differences between CCWGs and GNSO PDP WGs, and in doing so, to help the community in determining the applicability of the CCWG model for resolving a particular issue. Sending on behalf of the Council Leadership ___ All Please find attached two versions of the Agenda for our Strategic Planning Session to be conducted next week in Los Angeles. One is a simple version of the agenda that gives you a good overview of the three days, while the detailed agenda provides you with more information about the goals/objectives for each session along with required reading. The required reading is an important part of your preparation for the three days and we sincerely hope that you will take the time to either refresh your memory of a number of the documents or make yourself familiar with them for the first time. It is our hope that as we work through the agenda and discuss the relevance and importance of these documents it will provide us all with a working understanding of how they apply in our work as the GNSO Council. In order to assist you in this regard, a Google drive has been created that contains all the materials that are required to be reviewed and read prior to the meeting, as well a number of documents that provide additional background information but which are of an optional nature (Please see here<https://drive.google.com/drive/u/1/folders/1BZtK5S4pC1Fx9hkieNS5Nm1WwPvM1-yF>). The detailed agenda identifies the documents that will be relevant to each day. Please make sure to take the time to review at a minimum the required documents as it will be imperative to have a common understanding and background with regards to the topics under discussion.
